The Employer and the Union agree that all employees under the authority of the Employer shall become members en:! relTBin. members in good standing of the Union dS a condition of their employment within thirty-one (31) days of the signing of this agreement, or after the employee's probationary period of six months, ': whichever date is applicable. 2. Certain employees and/or pOSitions may be excluded from the provisions of Article VIII, section 1 . Such employees and/or positicm shall be agreed to by the Employer and the Union. ARTICLE VII - HEALTH AND WELFARE: As of January 1, 1972 the Employer shall pay into the Washington Teamsters Welfare Trust premiums that shall be $35.2.0 a month for every employee covered by this agreement who worked eighty (80) hours or more in the month of December, 1971 and thereafter shall pay $35.26 a month for each employee who works eighty hours or more during the preceding month, for the term of this contract. It is agreed that 'this clause may be opened at any time, providing the carrier raises the premium. ARTICLE VIII - DRUG AND PHARMACEUTICAL SERVICES: Effective January I, 1971, for hours worked the previous month, and each month thereafter, during the life of this Agreement, each Employer who is a party to this Agreement shall pay into the Employee Benefits Trust Fund, the provisions of which the undersigned parties agree to accept, the amount of $4.90 per month for each employee covered by this Agreement who wae compensated fol' eighty(80) hours or more during the previous month for the purpose of providing employees and their families drug and pharmaceutical supplies. The Union agrees, that during the life of this Agreement, they will not request any additional benefits and the Employer agrees, that during the life of this Agreement, he will pay any increase in contribution rate if required by the Trustees to maintain these benefits. The above payments shall be made to the Administrative Office at Seattle, Washington, by the tenth (10th) day of each month and in the event the Trustees of the Trust Fund are required to take legal action to collect any Employer'S contribution due under this contract, the Employer shall be liable for all necessary costs and expenses of the litigation, including reasonable attorney fees. Failure to make all payments herein provided for within the time specWed shall be a breach of the Agreement. ARTICLE IX - RETIREES* WELFARE TRUS.1; During the life of this Agreement, the Employer agrees to pay into the Retirees' Welfare Trust the sum of Three Dollars and Fifty Cents ($3.50) per month for each employee who roceived compensation for eighty (80) hours or more during the preceding month. The above payments shall be made to the Administrative Office on or before the tenth (10th) day of each month. In the event the Employer is delinquent in the payment of his contributions to the Retirees I Welfare Trust, the omployo8a, the Union, or the Trustoes 8h6ll have the right (notwithstanding any other provisions of this Agreement) t.o tGke any legal action they deom necessary against the Employer to collect such delinquent amourlts. In the event legal action is required to collect the Employer'S contributions due the Retireen' Welfare Trust, then the Employer shall be liable for all costs and expenses of liti'gation including reasonable attorney feos. The Employer and the Union hereby agrlle to the provisions of the Retirees' Welfare Trust arid shall vest in the Trustees the sole diucnJtion to detormino eligibility, benefits, and termination of benafits .
