Dear Tom,
Near the beginning of the year on Snow Creek Road and just
recently on McGee Road we had bad washouts in areas of your phone
line installations. We have attributed both to being caused by
improper compaction by your contractor during back - filling.
As the washouts were on a narrow road and into the driving
lane we felt it to be an emergency situation and one of our men
took care of both problems as they occurred. He has a total of
three hours and ten yards of quarry rubble on each job.
You will find enclosed an itemized billing for his time,
truck, and materials.

P E R M I T
Subject to the following terms and conditions, PERMISSION IS HEREBY GRANTED to Applicant
to perform work as described on the reverse of this document.
This permit is conditioned upon Applicant's compliance with the general provisions set out
herein, and any special provisions attached hereto.
GENERAL PROVISIONS: In case of any damage to said streets, avenues, alleys, roads, high-
ways, turn -outs, gutters, ditches, wood or concrete walks, drain pepes, hand or embank-
ment rails, bridges, and any and all other appurtenances by the Grantee, the said Grantee
agrees to repair such damage at the earliest time possible at his own cost and expense.
The Grantee, its sucessors and assigns, agrees to protect Jefferson County and save it
harmless from all claims, actions or damages of every kind and description which may ac-
crue to or be suffered by any person, persons, or property by reason of the performance
of any such work, character of materials used or manner of installation, mainteiiancE
and operation, or by the occupancy of rights of way by the Grantee; in case any suit or
action is brought against the County for damages arising out of or by reason of any of
the above cause, the petitioner, its sucessors or assigns will, upon notice of conmience-
ment of such action, defend the same at its sole cost and expense and satisfy any judge-
ment arising therefrom if determined adverse to the County.
During the progress of the work such barriers shall be erected and maintained as may be
necessary or as may be directed for the protection of the traveling public; the barriers
shall be properly lighted at night.
On completion of said work herein contemplated all rubbish and debris shall be immediately
removed and the roadway and roadside shall be left neat and presentable and satisfactory
to the Department.

Dear Mr. Becker:
Following up on the conference you had with Mr. Swartzlender
and Mr. Nyberg, we enclose the original and one copy of a
Special Use Permit for #2813 Little Quilcene Road from High-
way 101 to Lord's Lake.
We appreciate your consideration and interest in taking over
the Little .Quilcene Road. It ceased to be a typical Forest
Service Road some years ago. Jefferson County is in a better
position to provide service to the traffic on the road than
the Forest Service. In addition Jefferson County can do a
better control job than the Forest Service.
You will note that the special use permit is written for a
10 year period. This provides you with an amortization
period for investments in maintenance and reconstruction by
the county.
The rights- of-way on file for Little Quilcene Road all stip-
ulate a 66 ft. right-of -way.
"The said strip being (33) feet in width on each side
of center line of a road as located and to be con-
structed on the ground, with as much additional width
as required for adequate protection of cuts and
fills." **tt

coanissioners will sign both copies in the space provided.
The Forest Supervisor has already signed. At your convenience

20. Jefferson County to establish said road as a part of its permanent system
of roads under county jurisdiction.
21. Forest Service grants to Jefferson County, State of Washington, permission
to exercise rights and privileges for constructing, maintenance and control
granted to the Forest Service in the right-of -way easements in the name of
the United States Government for the said road.
22. County to maintain said road for all normal traffic and including all heavy
hauling unless by mutual agreement in writing other arrangements are made to
provide for the necessary maintenance required to keep the road in condition
equivalent to its standard when constructed, reconstructed or resurfaced.
23. To the extent permitted by applicable law, not to abandon road and related
rights or any segments thereof, without 180 days prior written notice to
the Forest Supervisor.
24. The permittee will post and maintain signs as required by the District
Ranger notifying the public of road closures, unusual hazards, or other
special conditions pertaining to the use of the road authorized by this
permit.
25. All roads constructed under the authority of this permit across National -
Forest land shall be open at all times to full use and enjoyment by the
Government for any and all purposes deemed necessary or desirable on connec-
tion with the control, management, and administration of Government -owned
land or the resources thereof and, insofar as compatible therewith, the
Government may extend such rights and privileges to others, provided such
use by others shall be. controlled so it will not, in the opinion of the
Regional Forester, interfere unduly with the use of the road by the
permittee.

