AGREEMENT
THIS AGREEl.mNT, made and entered into this 20th day of May, 1963, by and between the
State of Washington, Washington State Highway Comission, acting by and through the
Director of Highways, hereinafter referred to as the "State" and the Board of Jefferson
County Commissioners, hereinafter referred to as the "County".
WITNESSETH:

State, and ,
WHEREAS, the aforementioned project includes oonstruction of a grade separation at
the intersection of County Road FAS No. 497 as shown on the attached map entitled
Secondary State Highway No. 9-E, intersection with Jefferson County Road FAS No. 497,
and entitled Exhibit "Aft mich by this reference shall be made a part of this agreement,
and,
WHEREAS, the State Contemplates improving the old county road as shown in red on
Exhibit "A" to be used as a det01.1r during the cc)nstroction of said grade separation.
NOW THEREFURE,the parties hereto mutually agree as follows:

The County agrees that the State may improve old <x>unty road as shown in red on
Exhibit "A" by shaping and paving and use the road during the construction of the grade
separation.

The County further agrees that when the grade spearation has been constructed, traffii::
transferred from the detour road to the County Road .FAS No. 497 and the State has no '
further need for the old road, the County will accapt the detour road, as shown in red
on Exhibit "A", as a county road in its existing condition '{{hen notified in writing by
the State that the State has no further need for the. read and is transferring it back to
the County.

The State agrees at State expense that it will re-shape and pave the old county road
~d maintain same d.uring the construction of the grade spearation.

It is further agreed that no Uability shall attach to the State or the County
except as expressly provided herein.

: No further business appoaring tha meeting was adjourned to meet in regular session on
