We have attributed both to being caused by improper compaction by your contractor during back - filling. As the washouts were on a narrow road and into the driving lane we felt it to be an emergency situation and one of our men took care of both problems as they occurred. He has a total of three hours and ten yards of quarry rubble on each job. You will find enclosed an itemized billing for his time, truck, and materials. Thank you for your attention to this matter. We appreciate your consideration and interest in taking over the Little .Quilcene Road. It ceased to be a typical Forest Service Road some years ago. Jefferson County is in a better position to provide service to the traffic on the road than the Forest Service. In addition Jefferson County can do a better control job than the Forest Service. You will note that the special use permit is written for a 10 year period. This provides you with an amortization period for investments in maintenance and reconstruction by the county. The rights- of-way on file for Little Quilcene Road all stip- ulate a 66 ft. right-of -way. The accident in question was on a Jefferson County road and was not within the boundaries of the Quilcene Ranger District. We have very little inform- ation as to history of the road. We know that it is basically lucaLed on a railroad grade constructed in early 1920'x. We have no record of road plans or specificatiuns. To date, we have not found any conveyance records. Two Ranger District employees arrived at the scene after the accident so have very little information concerning the incident. Ranger District employees were James Halvorson and Richard Dinkleman.' Dear Sir: I represent Earl Woodley, Inc. in a truck/bus accident which occurred on May 4, 1982, in the Quilcene Ranger District. According to the State Patrol report, the accident occurred on U.S. Forest Service Road No. 2907. I have learned from Mr. Minty of your District that Forest Service Road No. 2907 was deeded to Jefferson County approximately ten years ago; As I understand it, this road is now known as Jefferson County Road No. 34270. I would appreciate receiving any information that your office may have concerning the road on which this accident occured. Specifically, I would be interested in knowing the history of the road, including the design specifications and plans. I would also be interested in any information you could provide me regarding the transfer of this property to Jefferson County. I have also learned that there were Forest Service personnel present at the accident scene. I understand that these people were working out of the Quilcene Ranger Station. I would appreciate it very much if you would mention this accident to all Forest Service personnel at the Quilcene Ranger Station and provide me with the names of all persons who may have knowledge of this incident. All the documentation in the county files has been sent to you in prior correspondence. The physical evidence in the field may support your claim to use of the Ridderbusch access road; but Jefferson County has no right to impose access rightsfor you on another person's property. Mr. Ridderbusch has stated that his road was built as part of the consideration for right -of -way; timber value taken from his land; and as a replacement for the lower road being vacated. I discussed this road with Mr. Becker before he left for the south; but he was unable to add information beyond what was in the file. I am sorry that I cannot assist you further in this matter. M. L. Director of Public Works MLS:ejs cc: Board of County Commissioners File 352909 SNOW CREEK ROAD` 45 -019 Likeke Flace Kaneohe, Hawaii 96741, :november 6, 1980 Jefferson County Board of Commissioners Courthouse Fort Townsend, Gentlemen: Late in 1979 my wife and I purchased from George and Lorraine Nichols approximately 11 acres of land in the Lake Leland area with the eastern end cf the property abutting the lake. We were advised by i:r. Niichols that he had earlier agreed with the County Commissioners to give the County the property they needed for a new upper road and right -of -way in exchange for two things. These were, one, an access road to his cabin near the lake from the new upper County road a-.1, two, their agreement to vacate the portion of the lower old County road which went throurh his property near the lake. The Ccm.,issioners agreed to these vondit!cns. However, at this point in time we are not positive or how this arree- mant was actually carried out and we request your action on this matter. The piece cf property is described on our tax statement as "S 26 T 28 R 2 W 11.35 A Lot 1 (:;1/2) Less R of W." The minutes of the Comm..issicner's meeting of April 1, 1963 containei the information regarding George Nichols' appearance be- fore the Corr_iseioners and the agreement cencerninp the lower road being vacated when the new road was dropped to his and the adjoining Ridderbusch property. (A copy or a portion of these minutes is enclosed.) To give you additional background George Nichols gave me the following infor- maticn by letter, and I quote portions of it: "When the county fathers first discussed the possibility of abardon- im, the bridge across the lake and building a new access to the north side of the lake I attended a commission meeting and told the ccm °.issioners that we would give the county the property needed for the right -of -way, If in return they would vacate the lower road and provide us with an access rand tc the cabin, fror the new road. I also suggested the;• put the drop road alone the east line and we would give the. Ridderbuschs access to their property over the same road. In this way the county would only have to put in one drop road. They agreed to our request and suggestions. Horace Gleason was chief of the survey crew and Ed Becker was county engineer at the time. Horace came to us and told us that the topography of the property along the east line made it almost impossible to put the drop road in the location suggested. Lorraine told him of an old 'skid road' that was used for logging that land many, many years ago, when she was a child. The survey crew did some hunting and did in fact find the old skid road, which was used as the bed for the present access road. We discussed these developments with the Ridderbuschs and I feel there would be no problem verifying all of these facts.." There is in fact a "drop road" all on the Ridderbusch property which runs .