The work of constructing, removing and relocating all or any part of said electric
power transmission circuits and fixtures appurtenant thereto shall be performed by the .
holder in compliance wi. th paragraph I, and without unnecessary interference With traffic;:
upon or along sia county road or roads, None of such work shall be undertaken or carried
on without ten days' written noti ce having been first given to sald Board of County
Commis sio neI:'s.

Any and all damage or injury done or caused to be done to snid cot! nt,y l'ond or roads;'
or to any porti on thereof, in the cons truction, operation or maintenance of said electrio
power transmisoion circuits shall be immediately repaired and reconstructed by the holdei'
within the limits of appropriations available therefor and under the supervision unci t.o !
the satisfaction of said Board of County Commissioners. Except where ih the opinion
of the Board of County Commissioners an emergency exists, notice in writing of such
repairs or reconstruction required of the holder hereunder shall be given to the holder.
Upon the failure und neglect. or refusal of the holder to do and perform immediately after:
receipt of such noti ce any repairs or rl,construction of said county road or roads herein
required of the holder, or in un emergency without prior notice, the 30ard of County
Commissioners may undertake and perform such repairs or reconstruction and the reasonable
cos t thereof including a reasonable sum for overhead 'will be paid by the holder wi thin
the limits of appropriations available therefor apon presentation of properly executed
vouchers therefor; provi ded, however, that the County shall submit an estimate of the
cost of su ch repairs or reconstruction to the Bonneville Power Administrator, and shall
obtain said Administrator's approval of the cost thereof before making any sucq repairs
or reconstruction; except that if in an emergency, t.l-}e existence of 'tklich shall be
determined by the County, it becomes necessary for the County to make such repairs or ,
reconstruction without giving Slch notice and obtaining the approval of the cost thereofi
by said Administrator, the United States shall not be required to make any payment
therefor unless the sum expended, or any lesser reasonable sum, shall be approved by said
Administrator. Whenever the Board of Coun~ Commissioners shall perform or cause to be
performed any of the work contemplated in this paragraph the wages of every laborer and
mechanic employed in the performance of said \'oUrk shall be computed on a basic day rate
of eigpt hours per day and v~rk in excess of eight hours per duy shall be permitted only:
upon the condition that every such laborer and meciH.mic shall be compensated for all hours
worked in 'excess of eight hours per day at not less than one and one-half times the .
basic rate of pay. For each violation of the requirements of this provision, a penalty
of five dollars ($5.00) shall be imposedupon the county for each laborer or mechanic for
every calendar day in which such employees shall be required or permitted to labor more
than eight hours upon said \'oUrk ,~thout receiving compensation computed in accordance with
this provision and all penalties thus imposed shall be withheld for the use and benefit
of the holderj provided, further, that no person undergoL1c'; or serving", ,sentence of
imprisonment at hard labor shall be required or permitted to perform any of such work.

The holder shall, within twenty days from receipt of a copy of this order, file with
the Board of County Commissioners at Port Townsend, Washington, its written acceptance
of the terms and conditions of this franchise.