Please refer to your letter of November 7, 1983 concerning the above case.
The accident in question was on a Jefferson County road and was not within
the boundaries of the Quilcene Ranger District. We have very little inform-
ation as to history of the road. We know that it is basically lucaLed on
a railroad grade constructed in early 1920'x. We have no record of road plans
or specificatiuns. To date, we have not found any conveyance records.
Two Ranger District employees arrived at the scene after the accident so
have very little information concerning the incident. Ranger District
employees were James Halvorson and Richard Dinkleman.'

Dear Sir:
I represent Earl Woodley, Inc. in a truck/bus accident which
occurred on May 4, 1982, in the Quilcene Ranger District.
According to the State Patrol report, the accident occurred on
U.S. Forest Service Road No. 2907. I have learned from Mr. Minty
of your District that Forest Service Road No. 2907 was deeded to
Jefferson County approximately ten years ago; As I understand
it, this road is now known as Jefferson County Road No. 34270.
I would appreciate receiving any information that your office may
have concerning the road on which this accident occured.
Specifically, I would be interested in knowing the history of the
road, including the design specifications and plans. I would
also be interested in any information you could provide me
regarding the transfer of this property to Jefferson County.
I have also learned that there were Forest Service personnel
present at the accident scene. I understand that these people
were working out of the Quilcene Ranger Station. I would
appreciate it very much if you would mention this accident to all
Forest Service personnel at the Quilcene Ranger Station and
provide me with the names of all persons who may have knowledge
of this incident.

We can't say that we greeted the news in your letter of March 3 to us
with loud huzzahs but we can and do say we certainly appreciated your effort
and time which went into the checking and consideration given to our request
for assistance in regard to a right of way to our property.
And we are aware of the difficult position the County Commissioners could
find themselves in at this point in time in regard to such a matter even though
as you state, "The physical evidence in the field may support [our.l claim to
use of the Ridderbusch access road ..."

Dear Mr. Goodhue:
I have reviewed your letter of February 10, 1981 with the Board of County
Commissioners. All the documentation in the county files has been sent to
you in prior correspondence. The physical evidence in the field may support
your claim to use of the Ridderbusch access road; but Jefferson County has
no right to impose access rightsfor you on another person's property. Mr.
Ridderbusch has stated that his road was built as part of the consideration
for right -of -way; timber value taken from his land; and as a replacement
for the lower road being vacated.
I discussed this road with Mr. Becker before he left for the south; but he
was unable to add information beyond what was in the file.
I am sorry that I cannot assist you further in this matter.

Gentlemen:
Late in 1979 my wife and I purchased from George and Lorraine Nichols
approximately 11 acres of land in the Lake Leland area with the eastern end cf
the property abutting the lake. We were advised by i:r. Niichols that he had
earlier agreed with the County Commissioners to give the County the property they
needed for a new upper road and right -of -way in exchange for two things. These
were, one, an access road to his cabin near the lake from the new upper County
road a-.1, two, their agreement to vacate the portion of the lower old County road
which went throurh his property near the lake. The Ccm.,issioners agreed to these
vondit!cns. However, at this point in time we are not positive or how this arree-
mant was actually carried out and we request your action on this matter.
The piece cf property is described on our tax statement as "S 26 T 28 R 2 W
11.35 A Lot 1 (:;1/2) Less R of W." The minutes of the Comm..issicner's meeting of
April 1, 1963 containei the information regarding George Nichols' appearance be-
fore the Corr_iseioners and the agreement cencerninp the lower road being vacated
when the new road was dropped to his and the adjoining Ridderbusch property. (A
copy or a portion of these minutes is enclosed.)
To give you additional background George Nichols gave me the following infor-
maticn by letter, and I quote portions of it:
"When the county fathers first discussed the possibility of abardon-
im, the bridge across the lake and building a new access to the north side
of the lake I attended a commission meeting and told the ccm °.issioners
that we would give the county the property needed for the right -of -way,
If in return they would vacate the lower road and provide us with an access
rand tc the cabin, fror the new road. I also suggested the;• put the drop
road alone the east line and we would give the. Ridderbuschs access to their
property over the same road. In this way the county would only have to
put in one drop road. They agreed to our request and suggestions.
Horace Gleason was chief of the survey crew and Ed Becker was county
engineer at the time. Horace came to us and told us that the topography
of the property along the east line made it almost impossible to put the
drop road in the location suggested. Lorraine told him of an old 'skid
road' that was used for logging that land many, many years ago, when she
was a child. The survey crew did some hunting and did in fact find the
old skid road, which was used as the bed for the present access road. We
discussed these developments with the Ridderbuschs and I feel there would
be no problem verifying all of these facts.."
There is in fact a "drop road" all on the Ridderbusch property which runs
.`rem.. the ncu urger County road down to approximately the area of Ridderbusch's
cabin and at the point this road intersects our north property line (formerly the
Nichols' property) is a gate separating Rir.derbusch's property and ours.

