THIS EASEMENT, made and entered into this 8th day of Tuly N~~ /- • ~~
1974 by and between JEFFERSON COUNTY, herein caliad the "Graniee," and the tate "--
of Waebingtoa, acting by and through Che Department of Natural Resourcea, herein
called the "State," WITNESSETH:
The State fnr and in consideratioa of the terroa and conditione apecified here-
in, hereby grants and conveys to the Grantee:
An easement for a right of way for the sole purpoee of construction, opera-
tion, use, and maintenance of n road over and acroas a location as ahown on Plat
No. 3078 filed in the office of the Commissioner of Public Lands at Olympia, Wash-
ington, reductions of which are attached as Exhibita A and B, indicating said right
of way in red, and by thie reference made a part hereof, all in Jefferson County,
Washington. Prov.tded, the Grantee may permit the inatallation of utilities specif-
ically pertaining to electronic transmiaeion linea, telephone lines, or pipelines
but for no other purposea.
This eaeemant granted herein ia aub~ect to the following terms, conditions,
and provisions:
Subject to all matters of public secord.
Coneidecation
The conaideration paid by the Craatee to the State is as follows:
Pone. The benefits accruing to the State from the granting the public right
of way offaet the damage done to the land by the same grant.
Damage and Protection from DamaBe
Grantee, when uaing the tights granted herein, eha11 repair or cause to be re-
paired at !ts aole cost and expense, all damage to improvements on State lande oc-
casioned by it, vhich is in excesa of that which it would cause through normal and
prudent uee of eaid rights.
All legal eubdiviaion survey cornere and witnese objects are to be preserved. If
auch are destroyed or diaturbed, the Gzantee ahall re-establish same in accordance with
U. S. Cauaral Land Office atandarde at hie own expense. Those cornera that must be
necesearily dieCurbed or deatroyed in proceae of conatruction must be adequately refer-
enced prior to revoval of the corner and/or aitneas ob~ect. Grantee ehall recozd these
refereacea in the respective offices of the local County Engineer and the Co~issioner
of Pub11c Lande.
The Grantee ehall preve¢t the establishment of weeda upon, and the spread of
weede from, any portion of the right of way herein granted which ie adjacent to cul-
tivated State lande and ehall further comply vith the county noxious veed control
board rules and regulations established under the Uniform Noxious Need Control Statute
(Chapter 113, Laws of 1969 Es. Ses.). Paqment of weed control coste will be the
Crantee's responalbility.
In the event the coun[y noxious weed control board directs the Grantee to con-
trol veeda or the Crantee electe to kill or control the grovth of weeds and/or brush
by chemical [reatment vithin or in proximity to eaid right of vay, he shall use
only those chemical agente, the containez labele of which have been regiatered vith
the Nashington State Department of Agriculture. Such use muet be in accordance
vith labeled directione and appcoved oE jointly by the Hashington State Department
of Agrlculture and the County Exteneion Agent before co~encement of any conerol
pragram.

Facility Protection
Trees that become an interference or a hazard [o [he rights hercin granted
and located outside of the limits of said ri~ht of way may be removed upon obtain-
ing the written consent oE the State, and pz}rynent of the appraised value therr_of. ~
Restoration ~
It is understood and agreed that in Che event any portion oF the road described
herein is abandoned, the Grantee shall talce khe necess¢ry legfll action to vacate
such portions and shall immediately restore the land within all abandoned portions
to a natural conditiort as msy be directed by tfie State.
On those portions designated for restoration, nll asphalt shall be removed
from the abandoned rioht of way and shall not be deposited on the adjacent StaCe
land; in addiCion, [he land surface shall be scarified to blend with the adjoinin~
landscape.