`rem.. the ncu urger County road down to approximately the area of Ridderbusch's cabin and at the point this road intersects our north property line (formerly the Nichols' property) is a gate separating Rir.derbusch's property and ours. 352909 SNOW CREEK ROAD Jefferson County Board of Commissioners November 6, 1980 Page 2 of 2 This appears to be the drop road to which George Kiehols is referring and would provide the agreed upon access to our property if the Commissioners establish the fact this road was and is the cne put in per their earlier agreement with the then two adjoining property r,wners and document such as being a legal access to our property. Dear Mr. Sanstrom: Subject: Access Road - Lake Leland Thank you for your letter of January 30, 1981 regarding the access road to Nichols' cabin on Lake Leland.,. As you undoubtedly realize from my earlier correspondence to the Board of Commissioners including the information from George and Lorraine Nichols, Mr. no Ridderbusch's telephone conversation with you does not agree with the data given to us. I will be most appreciative if you will carry your investigation further. The following facts seem to be relevant: 1. The only record of the reason that the County constructed the drop acces road to the vicinity of Nichols and Ridderbusch's cabins states that George Nichols appeared before the Commis- sioners and requested the lower road be vacated "when the new road is dropped to his and the adjoining Ritterbush property." The excerpt from the minutes of the Commissioners meeting which I earlier sent to you included the above words as well as, "The Commissioners were agreeable." Nowhere is there an indication or record that Ridderbusch negotiated with the County for the drop road. 2. On the drop access road which was put in by the County to the cabin(s) there is a gate in the fence separating the Nichols' and the Ridderbusch property. If access wasn't intended to be provided to Nichols' property reason dictates that the gate wouldn't have been erected. 3. Ritterbusch fan some reason was paid by Jefferson County for his Quit -Claim of property "in the matter of the North Leland Road." I'm certain you are as anxious to equitably resolve this matter as we are. Possible Ed Becker, who George Nichols advises still resides in Port Townsend 352909 SNOW CREEK ROAD Mr. M. L. There is a cnmplete file on County Road Project. 3301 seLting up the location, design, rinhl, of way, and constrpc- tion of the upper road, inc Iudinn the contract: construction plans. My Roy Ridderbusch has told me (hy phone) that the access to his property was never intended for access to the Nichols' property that you now own. He also told me that there was an existing access to the Nichols' Property that would require rather minor bulldozer work to remove alder, growth to make it passable. The County Road Superintendent, Fred Marggraf, and I checked this out. We found the old road, overgrovni with alder, leading down to the vicinity of the Nichols' cabin. My inquiry was questioning the proper spelling of the original homesteaders after whom I am assuming you named the road. Their name was Magee not McGee. My father, Lester West, lived with the Magee family for a short time in his youth and later purchased the home and 40 acres from them. I grew up here and have recently moved back 'home' to raise my family. It was nice to see that when you named the roads you named them after local citizens, (Munn road after my aunt & uncle). In your letter you state this road was originally the Arcadia Valley Extension yet in my 30 yr. I have never heard the road referred to by this name. It's a privlidge to have a road named after you but a disappointment to have it spelled incorrectly. As there are only the two families living on McGee Rd. I didn't feel a petition was really necessary as neither of the two parties object to correcting not re- naming the road. If it is a formality we must follow please let me know. The Washington State Law RCW 36.32.280 & 36.32.290 place direct authority on the county to exercise the state's "soverign and Police powers- -for the purpose of preventing which threaten or Fisheries and Department of Game. These two state laws are in conflict as implemented or interpreted by your staff. Your department puts fish welfare ahead of human welfare. Lands already eroded from Yarr's property are to be further damaged by sloping a 5 foot face on a "2:1 slope or greater, then rock faced ", which results in a further loss of 10 feet to 15 feet of good land. The county found by placing large toe rock, topped With keyed rock spawls nearly 2:1 slope facing was possible, original channel capacity maintained, and further loss of good land avoided. Grant Fiscus of our department, and the landowner Mr. Yarr, went over details of the project together on site, on June 18, 1982. After looking at all eroding banks and examining the stream, the details of how the job could be done while minimizing impacts to fish habitat were apparently agreed upon. These details were subsequently expressed as provisions one through seven on a Hydraulic Project Approval (HPA, dated 6- 25 -82) issued to Mr. Yarr. At that time, there was no indication that a county construction crew would be involved. During the course of a routine phone conversation with Milt Sandstrom on September 2, 1982, our Habitat Manager was advised that the county would be doing the construction work. We immediately sent to your office a copy of the HPA previously issued to the landowner. It became apparent that there was a difference of opinion regarding reshaping of the eroding bank prior to rock placement. While there also appeared to be resistance from the landowner on this item as well, it should be noted that our HPA is an approval subject to its attached conditions. On September 9, 1982, our staff visited the site and reported that it appeared the bank was not reshaped prior to rock placement, contrary to provision four (see attachment). In spots, it appears that nearly one -half of the wetted width has been rock.