C-S40 WHEREAS, the Department of Highways of the State of Washington, acting as Agent of and for the Bureau of Public Roads of the Department of Commerce of the United States of America, is desirous of constructing a Federal Aid Project No. S-0322(5) & S-0496(;) Jefferson County, over and across the NE: NW; and the NW;NW; of sec. 14, the SW~5W~, the NWtSW; and the SW:NW; of sec. 11, the S~NE;, and the NE;NE;, of Sec. 10, the sm~SEt. the NE;SE;, the NWtSE4 the SWtNE; Lot 2 and Lot'3 of sec. 3; T. 29 N. R 1 W., W. M.' the SE; SW4, the SW;SWi, the NW;SW; and the 5W;NW; of sec. 34, the SE~NE; and the NE;NE!of sec,'33, the SE;SE;, ,the SW;SE;"the NW;SE;, the NE;NW;, the SE;NW;, the NE;NWt and the NW;NW; of Sec. 28, and the SW;SW~ of sec. 21, T. 30 N., R 1 W., W.M. " I and WHEREAS, the Department of Highways of the State of Washington, acting as Agent for the United States Bureau of Public Roads, is desirous of receiving Federal funds for the improvement of s aid road, and . WHEREAS, the said Bureau of Public Roads of the Department of Commerce of the United States of America will not participate in the construction of said road until and unless the County of Jefferson will agree to refrain from permitting encroachment upon the right of way of said above-mentioned road, and until and unless the County of Jefferson will agree to refrain from passing resolutions affecting the free flow of traffic on said above- mentioned road or that will give preference to local routes Which intersect with said road, other than by th.e erection or install~tion of "slow" and/Qr "caution" signs or signals, or that will unreasonably hinder or delay traffic.on said above-mentioned road,. and until and unless the C,ounty of Jefferson will agree, by suitable resolution, to adopt the grad~s of the improvement as the grades of the county road that is involved, and agree to protect the State of W,shington against any anp all. claims for, damages on account of any changes ,of grades and the cOnstruction of this improvement, and until and unless the County of Jefferson will agree to maintain said improvement within the limits of the County of Jefferson ,after the improvement has been completed; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Jefferson County that for andin consideration of the Department of Highways of the State of Washington and the Bureau of Public Roads of the Department of Commerce of the United States of America constructing said road and routine; traffic on same over and a crossthe NE;NW; and the NW;NWk of sec. 14, the SW;SW;, the HW1SWt and the SW;NW; of sec. 11 the SE;NE;.and the NE;NE;.of, sec. 10, the SEtSE4, the NEiSE!, the NW~SE~ the SW;~~t., Lot 2 and Lot 3,of sec. 3 T. 29 N., R. 1 W.1_W.M.; theSE;SW;, the SW;SW;, the NW!SW; and the SW;ffi'l; of sec. 34, the SEtNEt and the NE;~~; of sec. 33, the SE;SEi, the SW;SE , the NW;SE;, the,NE;NW;, the SEtNWi,.the NE; NW; and the NW;NW; of sec. 28. and the SW!SW of sec.,211 T. 30 N., R L W., W.M., . . . . . " , , Jefferson County hereby agrees with the Department of Highways of the State of Washington and the Bureau of Public Roads of the Department of Commerce of the United States of America that it will not, in the future, permit encroachments on the right of way of the said above-mentioned road, nor will it pass any resolutions affecting the free flow of traffic on s aid above-mentioned road or that will gI. ve preference to local routes which inter.sct: with s aid road, other than by the erection or ins1allation of "slow" and/or "caution" signs or signals, or that will slow uP, unreasonably hinder, or delay traffic on said above-mentioned road, and that it will, by sUltable resolution, adopt the grades of the improvement as the grades of the county road that is involved, and hereby agrees to protect the State of Wash- ington against any and all claims for damages on account of changes of grades and the con- struction of this improvement, and hereby further agrees to maintain said improvement witbin the limits of the County of Jefferson after this improvement has been completed. Attn: State Aid Division Dear Sir: The Board of County Commissioners of Jefferson County hereby agrees that upon county concurrence and the award of the contract, for: Fe,derlll Aid Secondary Project No. 5-0322(5) & S-0496(3) Chimacum-Townaend Road and Chima cum-Center Road, it will execute the required Finance Resolution and Agreement to provide reim~ursement to the State for all funds expended on the project. The amount of Federal Aid participating funds will be returned to tho counties when received from the Bureau of Public Ro~ds.
