The Board of Jefferson County Commissioners met in special session this date, with the members of Key City Post No. 14951 Veterans' of Foreign Wars, to discuss suitable terms for a l:ase of the Veterans' Ha 1. W. J. Daly, Prosecuting Attorney read the proposed lease, which was agreeable to all parties. Upon motion made by James Yarr, seconded by Berti1 Kruse, and unen1mous1y carried, the County Commissioners approved the lease and signed same. Arnold J. Sather, Commander and Francis J. Bladk, Adjutant, signed tor the V. F. W. Post. Upon motion made 1:-3 T'l'n~s Yarr, seconded ~y BertU Kruse, the County agreed to pay all bills for maintenance up to April 1st. The lease is as follows: LEASE THIS LEASE, made and entered into this 1st day of April, 1952, by and between the BOARD OF COUNTY COMMISSIONERS for Jefferson County, St~te of Washington, party of the first partl and PORT TmmSEND POST No. 1495, VETERANS' OF FOREIGN I,olARS of the UNITED STATES, ~ corporat on, party of the second part, WITNESSETH: WHEREAS, the provisions of section 4019 et seq., Remington's Revised Statutes of Washington, having been complied with, and an order, under date of February 4th, 1952, authorizing and directing the execution hereof having been regularly entered in the proceedings of the party of the first part, now therefore, IN CONSIDERATION of the sum of $15.00 annually to be paid to the County Treasurer of said Jefferson County yearly in advanco on or before the first day of each succeeding April as hereinafter set forth (the sum of $15.00 for the first year's rent having been heretofore paid, the receipt whereof is hereby aCknowledged) the said Board of County Conunissioners, party of the first part, has hereby leased and let, and by these presents does hereby leasa and let unto the party of the second part, for the period of 10 years, that is to say, from the first day of April, 1952 to the first day of April, 1962, the following lands and premises in Jefferson County, State of Washington, to-wit: West one-half of Lot 3 in Block 39 of the Original Townsite of theCity of Port Townsend These premises are leased and let primarily for use by the party of the second part as a meeting place and social hall for its members, and the members of its auxiliary, nut nothing Shall prevent the party of the second part from sub-leasing, sub-letting or renting W1Y portion of the building located thereupon, provided that such sub-leasing, sub-letting or renting shall not be for a continuing competitive business purpose, AND, it is particularly understood and agreed that the exec~~ion hereof shall in no event disturb the use and occupancy of the lower floor of the building by the United Service Organiza~on, a corporation, or its successor, but that use and occupancy shall remain and continue as long as such occupancy is necessary or desirable, the party of the first part, fully recognizing to the United States Department of Defense the duty and responBib- iHty o'A'ing by ,Jefferson County, and its citizens, to provide recreational and like facilities to members of the armed forces serving locally, in aid of morale and maintenance of good military order and discipline. IN ADDITION to the yearly rental heretofore reserved, the party of the second part, agrees to pay from this date forward all charges for power, lightp water, telephone service, and simlllU4 utilHle3, and to keep the premises fully insured against loss by fire, to pay the recurring premiums therefor and deliver all policys to the party of the first part. The party of the second part, further agrees, at its own expense, to keep said building in a reasonable state and condition of repair. Any desired changes in floor plan or design must first br;l submitted to the patty of the first part for approval. In CASE of the failure of the party of the second part to fully and promptly perform all covenants and requirements hereunder, this lease shall cease and determine and all rights of the party of the second part thereby forfeited. Rene\1al of this lease must of necessity be secured in the manner provided by statute, but insofar as permitted or authorized, the present members of the Board of County Commis- sioners, constituting the party of the first part, so recommend. IN WITNESS WHE H80F, the said Board of County Commissioner s, party of the first part, have caused this instrument to be executed in duplicate by authority of a resolution heretofore adopted, and the seal of said Board affixedj and the said party of the second part affixes ita corporate name and causes these presents to be executed by its authorized officers. All of WHICH is done at Port Townsend, Washington, this 1st day of April, 1952.