- covered. While some of the rearing habitat would have been lost anyway, the idea was to minimize encroachment into the stream channel. The end result is loss of both spawning and rearing areas, reduced channel capacity, and possibly Jefferson County -2- September 22, 1982 more energy being directed at the bank bordering the county road. Addi- tionally, our staff noted far more vegetation removal had occurred than was agreed to with the landowner. We are especially concerned with this portion of Tarboo Creek, since it is part of our coho spawning index area (R.M. 2.2 - 3.1) and has been very heavily seeded in past years. Instantaneous counts, for example in 1980, nearly reached 400 adult coho per mile. At this time we are undecided on what action to take, and we request a written response from your office regarding compliance with the HPA provi- sions. In the course of the logging, two access 'roads' were made from Fuller Road to the Snow Creek acreage. Fuller Road sustained damage at these points from the logging equipment and trees were felled, presumably on county right -of -way, to accomodate the logging equipment. Now that the winter rains have started, areas of significant erosion and standing water have appeared on Fuller Road as a result of run off from the logged acreage. The access road shall have a standard sixty (60) foot right of way width and shall be constructed in a manner which meets all county standards for grading, drainage, ballasting and placement of top course. On completion of construction of the access road, Jefferson County will vacate that portion of the Oak Head -Coyle road, County road , that crosses the Pacific Rim property and waive the road vacation pay back requirements. The vacated portion or' County road be maintained as an emergency access road. maintained at east and west terminus of that said portion of vacated county road." During this time, the Planning Department noted in their Staff Report that Mr. James Strictiand objected to the road vacation. It is also noted in other planning department correspondence that the Strictlands were notified of the Proposed road vacation. At the Planning Commission meeting of February 4, 1961, a recommendation was made to grant the request for the vacation, requiring, in addition, a condition that ''an easement be granted along the existing Strictland driveway to the vacated road" At the public hearing on March 23, 1961, the Board of County Commissioners accepted the .recommendation of the Planning Commission and added a third recommendation to the two the Planning Commission recommended: 1. An easement be provided to James Strictland from the upper driveway to County Road #16. 403908 Coyle Road The road was vacated by Resolution No. 52 -81 on May 11, 1961. The Strictlands' and others'opposition to the proposed vacation was noted both in Planning Department correspondence and Board of Commissioners minutes. It appears to the Department of Public Works that all legal requirements for road vacations were adhered to, including posting of the proposed vacation. I am enclosing a survey of the area that shows the roads as well as the vacated section of the Coyle Road. The Public Works has twice sent our inspector to the area to determine of gates are being used on the vacated road : both times no gates were in evidence; gate posts were visible, however. The road has been legally vacated and is the property of Thousand Trails, Inc. You have an easement for ingress and egress over the vacated roadway, as well as access along Thousand Trails Road and Tskutsko Point Road. Heavy equipment will now be used only at one location on a high bank not directly involving the stream. All other stream work shall be performed by hand with hand tools. 2. At the fresh sidecast site off the Dabob -Coyle Road near stream River Mile (RM) 0,9, (see item 1 of WDF letter, April 10, 1984) the following plan for restoration was agreed to. Afoot trail route shall be used to gain access to the toe of the bank, thereby avoiding damage to the upper part of the sidecast area. Using hand tools, a trench shall be cut into the slump and a log retaining wall secured in place in alignment with the natural banklinee A fabric /wire mesh on the inside of the wall would provide a beneficial seal in case of leaching. Accumulated sloughed material may then be removed using the outside perimeter as a protective berm. Excavated material shall be placed where it cannot reenter the stream. Dear Mr. Phinney: Jefferson County has taken the following remedial action on the problems addressed in your letter: 1. Unnamed tributary to Tarboo Creek, WRIA C- 17.0130, River Mile 0.9. The 20 *- yards of material sidecast at this location are ditching spoils that are utilized to widen narrow shoulders along roads. This practice has been discontinued at any site that could involve streams or shoreline areas. Jefferson County Public Works has submitted a plan and hydraulic permit to remove the material sloughed into the creek. 2. Unnamed tributary to Tarboo Creek, WRIA C- 17.0130, kM U.4. six foot diameter culvert under the Coyle Road has been in- and found to be in good condition. This portion of the Coyle Road is not on the six year transportation plan. Because of this, it is unlikely that the county will replace the culvert in the near future. When replacement is required, a bottomless arch type culvert, along with other types of structures will be c011- sidered. In the interim, the county will submit a hydraulics permit and be working with fisheries to develop a plan to construct weirs downstream of the culvert to allow fish passage. J. Give the regular alignment notes of the survey including all curve data. If the right of way enters or leaves the section on a curve, show the bearing of the tangent to the curve at the point of in- tersection. 5. Give the area of the right of way in each legal subdivision (Government lot or 40 acre tract). 6. Place the certificate of the official engineer upon each plat submitted. 7. All plats must be certified to be accurate, signed and sealed by a registered professional engi- neer or land surveyor. (Chap. 283, Laws of 1947.)