This appears to be the drop road to which George Kiehols is referring and would
provide the agreed upon access to our property if the Commissioners establish the
fact this road was and is the cne put in per their earlier agreement with the then
two adjoining property r,wners and document such as being a legal access to our
property.
Because we have been unable to locate a Legal description of the drop access
road which the Commissioners agreed to provide to (our) the property we will appre-
ciate any action you may find necessary to complete the agreement.

Dear Mr. Sanstrom:
Subject: Access Road - Lake Leland
Thank you for your letter of January 30, 1981 regarding the access road to
Nichols' cabin on Lake Leland.,.
As you undoubtedly realize from my earlier correspondence to the Board of
Commissioners including the information from George and Lorraine Nichols, Mr.
no Ridderbusch's telephone conversation with you does not agree with the data
given to us. I will be most appreciative if you will carry your investigation
further.
The following facts seem to be relevant:
1. The only record of the reason that the County constructed the
drop acces road to the vicinity of Nichols and Ridderbusch's
cabins states that George Nichols appeared before the Commis-
sioners and requested the lower road be vacated "when the new
road is dropped to his and the adjoining Ritterbush property."
The excerpt from the minutes of the Commissioners meeting
which I earlier sent to you included the above words as well
as, "The Commissioners were agreeable." Nowhere is there an
indication or record that Ridderbusch negotiated with the
County for the drop road.
2. On the drop access road which was put in by the County to the
cabin(s) there is a gate in the fence separating the Nichols'
and the Ridderbusch property. If access wasn't intended to be
provided to Nichols' property reason dictates that the gate
wouldn't have been erected.
3. Ritterbusch fan some reason was paid by Jefferson County for
his Quit -Claim of property "in the matter of the North Leland
Road."
I'm certain you are as anxious to equitably resolve this matter as we are.
Possible Ed Becker, who George Nichols advises still resides in Port Townsend

and who was the County Engineer at the time, might be of help. George also
mentioned Horace Gleeson who was the chief of the survey crew at the time.
And as you may know, George and Lorraine Nichols are now living in Port Townsend.
For

Dear Mr. Goodhue:
A review of the file documents that preceded the vacation of the county road
through your property has not uncovered any documents that would (live you
access throuqh the Ridderbusch property. There is a cnmplete file on County
Road Project. 3301 seLting up the location, design, rinhl, of way, and constrpc-
tion of the upper road, inc Iudinn the contract: construction plans.
My Roy Ridderbusch has told me (hy phone) that the access to his property was
never intended for access to the Nichols' property that you now own. He also
told me that there was an existing access to the Nichols' Property that would
require rather minor bulldozer work to remove alder, growth to make it passable.
The County Road Superintendent, Fred Marggraf, and I checked this out. We found
the old road, overgrovni with alder, leading down to the vicinity of the Nichols'
cabin. Their is a Bond access point existino where this old private road joins
the upper county road,
The County cannot be responsible for private access roads

Per our telephone conversation this date, enclosed please
find returned quit claim deeds to those two rights of way for the
proposed county road. The portions of the descriptions in question
are annotated in pencil.
As no plat is cited in the deed as exhibits to be recorded,
the erroneous roadway width as shown on the U.S. Forest Service
section maps of 50' +50' is immaterial and the deed description of
30' +30', when otherwise cofrected, will govern and be quite accept-
able.
Sorry to be an inconvenience, but believe this will preclude
any future questions.

