Letter of recomendation from Engineer Becker advising that the Cassellary Road passing through tax lot 16 be vacated and simutaneously adopt the Crown Zellerbach road as part of the County Road System and in preperation for adoption, a deed for a sixty foot right of way should be obtained from Crown Zellerbach. Bob Tiegel, representing Crown Zellerbach, stated he believes CZ only has 30' of property for right of way Becker stated this would be sufficient. Vacation tabled until definite information is received by Becker and Tiegel. 500309 Casselary Road November 10, 1972 To Board of Jefferson County Camaissioners Courthouse Port Townsend, Washington 98368 Cassellary Road Vacation Gentlement As directed by you, I have examined that portion of County Road located within tax lot 16 of section 23, township 29 north, range 2 west, I find that the road is visable however, unusable in its present state. Having been unused for approdmately 15 years, it is grown up to brush and small trees' At this time the area having pre been served by the Cassellary Road is being served by a Crown Zellerbach logging road which was constructed approximately 15 years ago. R.C.W. 36.75.020 states that roads used as a public highway for 10 years are county roads provided that they are adopted as part of the road system by resolution of the County Commissioners. The road as built by Crown Zellerbach has an unsafe approach to the West U.. Road. Regardless of the outcome of this vacation approach should be improved. It is my recomendation that the Cassallary Road passing through lot 16 be vacated and simultaneously adopt the Crown Zellerbach road as part of the County Road System. In the preperation for adoption, a deed for a sixty (60) foot right of way should be obtained Crown Zellerbach. The Board of County Commissioners can initiate vacation proceedings under R.C.N. 36.87.10. This latter pro- cedure is taken periodically to keep the road log current. As shown on the attached plan, it is our intention to cut off the narrow seldom used county road at a point just inside our right -of -way. Cul -de -sacs will be provided at the two new termini points within state right -of -way. At the completion of the contract the state would like to turn over to the county the right -of -way containing the turn around areas. This area is shown on the plan. A G R E E M E N T THIS AGREEMENT, made and entered into this 15th day of October 1976 by and between the STATE OF WASHINGTON, WASHINGTON STATE HIGHWAY COMMISSION, acting by and through the Director of highways, hereinafter merely referred to as "STATE ", and the COUNTY OF JEFFERSON, acting by and through the BOARD OF COUNTY COMMISSIONERS, hereinafter merely referred to as "COUNTY ". WITNESSETH: WHEREAS, the State is planning the improvement of State Route 101 from the junction of State Route 104 to the junction of State Route 20 at Discovery Bay in Jefferson County, and WHEREAS, as part of said improvement, it is necessary to close the East Uncas Road to through traffic and construct cul -de -sacs at each terminus of the said severed County Road, and WHEREAS, the Washington State Highway Commission, Department of Highways, and the Washington State Association of County Commissioners and Engineers have jointly developed a policy on Design Standards for Re- arranged County Roads, Frontage Roads, Access Roads, Intersections, Ramps, and Crossings adopted the 15th day of August, 1966 as Highway Commission Resolution No. 1773, and WHEREAS, it is to the mutual benefit of the parties hereto to have a determination made as to future ownership of the right of way for the aforementioned cul -de -sacs and a determination of future maintenance of said cul -de -sacs after their construction is completed. 500509 E. NOW THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: The County shall accept full control of the right of way for the cul -de -sacs on the severed ends of the East Uncas County Road as shown in red on Exhibit "A" of this agreement, such control shall include performance of all future maintenance for the cul -de -sacs. II At the time construction is completed on the cul -de -sacs included in this agree- ment, officials of the County and the State shall conduct a joint inspection of the cul -de -sacs to determine that the construction has been completed -in accordance with the plans and specifications of the State's contract for the work and that all work has been done in a workmanlike manner acceptable to the County prior to transfer. III The State shall notify the County in writing of the results of the joint inspection made in Section II of this agreement, and of the State's intent to transfer title and performance of maintenance of the completed roadway facilities to the County subject to any condition agreed to by the parties hereto at the joint inspection. The County shall notify the State in writing of their concurrence in the results of the joint inspection and tentative acceptance the completed roadway facilities. Upon receipt of the County's concurrence, the State's District Engineer shall in writing transfer all maintenance responsibility and control of the right of way therefor of the completed facilities to the County. Said transfer shall become effective on the date of such written notification to the County. - 2 - IV The State shall transmit to the County the deeds for the right of way of the transferred facilities within six (6) months of the effective date of said transfer. V It is provided and agreed that no liability shall attach to the State or the County by reason of entering into this agreement except as expressly provided herein. It appears that a plugged and long- unused box culvert under the highway is being reopened, possibly to accommodate some new drain- age patterns above the highway on the south side. If this is the case, I would appreciate hearing from you about your plans, as a new flow of water through this culvert would adversely affect our bridge. It is of the framed bent -on -mud block type, not a driven pile structure, and without channeling of the water and rip -rap protection, the supporting mud blocks would undoubtably be undermined and washed out.
