ORDINANOE RELATING 'It) SALES OF REAL ESTATE AND LEVYING
AN EXCISE TAX THEREON
BE IT ORDAINED By the Board of County Commissioners of JefferSl,n CO\!flty,
State of Washington. that Ordinance Number XXI is hereby adopted as follows;
SECTION I
R
"Sale" shall have its ordinary meaning and shall in addition include
any conveyance. grant. assignment, quit-claim, or transfer of owne rsMp of
or title to real property. including standing timber, or emy estat.e or interest
therein, for a valuable cxmsideration and any cxmtract for such grant, asa1 gnment
quit-claim or transt'er, and any lease with an option to purchase real property,
including standing timber. or any estate or interest therein or other contract
under which possession of the property is given to the purchaser or any other
person by his direction while title is retained by the seller 80S security and the
payinent of the purchase price, but shall not include transfers by gift, devise;
or inherJ. tance, nor a sale by or.to the United States, the State of Wa:3hington~
or any political subdivision tp~!eof, or a municipal corporation of t.his State,
nor a transfer by appropria tioll 'or decree in c ondemna don proc,eeding s brought by
the United States, the State or any political subdivision thereof, or a municipal
corporation, nor a mortgage or other transfer of the interest in real property
merely to secure a debt, nor the assignment thereof, nor any transfer or convey-
ance made pursuant to an order of s ale by the Court in any mortgage or lien fore-
closure proceeding or upon execution of judgment or a deed in lieu of foreclosure
to satisfy a mortgage or a oonveyance to the Federal Housing Administration or
Veterans' Administration by an authorized mortgagee made pursuant to a contract I
of insurance or guaranty wi. th the Federal Housing Administration, )!lor a transfer
or assignment of a vendor's interest in a contract for the sale of real property I,
even though accompanied by a conveyance of the vendor's interest in the real ~ II
property bvolved ****~c, nor a transfer in compliance with the terms of any J.casc~ I
or contract upon \'hi ch a tax as imposed by thi s ordinance ha s been paiel or where II
such lease or oontract was entered into prior to May 1, 1951, nor the sale of aI:Y II

"Seller-II shall include any individual, assignee, racei vedJ trustee in bank- Ii
ruptcy, trust, estate, firm, co-partnership, joint venture, club, com,pany, joint II
stock company, business trust, oorporatJ.on, municipal or quasi-municipal corpor- fj'
ation association, society, or any group of individuals acting as a unit, whethe) I
mutual, co-operative, fraternal, non-profit or otherwise, but shall not include II
the Unlted States or the Sti;i.te of 'lv'ashington, or any political subdivision of the
State of \'/ashington, and municipal oorporations of this State.

'I
"Selling price" shall mean the consideration, in money or anything of value,
paid or delivered or contracted to be paid or delivered in return for the transfE
of the real property or estute or interest therein and shall include the amount c
any lien, ,mortgage, oontract, indebtedness, or other incumbrance gt ven to secure
payment of 'the purd1asa price or any part thereof, or remaining unpaid on such
property at the time of such sal e, including the amount of any lien or encumbrc:mc
existing against the property and agreed to be pai d by the purchaser, but shall
not include the amount of any outstanding lien or encumbrance in favor of the
United States, the State, or a municipal corporation for taxes, special benef1.ts,
or improvEm$:1ts.

PROVIDED, From and after June 9 1955, as used in this ordinance, tbe tena