Gentlemen:
Jefferson County has requested an easement from the United States
Forest Service for portions of the Snow Creek road located in
Sections 9, 10 and 15, T. 28N., R. 2W. The area requested is
shown on the attached map.
In regard to this proposed easement our attorneys advise as
follows:
"It is possible there may be a problem in our granting the
county an easement for this road. The Port Townsend and
McCormick deeds appear to contain the Possibility of a
reverter. If this is so, the easement would revert to the
owner of the underlying fee upon granting it to the county.
"We suggest you furnish the county copies of the deeds for
their District Attorney's review. Should they wish a: ease-
ment, we will grant one similar to the form attached ".
Attached are copies of the easements acquired from City of Port
Townsend and Chas. R. McCormick Lumber Company. Also attached
is a copy of the type of grant we would convey if you so desire.

Thank you ror your letter regarding my inquiry about McGee Road. You
are correct when you say you found no record of the road being named
Magee. My inquiry was questioning the proper spelling of the original
homesteaders after whom I am assuming you named the road. Their name
was Magee not McGee. My father, Lester West, lived with the Magee
family for a short time in his youth and later purchased the home and
40 acres from them. I grew up here and have recently moved back
'home' to raise my family. It was nice to see that when you named the
roads you named them after local citizens, (Munn road after my aunt &
uncle). In your letter you state this road was originally the Arcadia
Valley Extension yet in my 30 yr. I have never heard the road referred
to by this name. It's a privlidge to have a road named after you but
a disappointment to have it spelled incorrectly. As there are only the
two families living on McGee Rd. I didn't feel a petition was really
necessary as neither of the two parties object to correcting not re-
naming the road. If it is a formality we must follow please let me
know. If you need further verification on the correct spelling you
could contact Jeanne Thomas in Port Townsend as she is the daughter
of the Magee's after whom I believe you named the road.

Near the beginning of the year on Snow Creek Road and just
recently on McGee Road we had bad washouts in areas of your phone
line installations. We have attributed both to being caused by

As the washouts were on a narrow road and into the driving
lane we felt it to be an emergency situation and one of our men
took care of both problems as they occurred. He has a total of
three hours and ten yards of quarry rubble on each job.

The creek work performed on the Yarr property was to
when the county re- aligned Tarboo Creek along the county road in 1932 (see enclosed
road plat). The erosion of the Yarr property was along the channel change and was
at least partially due to inadequate maintenance of the channel. Accordingly, the
county agreed to assist Mr. Yarr in stabilizing the banks of the channel and prevent
further loss of his meadow lands.
The Washington State Law RCW 36.32.280 & 36.32.290 place direct authority on the
county to exercise the state's "soverign and Police powers- -for the purpose of preventing
which threaten or
Fisheries and Department of Game. These two state laws are in conflict as implemented
or interpreted by your staff. Your department puts fish welfare ahead of human welfare.
Lands already eroded from Yarr's property are to be further damaged by sloping a 5 foot
face on a "2:1 slope or greater, then rock faced ", which results in a further loss
of 10 feet to 15 feet of good land. The county found by placing large toe rock, topped
With keyed rock spawls nearly 2:1 slope facing was possible, original channel capacity
maintained, and further loss of good land avoided.

Last spring we received an application for a hydraulic project (dated
May 19, 1982) from Mr. Yarr, for work as noted above. Grant Fiscus
of our department, and the landowner Mr. Yarr, went over details of
the project together on site, on June 18, 1982. After looking at all
eroding banks and examining the stream, the details of how the job
could be done while minimizing impacts to fish habitat were apparently
agreed upon. These details were subsequently expressed as provisions
one through seven on a Hydraulic Project Approval (HPA, dated 6- 25 -82)
issued to Mr. Yarr. At that time, there was no indication that a
county construction crew would be involved.
During the course of a routine phone conversation with Milt Sandstrom
on September 2, 1982, our Habitat Manager was advised that the county
would be doing the construction work. We immediately sent to your
office a copy of the HPA previously issued to the landowner. It became
apparent that there was a difference of opinion regarding reshaping of
the eroding bank prior to rock placement. While there also appeared to
be resistance from the landowner on this item as well, it should be
noted that our HPA is an approval subject to its attached conditions.
On September 9, 1982, our staff visited the site and reported that it
appeared the bank was not reshaped prior to rock placement, contrary
to provision four (see attachment). In spots, it appears that nearly
one -half of the wetted width has been rock.- covered. While some of the
rearing habitat would have been lost anyway, the idea was to minimize
encroachment into the stream channel. The end result is loss of both
spawning and rearing areas, reduced channel capacity, and possibly

more energy being directed at the bank bordering the county road. Addi-
tionally, our staff noted far more vegetation removal had occurred than
was agreed to with the landowner.
We are especially concerned with this portion of Tarboo Creek, since it
is part of our coho spawning index area (R.M. 2.2 - 3.1) and has been
very heavily seeded in past years. Instantaneous counts, for example in
1980, nearly reached 400 adult coho per mile.
At this time we are undecided on what action to take, and we request a
written response from your office regarding compliance with the HPA provi-
sions.

