Rice United Mine Corporation Your reference: Reference is made to the enclosed copy of the regions 6/15/65 memorandum, Mr. Willrich' s memo to the file dated 6/29/65 and your 5610(2810) memo- randum of 6/22/65. Region mentions the need to obtain statements from someone having knowledge that the existing road was in place prior to the initial claim. We will work with Mr. Hopper in getting this done. i Region also mentions the need to record the existing location with But in accordance with 44 LD 513. Your 6/22/65, 5610(2810) memo deals with a slight relocation of the existing road. If the relocation is accomplished the exact location of the existing road will 800n .be lost unless. steps arc taken to adequately monument its location. This is important since we claim prior rights on the road as located. It apprears that the best course of action is os follows: (1) Review FSM 5465, R-6 Supplement No, 30 dated 2/65 concerning the required preparations for both recording existing roads and ob- taining new rights-of-way over mining claims. (2) For purposes of recording the eXisting location with BU1 we sug- gest that you prepare both an 8xll section of a 2" to the mile planametric map nnd a large scnle blow-up sheet foldable to 8xll. showing the claim & location in more detail. (3) For purposes of obtaining a right-of-way for the relocation you . can use a reverse sepia of the plat prepared for (2) above and add the relocated route. Be sure sufficient monumentlltum is provided on the ground to allow accurate re-establishment in the future. We understand that the proposed relocation which you have submitted has been subjected to an analysis against a high fill route farther downstream, and found to be the most reasonable route if the mine tunnel entrance and access is to be undisturbed. The alignment, however. is very undisirable and un- doutably below the criteria required for the Illtimate standard. The most desirable location falls over the mine entrance. In the event that the. claim is found to be invalid and a contest is successful we may be in a posltlon to properly locate the road if we act fast. It would lnvolve filing an application for appropriation under 44 L.e. 513 immediately once the 352909 Snow Creek Road -2- present claim was invalidated. For this reason we suggest that you also survey & design the road in the best location irregardless of existing claim improvements and keep this information in your files. It would be' needed eventually anyway if condemnation is necessary. After you have completed items (l), (2}and (3), suhmit the data back to this office & we will take appropriate action to record the. existing road with BLM. We l.;ri11 also review the stata,s of the claim determination with Region & if it appears that a long delay is involved, proceed with ac- quisition of the right-of-way for the relocation you propose. This work could then be accomplished as an interim measure pending the construction of the ultimate location when and if the claim is invalidated. The material submitted with your 6/22/65, 5600 memo is being returned under separate cover as you will need it in preparing the above data. Reynolds: In response to your letter of February 25, 1976 concerning the county maintenance of these two roads, I referred this to the County Road Supervisor. He indicates that the County grader hao patrolled onto the BOnJon road about 300 feet upon request from the City of Port Townsend in order that they could have eaaier nccess to Lords Lake. Years ngo the County did patrol into the Taylor Ranch (Howe Creek Road) upon request by the people who lived there. It is not this departments desire to create usage roads by maintenance, therefore, non-county roads or driveways are graded only upon request and e.o time permits. ln times past, the County has adopted (by mutual agreement) Forest Service Roads for the County road system when so doing has been an asset to private property directly involved.