Department of Agriculture, hereinafter called "Grantor" to
JEFFERSON COUNTY hereinafter called "Grantee."
WITNESSETH:
, the Grantee has applied for a grant of an easement under the
Act of October 13, 19fi4 (78 Stat. 1089, 16 U.S.C. 532-538), for a road
over certain lands or assignable easementa owned by the United States
in the County of Jeffereon, State of Washington, and administered by the
Forest Service, Department of Agricultuxe.
NOW TFIEREFORE, Grantor does hereby grant to Grantee an easement for a
public road and highway along and across a strip of land, hereinafter
deFined us the "right-of-way" over and acrosa the lande in the County
of Jeffereon, State of Washington, as described on Exhibit A attached
hereto.
The word "xight-of-way" when used herein means said strip of land
whether or not there is an exieting road or highway located thereon.
Except where it is defined more specifically, the caord "hi~hway" aha11
mean roads or highways now exis[ing or hereaf[er conetructed on the
right-of-wny or any segcnertt of such roads or highways.
The right-of-way is ahown and speciFically described on the plat attached
hereto and made a part hereof.
This grant is made subject to the following terms, provisions and con-
ditions:
1, Outstanding vulid claims, if any, existing on the date of this
grant.
The easement herein granted is Limited to use of the described
right-of-way for the purpose of construction, operation ttnd
maintenance of a highway and does not include the grant of uny
rights for non-highway purposea or facili[ies: Provlded, That
the right of the Porest Service to use or authurize the use of
any portion of the right-of-way for non-highway purposes ehall
not be exercised when such use would interfere with the free
flow of traffic or impuir the full use and safety of the high-
way; and Provided Further, That nothing herein shall preclude
the Forest Service from locating National Foreat and other
Department of Agriculture information signs on the portions of
the right-oE-vay outside of construction limits.
3. During [he performance of thia ensement the Grantee agrees:
n. In connection with the performance of work under this
easement, including conetruction, maintenance and
operation of the facility the grantee shall not dis-
criminate agninst any employee or applicant for
employment because of race, color, creed, or national
origin.
b, The Grantee and his employees shall not discriminate
by segregation or otherwise against any peraon on the
basis of race, color, creed, or national origin by
curtailing or refusing to furnieh accomodations,
facilities, services, or uae privilegea affered to the
public generally,
c• The Gran[ee ahall include and require compliance with
the above non-discrimination proviaiona in any aub-
contract made with reapect to the operations under thie
easement.
By accepting this eusement, the Grantee hereby agreea to
comply with Title VI of the Civil Righta Act of 1964 and a11
requirementa imposed by or pursuant to the Regulation of the
U. 5. Department of Agriculture (7 CFR, Part 15) iasued
purauartt to that Act, and hereby aesures that in the opera-
tion and perfo rn~ance of thls eaaement to [ake immediately
any measures necessary to effectuate this requirement. If
any teal property or structure thereon is provided or im-
proved with the aid of Federal financial assiatance extended
to the Grantee by the U.S, Depar[ment of Agriculture, thia
asaurance ahall obligate the Grantee, or in the case of any
transfer of euch property, any traneferee, for the per:Cod
during which the real proper[y or etructure is used for a
purpose for which the Federal financinl aseistance ia ex-
tended or for another purpose involving [he provis;on of
similar services or benefi[s. If any personal property is
so provided, this assurance shall obligate the Crantce for
the period during which he retaine ownership or posaeasion
of the property, In all other cases, this assurance shall
obligate the Grant¢e for the period during which the Federal
financial asaistance 1s extended to him by this easement.
This aseurance 1s given in conaideration of the Federal
financial asafatance extended in this ensement to the
Grantee by the U.S, Department of Agricultute. The Grantee
recognizea and agreea tha[ auch Federal financial assistance
vill be extended in relinnce on the representation nnd agree-
menta made in this assurance. The Crantee further agreea

that the United States in addition to uny oCher righte and
remedies provided by thie aseurance, the Civil Rights Act
of 1964, or the Regulations isaued thereunder, ahall have
the right to enforce this agreement by suit for specific
performance or by any other availabLe remedy under the laws
of Che United States or the State in which the breach ox
violation occurs.
The Chief, Forest Service mey tesminate this easement, or any segmene
tFereof, (1) by consent of the Grantee, (2) by condenmation, or (3)
after a five (5) year period of nonuse, by a determination to cancel
after notification and opportunity for heaxing as prescribed by law.
IN WITNESS WtIEREOF, The Grantor, by ite Regionnl Foreater, Foreat
Service, has executed this easement (pursuant to the act above-mentioned,
the Delegation of Authority and Assignment of Functions by the Secretary
of Agriculture dated December 24, 1953, 19 Fed. Reg. 74, the Delegation
of AuthorLty by the Chief, Forest Service, dated September 30, 1963,
28 Fed. Reg, 10828, and the Delegation of Authority by the Deputy Chief
2orest Service, dated April 16, 1965, 30 Fed, Reg. 5647, the provisions

Following up on a conference between Messrs. Harold Nyberg and
Walter A. Kelly, we enclose the original and one copy of a Special
Use Pexmit for 1.8 miles of road V~2812, Townsend Creek Road, between
the junction of Penney Creek Road 112823 and the Forest Boundary in
Section 28, T. 27N., R. 2W., W.M.
We appreciate your r.onsideration and interest in taking over this
section of the Townaend Creek Road. ~
You wi11 note that [he special use permit is written for a 10 year
period. This provides you with an amortization period for invest-
menes in maintenance and reconstruction by the County.
The rights-of-way on file for this section of the Townsend Creek Road
stipulates "--- a strip oF land L00 feet in width and having 50 feet
of width on each side of the following described center line.---"
If the document is satisfactory we would appreciute it if the Com-
missioners would sign both copies in the space provided. The Forest
Supervisor has~already signed. At your convenience please return the
signed carbon copy for our files.