Dear Commissioners:
highway 104 cut off on highway 101. Late this summer several acres adjacent
'to Fuller Road were logged along about mile of the road. The logged
acreage belongs to a group called the Snow Creek Association. In the course
of the logging, two access 'roads' were made from Fuller Road to the Snow
Creek acreage. Fuller Road sustained damage at these points from the logging
equipment and trees were felled, presumably on county right -of -way, to
accomodate the logging equipment. Now that the winter rains have started,
areas of significant erosion and standing water have appeared on Fuller Road
as a result of run off from the logged acreage. These were no drainage
problems in these areas of the road in the years prior to the logging.

Re: Shoreline Substantial Development Permit Exemption, Earth Work
Dear Mr. Lium:
On July 6, 1987 I inspected property on Southpoint Road described as Tax 5,
Section 9, Township 27 North, Range 1 East, WM. As work was being conducted
within the jurisdiction of the Jefferson -Port Townsend Shoreline Management
Master Program without a shoreline substantial development permit or exemption,
I placed a stop work order on the activity. After discussions with you, I granted
a verbal exemption for certain work to proceed. This letter follows the verbal
exemption.
I have reviewed your request to clear the upland portions of your lot, grade
an access road onto the lot and relocate drainage on the lot. The estimated cost
for this work is under 52,500.00
It is the administrative determination of this office that the project will
have a fair market value of under 52,500.00 and will not materially interfere with
the public's use of the water, therefore, a shoreline permit will not be required.
The following conditions shall apply to this exemption:
1. Any work not described in this letter shall receive separate, review and
approval by appropriate agencies prior to the commencement of the work.
2. No work waterward of the ordinary high water mark is authorized by this
exemption, except as provided in condition 3 below. No fill may be placed
on the beach or intertidal areas of your property. A bulkhead is not
authorized by this letter of exemption.
3. Erosion control measures to contain sediment from the relocated drainage
and grading work shall be placed immediately.
4. Approval from the Jefferson County Public Works Department shall be
obtained for the access work on your property.
Some fill had been placed in the intertidal area prior to my arrival to the
site. This material was removed without the use of heavy equipment on the
beach, and the intertidal area restored to its approximate original contour, prior
to my departure.

I have been requested board of Jefferson County
to 'write to you to clarify some of the details of the
Coyle road vacation, which took place May 11, 1961,
The original requirement to vacate a portion of the Coyle road
originated as condition No 5 of the Jefferson County Building
Department, which stated:
"Pacific Rim Group shall secure an easement or shall provide an
easement across its own property to provide public access to the
properties located west of and adjoining the project site. The
access road shall have a standard sixty (60) foot right of way
width and shall be constructed in a manner which meets all county
standards for grading, drainage, ballasting and placement of top
course. On completion of construction of the access road,
Jefferson County will vacate that portion of the Oak Head -Coyle
road, County road , that crosses the Pacific Rim property and
waive the road vacation pay back requirements. The vacated

During this time, the Planning Department
noted in their Staff
Report that Mr. James Strictiand objected to the road vacation. It is
also noted in other planning department correspondence that the
Strictlands were notified of the Proposed road vacation.
At the Planning Commission meeting of February 4, 1961, a
recommendation was made to grant the request for the vacation,
requiring, in addition, a condition that ''an easement be granted along
the existing Strictland driveway to the vacated road"
At the public hearing on March 23, 1961, the Board of County
Commissioners accepted the .recommendation of the Planning Commission
and added a third recommendation to the two the Planning Commission
recommended:
1. An easement be provided to James Strictland from the upper
driveway to County Road #16.

