IV.
In the event that all or any part of said county road or roads shall become a primary
state highway, and thereafter, by renoon of the construction, repair, improvement, al-
teration or relocation of all or any portion of said primary sta.te highway as det.ermined
by the Director cf Highways of the Stnte of Washington, it snall become necessar}', in
the opinion of said Dir~ctor of Highways, to remove or relocate any or ell of said
electric po~:er transmission circuits end appurtellant fixtures from said highway, the
holder ae;rees to remove or relocate said 91ectric pOl'/er tran::l":l.ssion circuits and
appurtenant fixtures immed:l,ately, and at H3 OWIl expense, to the plece 01' pIa-cas on said
state highway designated by soid Director of Highways, pursuant to Title 41, Chapter IX,
Volume 7A, Remington's Revised Statutes of Washington.

The work of constructin~, removing and relocating all or any part of said electric
pOI...er transmission circuits and fixtures appurtenant t,hereto s'JC'.ll be performed by the
holder in compliance with paragraph I, and ~rithatlt unnecessary interference with traffic
upon or along said county road or r03d~. None uf such work shall be undertaken or
cnt'l'ied on withou'jj ten days' written notice havtng been first Civen to said Board of
County Commissioners.

, Any and all damage or injut:y done or daused to be done to sal d county 1'0 ad or roads ~
or to eny portion thereof, in the construction, operation or ma~ntenance of said electric
power transmission circuits shall be immediately repaired and reconstructed by the holder
under the supervision and to the satisfaction of said Board of County Cornm~_ssioners.
Except where, in the opinion of the Board of County Commissioners an emergency exists,
notice in writing of such repairs or reconstruction required of the holder hereunder
shall b~ given to the holder. Upon the failure and neglect or refusal o~ the holder to
do and perform immediately after receipt of such notice any repairs or reconstruction
of said county road or roads herein required of the holder, or in an emergency without
, prior notice, the Board of County Commissioners may undertaKe and perform such repairs
or reconstru.ction and the reasonable cost thereof inchtding a reasonable sum for overhead
~dll be paid by the holder in accordance with standard government accounting practices
, upon presentation of properly executed vouchers therefor. Whenever the Board of County
> Commissioners shall perform or cause to be performed any of the work contemplated in this
paragraph the wages of every laborer and mechanic employed in the pp.rform!lnce (If said,
work shall be computed on a basic day rate of eight hours per day and work in excess of
eight hours per day shall be permitted only ~poh the condition that every sucp laborer
and mechanic shall be compensated for all hours worked in exceS3 of eight hours per day
at not less than one and one-half times the basi c rate of pay. For each vt ole,tion of
the requirements ~of this provision, a penalty of nve dollars (:$5.00) shall be imposed
upon the county lor each laborer or mechanic for every calendar day in which such employees
shall be required or permitted to labor more than eight hours upon said work without
receiving compensation computed in accordance with this provision and all penalties thus
imposed shall be ~dthheld for the use and benefit of the holderj provided, further, that
not person undergoing or serving a sentence of imprisonment at hard labor shall be required
or permitted to perform any of sHch work.

This franchise is granted pursuant to the provisions of section 6450-38 Remington's
Revised Statutes of Washington.

The holder shall, within twenty days from receipt of a copy of this order, file
the Board of County Commissioners at POR'1' 'I'CJ\'!NSEND, l'1ashington, it s wri ttcn accept-
