At that time we informed you that preliminary approval for the above subdivision was determined to be an active project with preliminary plat approval. The preliminary approval will extend until July 31, 1997. A copy of the findings for this determination is attached for your records. A copy of the preliminary plat approval and the mitigative measures is attached for your use in proceeding with preparation of the final plat and related materials. To assist you and your surveyor, a copy of the instructions for final plat preparation is also attached. Staffwould recommend a target date of at least two months prior to the expiration date for submittal of a draf~ final plat with the related materials. PADRIC BURKE As you are aware, staff notified Mr. Burke on August 21, 1995 that the preliminary plat approval issued July 31, 1992 expired on July 31, 1995. Mr. Burke met with you and I to discuss whether or not the preliminary approval could be re-instated. Based on the record, a decision was made that the preliminary approval could not be re-instated. The legislature amended the time line for preliminary plat approVals from 3 years to 5 years during the 1995 session. Staff has conducted further research regarding this amendment to RCW 58.17.140. Our findings are summarized below: Subsequent to passage by the legislature, the amendment was approved by the governor on April 17, 1995. The bill that went to and was approved by the govemo~set an effective date of midnight, July 22, 1995. Since Mr. Burke's preliminary plat had not expired at the effective date of the amendment, it seems reasonable to conclude that the approval for the preliminary plat of Quilcene Heights was extended to five years by action of the legislature. Consequently, it is the recommendation of staffthat the Quilcene Heights Large Lot Subdivision plat is still an active subdivision plat with preliminary approval. And given the timing of the amendment, the preliminary plat approval would be effective until July 31, 1997. SUBDIVISION ADMINISTRATOR CONCURRENCE. A subdivision upon which preliminary approval has expired, should the property owner desire to pursue development as a subdivision, shall be resubmitted and processed as new application. New applications are processed under subdivision regulations in effect at the time of application. Box 4054 Seattle, WA 98104 Re: SECOND NOTICE - LLA91-0008, Quilcene Heights Large Lot Subdivision Dear Mr. Burke: Preliminary approval on the above large lot subdivision will expire on July 31, 1995. The Jefferson County Subdivision Ordinance reads in part: 6.212 Expiration: Approval of a subdivision shall expire unless the final plat is submitted in proper form for final approval within thirty-six (36) months, unless an extension is granted by the Board upon submittal of an affirmative recommendation of the Planning Department at least thirty (30) days prior to the date of expiration. Applicants may submit written extension requests to the Planning Department at least thirty (30) days prior to the date of expiration. The Board may grant extensions not to exceed twelve (12) months, upon a showing that the applicant has in good faith attempted to submit the final long Plat within the initial 36 month period. 6. 213 Renewal Procedure: has expired shall be application. The Jefferson County Subdivision Ordinance (3rd Edition) reads in part: 5.208 Expiration: Summary short subdivision approval shall become invalid when the final short plat is not submitted in proper form for final approval within six (6) months from the date of summary approval. Extensions may be granted...when requested in writing by the applicant at least thirty (30) days prior to the date of expiration. Extensions may be approved for a maximum of six (6) months one (i) time only. 5.209 Renewal Procedure: A short plat upon which preliminary approval has expired shall be resubmitted and processed as a new application. Please update the County on the progress of the subdivision. If you wish to request a six (6) month extension please check the appropriate box and return this form to the Permit Center. On July 31, 1992, Jefferson County granted preliminary plat approval of the project. The Jefferson County Subdivision Ordinance states that preliminary subdivision approvals will expire in three years unless the final plat is submitted in proper form for final approval. The ordinance provides for a one time 12 month extension upon demonstration of a good faith effort to comply with the conditions of preliminary plat approval. Since the preliminary plat approval will expire on July 31, 1995, please advise the Permit Center staff of: (a) whether you intent to file for final plat approval prior to July 31, 1995 , (b) whether you will pursue a request for a 12 month extension on the preliminary approval, or (c) whether you intent to let the preliminary plat approval expire.
