Brown , Member Motion by Commissioner O'Meara, second by Commissioner Brown to approve and sign Resolution No. 6l-73, Intent to Establish County Road, as follows. Unanimous. RESOLUTION NO. 61-73 INTENT TO ESTABLISH COUNTY ROAD WHEREAS, after due consideration, it appears to this Board of County Commissioners that it is in the public interest to maintain as a part of the County Road System: A right of way 60 feet wide through Sections 9, 10, & l5, T. 28N., R. 2 W. W. M. , as shown on the attached Exhibits A, B & C. and in contemplation of the language of Statute R.C.W. 36.81.0l0, now therefore, BE IT RESOLVED, this board of County Commissioners does now declare its intention to establish said road, and be it FURTHER RESOLVED, and the County Road Engineer is hereby directed to examine said road and report his opinion as to whether this road is practicable, as to the necessity of the road, as to the proper terminal points, general course and length thereof; and all other facts, matters and things which will be of importance to the Board; and that such report be filed as soon as possible. Appli- cation will be referred to Assessor's Office for property appraisel before action is taken by the Board. Letter of request from the Senate Committee on Ways and Means relating to the Open Space Advisory Committee. Names of members and chairman will be forwarded, along with other requested information, by the Assessor's Office. Hearing for Protection Island, Division 5, con 't. Planning Director, Dave Cunningham, presented latter of recommendation for approval with outl1ned restrictions, which should be placed on several lots within division 5. Charles Little, Developor, stated they have made every effort to comply with all rules of all agencies to preserve the auklets, including an attempted lease agreement with the Committee for Natural Preserves and an impact statement submitted to all concerned agencies. They would now l1ke to complete this development. Mr. Carroll Rieck, State Game Department, stated he has encouraged the Department of Natural Re- sources to accept lease with Mr. Little for protection of the birds. Their recommendation is the Division 5 should not be developed but kept as a bird sanctuary, and that a 12' cyolone fence be put up to separate the division from the others. Me Mike Ruef, Department of Ecology, stated they fully concur with and support the Game Department's pOSition for the preservation of the birds and request that Division 5 be preserved as a bird sanctuary. Mr. Gary Lkine, Sports Fisheries and Wildlife, stated they are in no pOSition to purchase propertjr for the preservation of non-game birds, however, the perferred solution is to place the entire division into a sanc- tuary statis to provide a buffer for the nesting area. Helen Engle, Tahoma Audubon Sooiety, said they urge no human use or deve10pmont of Division 5, and advise management by the Department of Game as a sanotuary for the birds. Dave Frazer, Student, U of W College of Forest Resources expressed more concern over the Puffins llnd said he is not only worried about human destruotion, but also many birds are killed by dogs and cats. Lord Lynn Leschner, graduate student, U of W College of Forest Resources and Bob Clawson, Olympic Audubon Sooiety spoke in behalf of Division 5 being reserved as a sanctuary. John SHpp, Tacoma, advised that auklets have a praotical value to the fi shers. Stated this is the bird 395 ,
