OF COMMUNITY DEVELOPMENT Parcel Number: 701355001 S-T-R: 35-27N-01 W Site Address: 655 SILENT LAKE RD QUILCENE WA, 98376 FINDINGS: In accordance with the authority provided under subsection 4.101 and the requirements contained in Subsection 5.402 of the Jefferson County Interim Critical Areas Ordinance, the following are findings of fact relating to the referenced application: 1.) The application was reviewed by Jefferson County Permit Center staff on 1-24-2000 for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: seismic, fish &wildlife habitat, shoreline (Silent Lake), adjacent commercial forest land, landslide hazard (1). 2.) The potential for an earthquake of a high magnitude occurring in western Washington in the near future is considered a high probability by regional experts. 3.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 4.) Designated commercial forest lands are located on the northern and eastern adjacent properties. According to the Jefferson County Interim Forest Lands Ordinance (Ordinance No. 01-0121-97), buffer and development restrictions are required on property located adjacent to designated forest lands. Please refer to the attached letter regarding buffers and development restrictions for this property. 5.) Designated long term forest lands are located on the northern and eastern adjacent properties, on which a variety of forest related activities may occur that are not compatible with residential development. These activities include spraying, pruning, harvesting, blasting, drilling, rock curshing, and vehicle movements, which can generate dust, smoke, noise and odor. Forest or mining activities performed in accordance with county, state, and federal laws are not subject to legal action as public nuisances. This waiver from the provisions of the Jefferson County Interim Critical Areas Ordinance is granted subject to the following conditions. Any deviation from these conditions shall result in this waiver being revoked and the application becoming subject to further review. CONDITIONS OF APPROVAL: 1.) A setback (buffer) of 35 feet, measured perpendicularly from the ordinary high water mark along the shoreine of Silent Lake shall be permanently maintained as a fish and wildlife habitat area. 2.) Fish and wildlife habitat area buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Area Administrator. No alteration shall be made to the fish and wildlife habitat area buffer without prior authorization by the Critical Area Administrator. All construction activities, including the storage and preparation of materials, shall not encroach upon the designated fish and wildlife habitat area, its associated buffer, or any critically important plants and trees identified on the subject property. .) Damage to vegetation to be retained on site shall be minimized by directional felling of trees away from these areas. 5.) Required forest land submittals were received and approved on May 11, 1998. (Vol. 608 Page 421-422 of Official Records) (CAR98-0015) 6.) The proposed development shall be located on the subject property exactly as identified on the Universal Plot Plan, or other Site Plan, approved by the County as part of the triggering permit application. Applicant shall be responsible for contacting and notifying contractor(s) of the above conditions in order to ensure compliance at various stages of construction/development. 7.) Surface drainage shall not be directed across the face of a landslide hazard or ravine. 8.) On Lot 1, the minimum building setback shall be 100 feet from the shoreline or the upland boundary of its contiguous wetland. There shall be no grading or development between Silent Lake and the building setback line, except for construction of a lake access path. 9.) On this lot, outside of the area cleared for a homesite, a minimum of fifty percent of the trees representative of the size and species composition of the stand, including all snags and all trees 21" shall be retained, except that all retained trees may be limbed up to provide views. 10.) Lands adjacent to this plat are owned by the State of Washington and managed by the Washington Department of Natural Resources for timber production. Purchasers are hereby notified that timber management activities may occur on these lands, including timber thinning, falling, yarding, and hauling; road construction; and replanting, fertilizing, and aerial application of chemicals. 11.) An area 15 feet wide on the south property line of Lot 1 shall be maintained in natural vegetation and existing trees to serve as a wildlife corridor between Silent Lake and adjacent state forest land. 12.) On Lot 1, in the area extending 35 feet back from the Silent Lake shoreline and the upland boundary of its contiguous wetlands, native vegetation shall be maintained. 13.)
