Gentlemen:
This office represents the Gunstone family, who reside
and operate a commercial clam farm at Contractor's Point in
Jefferson County (Section 36, Township 30 North, Range 2 West
W.M.). The Gunstones' residence and portions of their clam
operation are located along Contractor's Creek.
Above my clients' property, Contractor's Creek passes
under a county road and under a railroad line, which I have
been advised is owned and/or controlled by your two railroads.
Culverts installed to handle the creek flow are not operating
properly and constitute a hazard to my clients' property. The
culverts are located approximately 100 feet east of a crossing
designated with crossing inventory number Milw. 399 797 K.
Apparently substantial amounts of fill material from
under the railroad bed have been falling into the stream for
over a year, and there now are timbers from an abandoned rail-
road trestle which are partially blocking the culvert. The
debris in the stream has caused some flooding damage over the
past winter, including loss of some large cedar trees on the

Dear Mr. Shelton:
Thank you for your letter of September 13, 1984 concerning the
failure of part of the culvert (Railroad No. PA 137'0 under
County Road 501409 at Highway M.P. 2.0 and under our adjacent
railroad track at RR M.P. 17.4.
I made a detailed inspection of the inside of this culvert with
Mr. Shanklin of the Seattle & North Coast
in September and
checked it again during my October trip. I agree that action
will have to be taken to correct the situation and have discussed
with Mr. Shanklin his plan for this; the method he outlined seems
quite feasible.
Since the Seattle & North Coast RR is presently in charge of this
line, the are also responsible for the maintenance of it. Their
trustee is working hard on plans to complete the purchase of the
line from the Milwaukee and get it back in operation. Once that
happens, the S&NC would be in a position to carry out the culvert
repairs. Mr. Shanklin said this is one of the first things he would
want to accomplish once they are running again.
If for some reason our line is sold to another railroad, I will
see to it they are notified in writing (with a copy to you) about
the culvert problem and their obligation to correct it. In the mean
time, I will continue to monitor the situation each time I am in
the area to make sure that it does not worsen in the coming months.

I have no particular objection to your proposal.
However, it should be noted that the installation will
require approximately 22' of 24" 12-gage asphalt
coated corrugated pipe. The installation will require
the service of some of our people.
Do I understand that you will
assist with the installation?
One further factor is involved which should be
resolved. A review of my file appears to indicate
that a diversion of the present drainage from our
culvert PA-1498 located west of the road is planned.
If this is planned then I believe we should know if
Jefferson County or Mr. Carroll Wells will be willing
to idemnify the Railroad against liability for losses,
damages, claims, etc, that may arise due to the
diversion of drainage from the area normal to PA-149

There has been referred to me file of the Jefferson
County Engineer's office reflecting correspondence between
yourself and that office from the dates of August 14, 1959,
to February 8, 1960.
The Board of County Commissioners for Jefferson County
has committed itself to proceed with this public improvement
and dhfW ordered the institution of proceedings in eminent
domain.
I am reluctant to commence the condemnation action in
view of the fact that the value of the real estate is so dis-
proportionate to the cost of the prosecution. This matter is
truly one for negotiation, and from information given to me
outside the language of Mr. Christian's letter to you of Feb-
ruary 8, I am satisfied that the county's offer is more than
fair.
Please let me hear from you forthwith, as I have
pointed out, it is just idle to unnecessarily throw away
money, and, frankly, I am satisfied that the value of. the
land needed by the county is less than what you would have
to put out of pocket as attorney's fees.

Last 'summer and fall we corresponded with you regarding right of way
across your property at Gardiner. When we were unable to obtain your right
of way as soon as hoped it became necessary to abandon the project for last
year. We did not then know if the road would be built so we suspended
negotiations.
The Board of County Convmissioners has indicated that they now wish to
revive the project in order to schedule it for early construction this spring.
In referring to our past borrospondence, we can find no indication of
what you would consider a reasonable offer. There are only two fruit trees, one
apple and one pear, which would be affected by this construction. Through age
or neglect or both these now seem to be of little value. On the condition that
the fencing would be taken care of by the owner, we have authorized to increase
our offer to $100.00.
Since the board is now coardtted to the completion of this project it is
to be hoped that we can arrive at an amicable settlement without the necessity of

It is not the policy of the county to pay for right of way for local roads
where the road is built solely for the benefit of the local owners. However
there is always the problem of the owner at the end of the existing road who
needs no further extension and we are forced to recognize the fact.
In order to find an early solution we feel we can offer $58.00 for the right
of way across your property. This represents a valuation of $200.00 per acre for
the 0.29 acre that we require. Since the assessed valuation of this parcel if
only $80.00 per acre and includes 215 feet of waterfront we feel that this is a
fairly generous offer. As you will note on the sketch we sent you previously,
the proposed road is across the south end of your property and there is no
severance involved.
We are enclosing the corrected deed and a voucher for payment. If this Mesta
with your approval please sign where indicated and return in the enclosed envelope.
If you are married, would you have your wife sign the deed too?

