Brown, Member Motion by Commissioner O~ Meara, second by Commissioner Brown to adopt and sign Res. No. 65-74, Establishing a "Controlled Substances Enforcement Fund", as follows. Unanimous. I RESOLUTION NO. 65-74 WHEREAS, in Jefferson County Superi?r C ourt'Cause No. C-724, the Court entered an individual Order Deferring Sentence and Granting Probation for each of the four defendants requiring each to pal' the amount of One Hundred Fifty ($150.00) Dollars into a "Controlled Substances . Enforcement Fund" , and WHEREAS. the paymenls have been made to the County Clerk in accordance with the said orders, and WHEREAS, no "Controlled Substance Enforcement Fund" presently exists in Jefferson Coun ty., and WHEREA..C;, it is contemplated that in future dnlg related criminal cases the Court may require payments into the said "Controlled Substances Enforcement Fund", and WHEREAS, it is advantageous to the citizens 01 this County to 'have funds available for the i investigation and prosecution of controlled substances; NOW, THEREFORE ,IT IS HEREBY RESOLVED that a special fund to be known as the "Controlled Substances Enf'orcement Fund" be, and hereby is established. The Clerk of the Court is hereby authorized and directed to disburse those funds, paid to the Clerk pursuant to the orders of the Court in Cause No. C-724, to the "Controlled Substances Enforcement Fund". IT IS FURTHER RES OLVED that disbursements from the said "Controlled Substances Enforcement . Fund" shall be made only upon the written request of the Prosecuting Attorney. The said funds shall be used only for the investigation and lor prosecution of controlled substances violatior.,l. The Prosecuting Atton'ley shall keep an accurate record of all such expenditures or payments. APPROVED AND ADOPTED this 13th. day of November, 1974.
