County Commissioners. ARTICLE VII. SHORT SUBDIVISIONS I Short subdivisions will comply with regulations as established by the by the Board. But in all cases land in :f short subdivisionB may not be further divided in any manner within a period of five (5) years without the filing;. of a final plat; provided further, that such regulations are not required to contain a penalty clause as provided iI. R. C. W. 36.32.120 al1d may provide for wholly injunctive relief. . ARTICLE IX. MODIFICATIONS, APPEALS AND FEES I Section 9.01 Modifications - Where the Board of County Commissioners finds that extrqordinary hardship may result form a strict compliance with these regulations, it may vary the regulations so that substantial justice may be done and the public interest secured; privided that such variation will not have the effect of nullifying the intent and purpose of the Comprehensive Plan or these subdivision regulations. Section 9.02 Appeal - Any decision approving or disapproving any plat shall be reviewable for unlawful, arbit- rary, capriciouB or corrupt action or nonaction by writ of review before the superior court of the county in which such matter is pending, The action may be brought by any prperty owner in the city, town or county having jurisdiction, who deems himself aggrieved thereby: PROVIDED, That application for a writ of review Bhall be made to the court v.nihtim~tlni.r.tya(l3O::)eclaJ)[a,lfzwrrl(lmY'i chromftmhr,d)to be reviewed. The cost of transcrip- tion of all records ordered certified by the court for such review shall be borne by the appellant. Section 9. '03 ,Fe~ In order to defray the costs of administration, notifications, leg~l pubUcatioll and plan checking, the .following fees shall be imposed and paind to Jefferson County at the time of submission of final plats for approval. a. Platting fee: $2.00 per lot. Minimum fee: $50.00 b. Engineer's fee: As stipulated by County Engineer, including cost of independent computer check of plat, by the Engineer. c. Olympic Health District fee: &:25.00 plus $1. 00 per lot. i ARTICLE X. ACKNOWLEDGMENTS Section 10.01 Acknowledgments and Certificates - The following forms shall be used for acknowledgments and certificates required under this ol'dinance: I a. Des,cription This plat of "John Doe's Addition to the City of Port Townsend, Jefferson County, Washington" covers and includes all of the Southwest Quarter of the Southwest Quarter (SW 1/4 of the SW J/4) of Section Fourteen (14), Township Thirty (30) North. Range One (1) West of the Willa,neUe Meridian. All courseEl and dimensions are as shown on the face of this plat. All monuments are of concrete filled pipe except as othe rwise de s ignated. b. Dedication The completed plat must contain a dedication which shall read as follows, when germane: "Know all men by these presents that the undersigned, owner, in fee simple of the land hereby platted and mortagages thereof hereby declare this plat and dedicate to the use of the public forever all streets, avenues, places and sewer easements or , whatever public propet y ther is shown on the plat and the use thereof for any and all public purposed not inconsistent with the use thereof for public highway purposes. Also, the right to make all .ne.ceaaary sl!lpes for cuts and fills upon lots, blocks, tracts, etc., shown on this plat in the reasonalbe original grading of all the streets, avenues, places, etc., shown hereon. Also, the right to drain all streets over and across any lot or lots where water might take a natural course after the street or streets are graded.
