WHEREAS, this Board of County Commissioners does now find and detennine that thei II
acquisition of the following described state land, \'i1ich is School Land as the same is
defined by ROW 79.01.004, by Jefferson County, to-wit: I

BE IT RESOLVED . II
(1) That the Prosecuting Attorney for Jefferson CountYJ be and he is her~,by directe~
to prepare for execution and delivery to the Attcrrney General of the State of Washington i,
a warranty deed to the county owne,d lands as hereinbefore described; II
(2) That the Puget Sound Title Insurance Company be and it is hereby induced to iss~e
its standard form of purchaser's poll cy of title insurance insuring the ti tle of the land!!
which the State is to aequin with liability fixed at the sum of $5,000.00, and that the iI
premium therefor be chargeable to and paid for from the County Road Funds; II
(,3) That all details relative to the closing of the land exchange transaction herebt
authorized, including receipt and approval of the State's conveyance and the delivery of ii'
County deed and policy of title insurance shall devolve ,upon and become the duty of the r
Prosecuting Attorney for Jefferson County. II

An agreement was signed with the Dept. of Game for use of County Road right of way
in s1fk Sec. 25 T. 28N R 2W, 'W.M.. for installation of 1 double drum electrically driven
,fish screen together with necessary supporting structure, diking and power pole.

WHEREAS, The United States has made Rulable funds for a project for flood control..

;iE-45-l-4 in sheet, dated June l';l6l, attached hereto and made a part hereof; and !i
i WHEREAS, In accordance with the provisions of the Flood Control Act, approved 22 ii
liJune 1936, as amended (33 USC Section 701C)i and pertinent administrative determinations Ii
:isuch funds cannot be used until a responsib e local agency has given assurances satisfactory
,:to the Secretary of the Army that it will: :
a. Furnish without cost to the United States all lands, easements, rights-of-way, :~
and rights-of-entry. and perform all necessary alterations to utili ties; .1
:. b. Hold the Unl ted States free from any claims for d.o.mages arising out of the con-
;struction;
! c. Maintain and operate tho project works, after construction;