Road 52812, designated Townsend Creek Road from Penney Crcek Road /i2823 to Forest
Boundary in Section 28, T. 27N., R. 2W., W.M. The road right of way crosses Sections
21 and 28, T. 27N., R. 2W., W,M., a distance of 1.8 miles on the Olympic Nationnl
Forest for the purpose of public use, main[enance and reconstruction. The exercise
of any of the privileges granted in this permit constituhes acceptance of all the
conditions of this permit.
Section 1. Compliance with Laws and Re~ulations. The permittee, in exercising the
privileges granted by this permit, shall comply with thc regula[ions of the Depart-
ment oF P,griculture and all Federal, State, county and municipal laws, ordinances or
regulations which are npplicable to the area or operations covered by thia permit.
Section 2. Use non-Exclusive. The privileges granted in this petmit to use this
road are not exclusive. The Forest Service may use this road and authorize to use
it at any and all times. The permittee shall use said road in such manner as will
not unreasonnbly or unnecessarily interfere with the use thereof by other authorized
persons, including Fores[ Service.
Section 3. Rules and ReRUlations Governine Uae. The permittee, its agente, zmployees,
contrac[urs or employees of contractors, shnll comply witli all reasonable rules nnd
regulations prescribed by the ForesC Service for control and safety in the use oE this
road and [o avoid undue damage to the road. Such rules and regulutions will include:
(1) Upon rensonable notice closing the road or restricting its use when, due to weather
conditione, or the making of alterna[ions or repairy, unrestricted use would, in
Forest Service judgment, cause excessive damage, or create hazardous conditions;
(2) Cloaing the road or restricting the use when required by any ~overnmental agency
which by 1ew hns jurisdic[ion to nuthorize such closing or restriction, of which
requirement prompt notice shall be given;
(3) Upon reasonable notice closing the road durin~ periods when, in Forest Service
judgment, there ia ex[raordinary fire danger;
(G) Traffic controls which, Ln Forest Service judgment, are required for safe and
effective use of the road by nuthorized users thereof;
(5) Prohibition upon the louding of logs on trucks while such trucks are standing on
the roadway surface, except to recover loat logs.

ditions pertaining to the use of the road authorized by this permit.

Forest lnnd shali be open at all times to full use and enjoyment by the Govern-
ment for nny nnd a11 purposes deemed necessary or desirable in connection
with the concrol, management, and administrn[ion of Gavernmenf-owned land or
the reaource [hereof and, i.nsofar as compacible therewith, the Government may
extend such rights and privileges to others, provided such use by others shall
be controlled so it will not, in tl~e opinion of the Regional Porester, inter-
ferc unduly with the use of [he road by the permittee.
Section 4. Fire Preven[ion and Suppression. The permittee shall take ull reason-
able precautiona to preven[ and suppreas forest fires. No material shall be
dispooed of by burning in open fires during the closed season es[ablished by law
or regulation without a written permit from the Forest Service.
Sec[ion S. Dama~es. The permit[ee sha11 exercise diligence in protectin~ from
dar.~age [he land and property of tl~e United States covered by nnd used in connection
with this permit, nnd promptly upon demand shall pay the United States for any
dnmuge resulting from negligence, or from violation of the terms of thie permit
or of any law or regulation applicable [o the National Forests, by the permittee,
or 6y his agents, contractors, or employees of the permittee ncting ai[hin the
scope of ttieir ugency, contract or employment.
Section 6. OFficlals Not to Benefit. No member of or Delegate to Congress or
Residenc Comnissiorter shall be admitted to any share or part of this agreemen[ or
to nny benefit that may arise herefrom unless it is made with a corporation for its
general bene£it.

Section 7. Outstanding Riglits. This permit is subject to all outstanding rights.
Section 8. USe bv Other than Permittee. If the successor in interest is qualified
as a petmittee, anJ is willing to assume the applicable conditions oE the perniit
and such new conditions approprinte for the circumstances, the Forest Service may
authorize him by permit to use this road.
Sectron 9. Suspension. Upon Lhe failure of the permittee, its agents, employees
of contractors to comply with any of the requiremencs of this permit, tlie district
ranger may suspend operations in pursuance of this permit.
Section 10. Nondiscrimination in Employment. During thc performance of this per-
mit the Permittee ngrees:
a. In connection with the performance of work under this pern~iY, including
construction, mairttenance and operation of the fucility the pecmittee
shall not discriminnte against any employee or applicant for employment

Section 11. Texminatlort. This permit shall tenninate in 10 years from the date
hereof unless extended in writing by the Forest Service. It may be terminated
upon breach of any conditions herein or at the discretion of the Regional Forester
or the Chief, Forest Service.

After searching our records for any county road right of way through your
property in Tax 19, Sec. 14, Twp. 27N., Rge 2 61.W.h1., I did not locate any
established or dedicated county road right of way. The extension of LI. Columbia
St. is a private access, and we do not have information on private accesses.
If you wish to contact a title company, I am sure they could locate information
on the private accesses.
I did not find any permits for Puget Power to route power to your property,
which is not unusual, as I am sure that they knew the access past the county
portion of W. Columbia St. to be private.
I hope we have provided the information you requested, If you have further
questions, please contact me.

Columbia Street in Quilcene for the purpose of cleaning out a creek. The creek is
filled with debris and will require backhoe work. Material removed will be left
along the sides of the creek. Consequently, Jefferson County would like your per-
mission in the form of the enclosed EASEMENT.
Should you require more information or wish to discuss this matter further, please
feel free to contact me. Your prompt response would be greatly appreciated. The
county would like to perform this work as soon as possible, hopefully next week.