The road was vacated by Resolution No. 52 -81 on May 11, 1961.
The Strictlands' and others'opposition to the proposed vacation was
noted both in Planning Department correspondence and Board of
Commissioners minutes.
It appears to the Department of Public Works that all legal
requirements for road vacations were adhered to, including posting of
the proposed vacation.
I am enclosing a survey of the area that shows the roads as well
as the vacated section of the Coyle Road. The Public Works has twice
sent our inspector to the area to determine of gates are being used on
the vacated road : both times no gates were in evidence; gate posts
were visible, however.
The road has been legally vacated and is the property of Thousand
Trails, Inc. You have an easement for ingress and egress over the
vacated roadway, as well as access along Thousand Trails Road and
Tskutsko Point Road.
I sincerely hope that the above synopsis has clarified for you
various aspects of the road vacation.

le During a June 28, 1984 site review between Washington Department of Fisheries and
County staff, bank protection /restoration work as originally proposed at four siteswas
significantly modified. Heavy equipment will now be used only at one location on a
high bank not directly involving the stream. All other stream work shall be
performed by hand with hand tools.
2. At the fresh sidecast site off the Dabob -Coyle Road near stream River Mile
(RM) 0,9, (see item 1 of WDF letter, April 10, 1984) the following plan for restoration
was agreed to. Afoot trail route shall be used to gain access to the toe of the
bank, thereby avoiding damage to the upper part of the sidecast area. Using hand
tools, a trench shall be cut into the slump and a log retaining wall secured in
place in alignment with the natural banklinee A fabric /wire mesh on the inside of
the wall would provide a beneficial seal in case of leaching. Accumulated sloughed
material may then be removed using the outside perimeter as a protective berm.
Excavated material shall be placed where it cannot reenter the stream. Rock may
be hand placed to help hold the logs in place. Exposed soils shall be stabilized.
Permanent County staff to supervise.
"3. Other bank locations impacted may be repaired as agreed on -site by confining heavy
equipment work only to high banks, repositioning select woody material or re-
positioning dislodged riprap.

The section of Coyle Road that runs through the area where you observed Pope
and Talbot logging operations; is a "useage" right of way. This means that the county
does not have right of way beyond the back of the ditch line. To have left only a few
trees standing next to the road would have created a "danger tree" situation, where
those trees could easily have blown down across the road during a windstorm.

Re: Hydraulic and erosion problems letter of April 10, 1984.
Dear Mr. Phinney:
Jefferson County has taken the following remedial action on
the problems addressed in your letter:
1. Unnamed tributary to Tarboo Creek, WRIA C- 17.0130, River
Mile 0.9. The 20 *- yards of material sidecast at this location
are ditching spoils that are utilized to widen narrow shoulders
along roads. This practice has been discontinued at any site that
could involve streams or shoreline areas. Jefferson County Public
Works has submitted a plan and hydraulic permit to remove the
material sloughed into the creek.
2. Unnamed tributary to Tarboo Creek, WRIA C- 17.0130, kM U.4.
six foot diameter culvert under the Coyle Road has been in-
and found to be in good condition. This portion of the
Coyle Road is not on the six year transportation plan. Because of
this, it is unlikely that the county will replace the culvert in
the near future. When replacement is required, a bottomless arch
type culvert, along with other types of structures will be c011-
sidered.
In the interim, the county will submit a hydraulics permit and
be working with fisheries to develop a plan to construct weirs
downstream of the culvert to allow fish passage.
J. Spencer Creek, WRIA C- 17.0005, RM U.1. Jefferson County
Public Works is working with the fisheries Department to develop
plans to restore Spencer Creek as requested. The county has sub-
mitted a hydraulic permit to fisheries, and will submit a S. C.
P. A. checklist and the plans that are being developed to
Jefferson County Planning fur review.

I discussed the above referenced matter with the Board regarding
surveying the property along the slide at Thorndyke after it is
staked by the state geologist and they .indicated that they did not
commit the county to conducting this survey and question whether
it is proper for the county to expend the funds to do so. I also
told them it would be unlikely that the county would be able to
do the survey for some time due to other projects being done at
this time and throughout the summer.