I recently applied for a P-1 private road approach per permit 83-06-08-3.
The permit was issued requiring a 21 foot length of 12 inch diameter pipe.
Our intent is to install a single lane road approximately eight feet
under, and it appears to me that a 21 foot length of culvert centered on
the existing gate would interfere with Mr. Doug Hovens existing drain.
The drain pipes, according to my dealer, come in 20-foot lengths as a stan-
dard, or are usually cut in half. I have located a 20 foot length of new
galvanized 16 inch pipe, and am asking that you allow this 20-foot length.
As we plan on being at the place the weekend of July 9, a prompt reply
would be appreciated.

ORDER TO ESTABLISH A COUNTY ROAD
"SCHOOL HOUSE ROAD", GARDINER
This matter coming to be heard this day upon the County
Road Engineer's report and the County Planning Department's report
with respect to Resolution No. 31-82, "Intent to Establish County
Road", submitted by the Jefferson County Commissioners, and it appear-
ing to the Board of County Commissioners that notice of hearing has
been posted and published for the time and in the manner provided by
law, proof of such posting and publication being now on file herein
and said Board having the other evidence adduced, and being fully
advised in the premises does now find and determine that the public
will be benefited by the establishment of this road as a part of the
County Road System; now, therefore,
BE IT RESOLVED, and it is hereby ORDERED. THAT:

HEARING NOTICE
WHEREAS, the Board of Jefferson County Commissioners have
determined it in the best interest of the public to maintain the road
commonly known as "School House Road" as a, part of the
County Road System,
which said legal description is as follows:
The West 60 feet of the NW; of Section 34,
Township 30N, Range 2 W.W.M. between County
Road No. 102 (Old Gardiner Highway) and
County Road No. 104 (Gardiner-Clallam Road)
contemplation of the language of Statute R.C.W. 36.81.010, Now,
Therefore,
BE IT RESOLVED, that this Board of County Commissioners does now
declare its intention to establish the above described "School House Road"
as a county road due to public necessity.
• BE IT FURTHER RESOLVED, that the County Road Engineer is hereb
directed to examine the said road and report his opinion as to whether this
road is practicable as to the necessity of the road, as to the proper
minal points, general course and length thereof, and all other facts
matters and things which will be of importance to the Board; and that such
report be filed as soon as possible.
BE IT FURTHER RESOLVED, that a public hearing shall be held on
Monday, the lath day of May, 1982, at the hour of 10:30a.m.,.i.n the Commis-
sioners' Chambers, Jefferson County Courthouse, Port Townsend,
Washington,
at which time all interested persons may appear and be heard on the report
and recommendation of the County Road Engineer either to proceed or not to

T Gary and I inspected the above referenced private road On January 7, 1982. The
road is approximately one half mile long with a good base. The owners now have
it fenced off on the southerly end. The road is used by the local drivers because
the driving distance on the county road system is 1.2 miles longer around to the -"'
east and 2.2 miles longer around to the west. F
If the county assumes responsibility for this road, we would have to grade it and r
BY? sign it. That would be all at the present time due to the traffic count (40 ADT). EC
We would put the road on our priority array and improve it when it becomes eli-
gible. At some time in the future, when traffic warranted it, we would have to ?. -
improve the intersections at each end, improve the drainage and surface.

GENTLEMEN:
Whereas, the gravelled road (known as "Schoolhouse Road "),
running North from the Old Gardiner Highway at the Gardiner
Community Center to the Gardiner Beach Road, is owned by the
abutting property owners; and
said road is frequently used by all local residents
for activities held at the Community Center, by the school busses
and for general neighborhood activities: and
WHEREAS, said road is vital to Fire District No. 5 of' Jefferson
County for fire protection and aid car calls; and
, owners of this road do not feel it is their duty to
maintain a road so commonly used as a public access;
NOW, THI'REFORE, Vie, the owners of the above referred to
property, respectfully request that the Jefferson County Commissioners
accept deeds to this road from the various owners and incorporate
said road into the County Road system, with the provision that by
their accepting this road the owners will not be obligated to pay
for up- grading or maintaining said road.
