Planning Director Cunningham reported on the foU(I)wing:i (1) Zoning designations, Inner Harbor, Port Ludlow. Sevel'alletters wers received from boaters an~ yacht clubs requesting the entire harbor be classified as "natural". Cunningham said a meeting was held with' representatives from Pope and Talbot, and members of the Shoreline Advisory Committee inspected the area and re-examined the designations of the shoreline. They concluded that their previous designations were correct and re-affirmed that their recommendations to the Board will be that the Shoreline Master Program show the area as some conservancy, some urban and some suburban. (2) Letter from Dennis Seinfeld, Attorney re: Herring Operations in Ludlow Bay. Mr. Seinfeld stated that seven boats are being moored at Port Ludlow and have anchored seven floating herring pens in the vicinity, causing damage to Mr. Swanson and interferring with his fishing operations. Cunningham said he has investigated the situation, a,nd submitted a letter advising that the Planning Departments administrative decision is that operations are of a cost or market val ue of $1,000 or more, and are materially interferring with normal public use of the water. Therefore, the herring operations require a Shoreline Management Permit from the county. Board concurs that the operations are illegal and Shollld be forced to cease and desist. Prosecuting Attorney Daly said he would sign a letter stating all related operations should cease until. an appropriate S. M. Permit is issued. Copies of the letter will be sent to the companies in violation of the act and Pope & Talbot Development Inc. (3) Cunningham submitted a copy of a letter from him to John D. Swift regarding the sale of eleven parcels of land near the Plat of Lazy C Ranch. ' Sale of property is in violation of the W:ishington State Sub- division Law, RCW 58.17. Acreage being sold is in an unapproved plat in a flood prone area. Prosecuting Attorney Daly said that since Mr. Swift has ignored all previous correspondence, the county should file suit against him. The Board requests Mr. Daly to commence with the necessary procedures (4) Public Notice, from the Corps of Engineers re: 071-0YB-I-002195. Arthur E. Freeman, Dis- covery Ba y - construction of pier, drive piling and install float for private boat moorage. Cunningham re- commends ta t the proposed project is exempt from the S. M. Permit System. Motion by Commissioner Brown, second by Commissioner O'Meara to approve exemption. Unanimous. Notice will be forwarded to the Corps. I I . Engineer Becker submitted the following for the Board's determination: (1) Proposed agreement from the State Highway Commission re: State Project, CS 0502, BogCichiel River Erosion Control, Haul Road. Motion by Commissioner Brown, second by Commissioner O'Meara to approve and sign agreement. Unanimous. (2) Resolutions for CRP No. 380, to improve Paradise Street, Paradise Estates, County Road No. 306; and CRP No. 381, to improve various county roads by striping.
