The East 660 feet of the Southeast Quarter of
the Southwest Quarter and the lIest 330 feet of the
Soutpwe~t quarter of the Southeast Quarter, Section
8, Township 30 North, Range 1 West, of the Willamette
Meridian, all lying and being in Jefferson County,
. State of Washington.
2. Length of Term and Rent. TO HAVE AND TO HOLD the said premises for the term
of one year beginning on April 1, 1962 and ending on March 31, 1963, for a rental of
One Dollar ($1.00) per year, payable on or before the 15th day of April, 1962, and, in
the event of ~enewal of said Le~se, on or before the 15th day of April of e~ch subsequent yea
year of any e.xtension. '
3. Option to Renew Lease. The parties shall have the option to extend this Lease
for a period pf one year from March 31, 1963, upon written notice each to the other in
writing, info.rming- each other that the appropriate officers or each have acted to approve
renewal of sa,id Lease, and fuether provided that any renewal hereof shall be subject to
negotiation ~s to rental and all other ~aterial terms.
4. Lessor's Hi ht to Use of Premi~es. The Lessor reserves the right to dump garbage
and other re use upon escr~ e pre ses or its own use, or for citizens of Jefferson
County, and ~rther reserves said right in behalf of the citizens of Jefferson County,
provided that, such us~ may be limited bJ an agreement between the parties hereto which may
hereinafter b.e made as to charges for dumping of garbage by the publJ.c or for limitation
of hours of u~e by the public on said described premises.
5. Duty of Lessee to ~~intain. The Lesses expressly agrees to take the premises
for the purpo~es of using the same as a garbage or refuse dump only, and shall use and
occupy the premises only for that purpose, and said garbage or refuse dump shall be
operated as a: sani tary fill dump, and shall conform to all of the applicable laws and ,
regula tions concerning such dumps, together wi th all of th e applicable laws and regulati:ons
for the prote.ction of the health and safety of all of the citizens of the said County. :
The Lessee further agrees to provide all of the equipment, labor and materials which may
be necessary in order to maintain the said premises as a sanitary fill garbage dump, and
that the providing of such equipment, labor and materials and the operation of such dump
shall constitute a part of the consideration herefore.
6. Right of Lessee to Rep;ulate. The Lessee is hereby granted the rightfu make
regulations for the handling and disposJ. tion of garbage and other refus e brought on to
the described premises, and to limit the nature of such garbage and refuse for the
purposes of maintaining a sanitary dump.
7. Mode of Operati on". The Lessee shall provi de adequate and reasonable rodent
control, controls of flies, odors and unsightliness and shall provide for su'ch compacting
and covering of garbage and refuse as is required to operate and maintain a sanita~J fill
garbage dump up to minimum standards of the State of ~ashington Department of Health,
and the Lessee shall neither conduct nor permit any burning of any material on the
described premises unless and until the provisions of Ordinance No. 1416 of the 'City of;:
Port townsend, Washin~ton, and particularly Section 2 thereof, shall be amended to permit
such burning or any burning.
8. Sub-Leasing. The Lessee shall not sub-let the premises or 'any part thereof or
assign this Lease without the written consent of the Lessor.
9. General Purpose. The purpose of entering into this Lease by each of the parti s
aforesaid is to provide for the health, safety and welfare of the citizens of the City
of Port Townsend and of Jefferson County, Washington, and to that end each of tire parti s
agrees to arbitrate and negotiate on all subjects relating to the establishment and
management of a sanitary fill garbage dump on described premises for the purpose of
maintaining the best feasible garbage dump thereon subject to the best interest ~f the
citizens of euch of said parties.
IN IilITNESS 1iHEREOF, Jefferson County and the City of Port Townsend, acting ,through
their, duly, authorized undersigned representatives herennto affix their signatures and
seals, and have caused their respective secretaries and clerks to attest the same with
their seals hereto affixed, pursuant to the authority duly granted to them by the laws
of the St~te of lIashington and the County Resolution and City Ordinance hereinabove
mentioned.