A resolution signed by the board of commissions on May 2, 1983
generally defines the boundaries of the unstable slopes just
north of Thorndyke Bay in Section 19, Township 27 North, .Range
1 East, W.M. The resolution further restricts development activity
within this area based on the potential for substantial property
damage.
In an effort to determine the actual boundaries of this hazardous
area, the state geologist has offered to complete a field investigation
and stake the uppermost scarp relating to the slide. The board has
requested that a survey crew subsequently survey the boundaries as
staked.
I am trying to coordinate this effort. I would appreciate an
approximate time schedule from your office as to when a survey
crew would be available. Please let me know what procedures are
necessary to set up the surveying.

After review of the application and Information regarding the vacation of County Road
16, comments and concerns addressed at the public hearing of February 9, 1981, and
correspondence received, the Planning Department recommends the following motion be
considered in the resolution of this matter:

west to the intersection with the Strickland upper driveway (see the map for the approx-

--2.' Gates are not to be placed at the terminus of the vacated road.

During a telephone conversation, Mr. Strickland said, "The County �has ymain-
tained the road for many years. The County road was there when my folks
bought their place down the hill - with access by an easement from the County
road to their property. Access was o.k. If Jefferson County vacates the
road, we will have to drive all the way around - which would be inconvenient.
A gate on both sides of the road is very inconvenient. It's almost impossible
for friends and relatives to visit without getting a million keys. I do not
want this road vacation."

INTENT AND VACATION DESCRIPTION: The Jefferson County Board of Commissioners
intend tend to vacate t e o lowing described County road:
That part of County Road No. 16 traversing Thousand Trails
parcel beginning at point just East of the East line of
the Northwest Quarter of Section 4 and ending on the West
line of the Northwest Quarter of Section 4 all in Township
25 N. Range I W.W.M., said road having a length of 3396
feet more or less (0.64 miles) and having a Right-of-Way
of 60 feet.
At,present the road is partially gravelled and single lane wide. An underground,
utility runs along, part of the right-of-way. The area is undeveloped, however,,
Thousand Trails plans to develop th, area as a camper club.
DEPARTMENT AND AGENCY FINDINGS:
Department: In favor pf the vacation.
Works Department understands that the vacation is Part of the building permit'
conditions for the camper cILb. The replacement road connecting from Zelatched
Point Road has been inspected, approved, and acce pt�
i�d by the Public Wqrks
Department (see enclosed letter).
2. Puget Sound Power and Light Company: No objection. Puget Power does qo7; rave
facilities on that section of County Road No. 16.
3. United Telephone Company: There is a buried telephone cable which would require_
a maintenance easement. The cable is buried on the north $ide of the road
approximately 42 inches deep. The cable runs from•the east boundary of the proposed 4.
vacation to the intersection of the road to Stephen Feldman's property.
4. Jefferson County Sheriff's Department: No objection.
5. Jefferson County Planning Department:
a. The optimum land use map of the Jefferson County Comprehensive Plan designates
the area as rural located within the Coyle planning area
b. The proposed vacation is not a trail corridor according area. the Jefferson County
Park, Recreation, and Open Mlc Plan. n.
c, The public hearing will be held by the Jefferson County Board of Commissioners
on February 9, 1981 at 11:00 a.m, in their chambers at the Courthouse, Port
Townsend. Public notice of the hearing will be in the January 21 and 28,,_1981 ,
editions of the Port Townsend Leader.
d. Thousand Trails, Inc.: No objection to the vacation. Thousand Trails understands
that the road vacation is part of the conditions for their camper club building
permit.
e. Building permit condition #5 for the camper club (November 1978):
"Pacific Rim Group, Inc. shall secure an easement or shall provide
an easement across its own property to provide public access to
the properties located west of and adjoining the project site.
The access road shall have a standard sixty (60) foot right-of-
-way width and shall be constructed in a manner which meets all
county standards for grading, drainage, ballasting and placement
of top course. On q!ppletion of construction of the access road,,
emergency access road. Gates shall be installed by Pacific Rim,
and maintained at the east and west terminus of that said
portion of vacated County road.”
f. James Strickland (adjacent property owner): Objects to the road vacation.

BOARD OF COMMISSIONERS ACTION: A t the public hearing March 23, 1981, the board reviewed
the request, department and agency findings, Planning Commission recommendation, and
public testimony. By formal motion, the board accepted the recommendation of the .
Planning Commission to approve the vacation subject to the two conditions to be amended
as follows, in addition to a third condition that would read as follows:.
1. An easement be provided to James Strickland's from the upper driveway to County
Road No. 16.

