".iii,~_i..MIJ-~"Al'.4 .1:"!'TL_~_j~.if~_--:~ -- - i' Ii Section 4.15 " I i Section 4 . 16 Written Conveyance All conveyance of property use rights or other intangible assets of camping club developments within Jefferson County shall be in writing and shall specify to the, purchaser thereof, the precise exclusive and non-exclusive rights conveyed thereby. Limitations on Sale and Use of Camp Sites I n the case of a planned unit development, the Board may, at its sole discretion, upon considering a specific plan permit up to 300% membership of the total number of sites, prior to the sale of the first membership. Subletting of sites shall be permitted, but multiple occupancy of any camp- site is prohibited. . Section 5.01 Variances ARTICLE V. VARIANCES, REMEDIES AND ENFORCEMENT When necessary, the Board may authorize conditional variances to the requirements of this ordinance. Application for a variance shall be made by petition of the promoter stating fully the grounds for the application. It shall immediately be forwarded to the Clerk of the Board for consideration. Before a variance may be granted, the Board shall first determine that: 1. There are special conditions affecting the property that are not common to all property in the area; 2. The variance is necessary for the preservation and enjoyment of a substantial property right of the petitioner and extra-ordinary hardship would result from strict compliance with these regulations because of the special circumstances or conditions affecting the property; 3. The variance complies with the spirit and intent of these regulations and will not be detrimental to the public health, safety, or welfare or injurious to other property in the vicinity. Section 6.01 Recordinq Prohibited ARTICLE VI. PROHIBITIONS, OFFENSES, PENALTIES Section 6.02 i Section 6.03 ! Section 6.04 The County Auditor shall refuse to accept any development plan for filing until approval of the development has been given by the Board of County Commissioners. Should a development of dedication be filed without such approval, the Prosecuting Attorney for Jefferson County shall apply for a writ of mandate in the na me of and on behalf of the Board of County Commissioners, directing the Auditor and Assessor to remove from their files or records the un- approved development or dedication of record. Unlawful Representations It shall be unlawful for any person, firm or corporation owning a develop- ment or camping club within the county to represent that any improvement upon any of the streets, alleys, or other public ways of said development or camping club has been constructed according to the plans and specifications approved by the Director or has been supervised or inspected by the Director when such improvement has not been so constructed, supervised or inspected. Development Permits - Prohibited No building permit, septic tank permit, or other development permit, shall be issued for any site of land divided in violation of this act or local regulations adopted pursuant thereto unless the authority authorized to issue such permit finds that the public interest wUl not be adversely affected thereby. All other members shall comply with provisions of this act and such mem- bers may recover his damages from any person, firm I corporation or agent in- cluding any amount reasonably spent to conform to the requirements of this act as well as cost of investigation, suit and reasonable attorneys' fees occasioned thereby. Such members may as an alternative to conforming his membership, rescind and recover costs of investigation, suit and reasonable attorneys' fees occasioned thereby, Penalties Any person who violates lmy oourt order or injunction pursuant to this ordinanoe shall be subject to a fine of not more than Five Thousand Dollars ($5,000.00) or imprisonment for not more than ninl.'lty (90) days or both.
