Mr. Lloyd McGath and Mr. Cyrus Myers appeared, Commissioners of Water District No. , 1. requesting the Board to appoint Mr. Sidney G. Cartwright Commiesioner of the DistrictJ! to fill the vacancy of Arthur White, deceased. Upon motion of George Huntingford. ' seconded by Lyall Arey. Mr. Cartwright was appointed to fill the vacancy. This being the time advertised for hearing on the application for franchise for Bonneville Power Administration's transmisaion line across the \'lest Uncus Road No. 34. in Sec. 26, T. 29N., R 2 W. W. M., and all posting and publication huvine; been done in accordance with the law. the members of the Board of Commissioners for Jefferson County signed the Fr,mchise as follows: I BEFORE THE HONORABLE BOARD OF COUN'l'Y cor.U'lISSIONERS OF JEFFERSON OOUNTY, WASHINGTON. FRANCHISE I e The application of the United States of Ameri ca, Department of the Interior, acting through the Bonneville Power Administrator, and its assigns, for a franchise to construct, operate and maintain one or more electrj,c power transmission cLrcuits \..rith appurtenant fixtures across. over and upon the right of way of the county road or roads hereinafter described, having come regularly on for heari ng on the 3rd day of May, 1965,' before the Board of County Commissioners of Jefferson County, Washington, under the I provisions of R. C. W. 80.32.010, and it appearing to the Board of County Commissioners' that public notice of said hearing was duly glve."l as required by law, and that it is for the publiC interest to grant the fran chi se applied for, it is ORDERED that a franchise be and the same hereby is granted to the United States of America and its assigns (heret.nafter referred to as "the holder"), fur a period of fifty years from the date of the entry of this order, to construct. operate and maintain one or more electric power transmission circuits together with the necessary towers, .. poles and other fixtures appurtenant thereto. subject to the tems and conditions here- , inafter enumerated, across, over, and upon the right of way of the followin g described county road or roads or portions: The centerline of the Bonneville Power Administration's transmission line crosses tract: 2F-PA-)A - The certerline of a Jefferson County Road No.3 4, known as West Uncas Road at BPA survey station 39 ~ 26.6 in the SWkNEk of Section 26, Township 29 North,. Range 2 \~est. Willamette Meridian, Jefferson County, Washine;ton, as shown on Drawing, Serial No. l30401 DTM-D. I, I. All construction, operation and maintenance of and repairs to said electri c power transmission circuits and fixtures appurtenant thereto shall be performed in accordan.ce with applicable state laws, and the specLficationa, rules und regulutiona of the latest edition of and supplements to the Naticool Electrical Safoty Code promulgated by the United States Bureau of Standards. Said ele ctri c power tranamiaalon c:1r cuits shall at all times be constructed, operated und maintained so as not to interfere unduly with the use of said county road or roads or endanger the safety of the traveling public thereon. . I II. AIL oosts of construction, repair, alteration, relocation or rumoval of ouid electric power transmission circuits and appurtenant fixtures shall be paid by the United Stutes of America. III. Whenever, by reason of the construc tion, repai r, improvement ulterf.ltion or reloca~ tion of aaid county road or roado, or any portion thtlreof, it sh~h beoome neceosury, . in the opinion of the Board of County Commissioners, to remove or relocate any part or, all of aaid electric power tranomiosion circuits und appurtenant fixturefl from aaid ' county road or roada, the holder agrees to romove or relocute Baid eleotric power trano'" mission circuits and apPul'tenunt fixtures immediately, and at. its Olfm expenae within the limits of appropriations uvailabl& therefor, to the pIneo or place/J on a aid county road or roads designuted by the Board of County Commissione;se IV. In the event that all or any purt of aaid county roud or rondo ohall become a primurer stute hi/91WaYi and thoroafter, by reason of the conatruction, repair, improve-il ment, a teration or re oCiltion of all or any portion of aaid primary state highway uo II detorminea by the Director of Highways of the Stute of Waohington, it shall become necesoary in the opinion of said Director of Hi~lways, to remove or relocate any or all of suld electrio p0wer tranomiB/Jion circuits and appurtonant fixtures from said highway, the holdor agrees to remove or relocate svid eleceric power transmission circuits and appurtenance fixtures immadiE\tely, and at its own expense within the limite of appropriations availabb therefor, to the place or places on said atate highwa designated by said Director cf Highways.