This part of the old Coyle Road 16 has been replaced with a new roadway in a
slightly different location so that the old road is no longer needed as part of the
Road System. Plans for C.R.P. 0354 required extra right of kwy from Station 699+00
to 699+50 to accomodate a road approach for the Whitney Road. A more suitable nnproach
was constructed immediately to the north so that the antra right of way was not used.

Gentlemen:
This gravel road had been in use until late 1973 when it was replaced by
relocation and reconstruction of that portion of County Road 16 under CRP 354.
This old road is no longer needed as it has been replaced by new construction
under CRP 354.
This road traverses Washington State Department of Natural Resources land,
therefore, vacation would revert the old road to the D.N.R. Negotiation with
the D.N.R. for the new right of way was done with the understanding that the
new right of way would replace th old right of way and that the unneeded portions
of the old right of way would revert to the D.N.R.
The enclosed map shows that portion of the old right of way not needed at
this time shaded in red. It is recommended that this vacation be done.

It is rather difficult to quote a cost for building a road to your
property until we ham at least a little information on what may be in-
volved. The county's coats may run anywhere in the range of fram 5 to
50 thousand dollars per mile, however, we seldom construct anything loss
than a 26 foot roadway.
If you were to uou the route across Pope and Talbot, and could use
part of the logging road that is already thero, I would gusas that your
cost night be from a lair of X3500.00 up. This would include thstplat re-
quired by Pope which should be fairly simple.
The route across state lands would also require a plot map which
would have to be in greater detail. ExerLination of the topographic map
would indicate that by using this route you would have to cross a rather
stoop gulch to got to the larger portion of your lands. This would 3A.Mly
cost at least 5000.00 and would more probably be in the noighborhood of
10,000.00 up.
Disragarding the principals, it is Mr belief that you would be
considerably ahead Pinanciolly be paying a pretty good price for the Ovadia
proporty.

The county stands ready to assist you in any way that wo can in
this matter but it appears that there are a fow details that should
be ironed out before we proceed further. This can boot be accomplished
by your calling personally at this office if you can find it possible
to do so.

Dear Mr. Kelly:
I recently purchased the south half of Section 34, Township 27
N. Range 1 W.W.M., with the exception of the southwest 20 acres
presently held by M. Obadia and R.A. Pierce. Both of these parties
have refused me an easement making it impossible to gain access to
my 138 acres.
Mr. Christian of the Department of Engineering, tells me that the
beat access, due to the lay of the land, would be through State
held property in the S.W. 1/4 of Sec. 35, Township 27, N. Range
1 W.W.M. I contacted Nm. R. Dowden, District Director of the
Department of Natural Resources for the State requesting an ease-
ment, and he informed me that the easement would only be granted
to the County, who in turn would work with me.
I would appreciate your help in securing access immediately North
of the Pope Talbot property located in the S.W. 20 of the S.W. 1/4
' of Section 35, Township 27 N. Rang 1 W.W. M. w

Rules Governing the Submission of Plats Accompanying Petitions for Rights of Way
1. Accompanying each application and made a part thereof, shall be a map showing the right of
way covered by the application.
2. Maps must be prepared on a good quality of mounted paper, size 17 inches by 23 inches, scale
400 feet to the inch. Unless by special permission, but one section should be shown on each plat.
3. Give distance to nearest government corners from the point of intersection of the center line
of the right of way with the sectional lines, both entering and leaving section, unless such road ends on a
government meander line in which case the meander notes connecting such end of road with nearest
government meander corner must be given.
4. Give the regular alignment notes of the survey including all curve data. If the right of way
enters or leaves the section on a curve, show the bearing of the tangent to the curve at the point of in-
tersection.
5. Give the area of the right of way in each legal subdivision (Government lot or 40 acre tract).
6. Place the certificate of the official engineer upon each plat submitted.
7. All plats must be certified to be accurate, signed and sealed by a registered professional engi-
neer or land surveyor. (Chap. 283, Laws of 1947.) The plat should be carefully checked by the engineer
or surveyor before submission. Plats found to be inaccurate will be returned, delaying action on the
application.
8. Give any other data that will be of service in the thorough understanding of the plat sub-
mitted.
