Having examined correspondence concerning King County Cause entitled Grim -vs- Jefferson County
and Jefferson County Cause No. 8441 entitled Jefferson County -vs- Mazda, et ai, and deeming that the
objectives therein sought should be accomplished, therefore,
BE IT RESOLVED, and the Prosecuting Attorney be and he is hereby authorized to move the Superior
I
Court for Jefferson County for its order of dismissal in Cause No. 8441 aforesaid.
ADOPTED this 7th day of October, 1974.

Board approved and signed Building Permit Variance for Mr. and Mrs. Howard L. Flowers granting a variance
from Ordinance No. 1-69, as amended, allowing their personal use of the well on Lot 10,Block 3,Carroll's
Hood Canal View Estates for domestic water to a single family dW'31ling located on Lot 11, Block 3, Carroll's
Hood Canal View Estates under certain ferms and conditions outlined in the permi.t. Chairman KeUy also
signed building permit application for the setting of a mobil home on above mentioned Lot. 11.
BUIIDING PERMIT VARIANCE
I
WHEREAS, Mr. and Mrs. Howard L. Flowers are owners of Lot 11, Block 3, Carroll's Hood Canal
View Estates, and
WHEREAS, Mr. and Mrs. Flowers have applied for a variance from Jefferson COlmty Ordinance No. 1-69,
as amended, allowing the use of a well located l)n Lot 10 of Block 3, Carroll's Hood Canal VIew Estates for
a domestic water supply on Lot 11, and
WHEREAS, the County is concerned about the potential health problems which can develop from the
granting of the variance requested.

NOW THEREFORE, the County does heraby grant to Howard L. Flowers and Noreen Flowers, his wife,
a variance from Jefferson County Ordinance No. 1-69, as amonded, allowing their personal use of the wall on
Lot 10,Bloc:k 3, Carroll's Hood Canal View Estates for domestic .....lite.l' to a single family dwslling located on
Lot 11, Block 3, Carroll's Hood Canal View Estates under the following terms and conditions:

(1) This variance is a personal variance given only to Howlird 1,. FlowerB and Noreen Flmvers, his
wife, and does not run with the land. Any Bale or transfer by Howard 1.. Flo'WElrs and/or Noreen Flowers
shall act to immediately terminate this variance.
(2) Howsrd L. Flowers and Noreen Flclwers shall execute and file with the Jeffer~cn Count~. Auditol'

restriotive covenants in a form satisfactory to the Jeffersorl County Commiasi(lnl'.lrs, specifioally setting out
the restriction on the use of domestic water from Lot 10, Blook 3, Carroll's Hoed Can~l View Esbltes. 'rhis
restrictive oovenant sholl speoifioally indicate that sale of the pro:Jerty by tho present owners, Howard L.
Flowers and Noreen Flowers, hia wife, shall terminate this variance and that use of domostio water {rom Lot 10
shaH immediately oease.
