The magnitude of the problem was pointed out by Mr. Chesterley inasmuch as he indicated the drainage originates from a,small valley approximately 7/8 mile long, covering a substantial, but admittedly unknown, area of upland extending possibly to Teel, Lake, Much of this area is heavily forested and has a much higher potential drainage if the present forested conditions are altered or changed without proper pro- tective measures. Prior to 1961 much of the run-off which had been diverted from the natural drainage passed westerly to a culvert which crossed the road at approximately Lot 3 or 4. After that date, the Chesterley and Fish properties began to have drainage come across their properties from a culvert which crossed the road at approximately Lot 11. In about' 1966, the entire flow of drainage was diverted across the Chesterley and Fish properties and caused a heavy damage through erosion. This damage was repaired by our clients at considerable expense to themselves. _ They have attempted to minimize damage since that time and have received some cooperation from the county in attempting to equal- ize the drainage between the two culvert's. It is anticipated that under present conditions, the maximum drainage that could over our client's properties would be approximately one-half of the total present flow as measured at the point of diversion. ., ' ft m However, if drainage is to increase, or if there is more than that amount coming over the Chesterley and Fish properties, it a is anticipated that there could be severe damage to the Chesterley and Fish properties. Becker to outline to the commissioners the material and feasibility of returning the drainage to the original flow. Discussion then turned to the expectations of planning by Pope & Talbot of the area south of Queen Anne Boulevard. for. Cheney indicated that Pope & Talbot has no set schedule for development of land above the road and it might be five to twenty years prior to the platting of that property. He indicated that Pope & Talbot would submit plans to the county commissioners outlining the manner in which water run-off E from platting, clearing and development of said property would be handled without darage to the lover property owners. Dear Sir: In view of increased property taxes, came being paid under protest due to the fact that with the enormous increase in this year's taxes, we are not receiving proper improvements such as water drainage. You are probably already familiar with the complaints about drainage along Queen Anne Boulevard at Pt. Ludlow Bay. The writer sees no reason, in view of present and future progress, why same could not be properly taken care of by draining excess run-off water along side the county road to the sixty-foot allotment which the county owns for access to the Bay, and not allowing the water to drain over private property, thus causing considerable damage to mentioned property. If we are to pay such increased taxes, one would expect to have proper road engineering with proper drainage. Would appreciate giving this matter your further consideration and advising. Pedersen, these small infringements on the cul-de-sac. I could ba mistaken, but I do not believe that Col. Pedersen would agree. He has been unwilling to speak to me or to my wife for about two years, al- though we have tried to be good and friendly neighbors. The matter is most h' unfortunate; my wife and I feel quite blameless, but Col. Pedersen has chosen to be hostile. I believe that his formal complaint to you is connected with this attitude on his part. I understand that he has told various County of- ficials that because our wall and carport intrude into the cul-de-sac, fire - equipment or other heavy vehicles might not be able to turn around therek lie also says, according to Hr. Sanstrom, that he is unable to turn his boat and trailer around readily in the cul-de-sac. As to the first problem, i.e., county equipment, I em not a good judge, but I believe that inspection first- hand on your part will confirm that there Is indeed a generous amount of space. As to the problem of his boat: he has turned it around several times in the cul-de-sac under our eyes, and seemingly without trouble. Ou one re- I cent occasion, he seemed to have some difficulty with the maneuver, but in that case two cars belonging to his guests were parked within the cul-de- sac and were the chief impodiment. Recently, for a period of about six weeks, Col. Pedersen parked his boat-trailer (part of the time with the - - boat Ou it) clearly within the cul-de-sac. At various times, his visitors have parked inside the cul-de-sac for a week or more. We du not particularly object to this; we believe this is a lonely, rural, isolated area with very little traffic and that informality and goodwill if shown aA all sides can - resolve any such questions easily. We understand that at sofao future date, the County might decide to pave our road or make other improvements and that the wall and corner of our carport in question could conceivable pose an impediment. We doubt that this will happen soon, but it certainly is possibled However, we believe that in the present state of affairs, these fixtures of ours do not seriously infringe - use of the cul-de-sac by the property-owners here or by the public. The reasons given for not accepting my proposal are not germane to the problem and what I proposed, and are totally unacceptable. Your statement, for example, that "The County has issued a license to use the right-of-way to Harold Curtis and James Huntley" is not binding to the County. Paragraph (5) of the license agreement, which by the way was granted without a hearing or our knowledge, states clearly that "the license may be terminated by the County on 90 days notice. Both Mr. Curtis and Mr. Huntley agreed to this condition, and therefore, should be fully aware of the clause. Consequently, the County is not bound to any protective agreement guaranteeing continued encroachment. Your statement "Because of the present use of the road, we see no need•to re- voke the license in order to make road improvements" is not valid. First, as expressed in my proposal, there would be no expense incurred by the County. Second, a cul-de-sac is a deadend road. The only people using it are the cul-de-sac property owners, vehicles cruising the area and service/maintenance equipment. Property owners living on South Bay Lane in between the cul-de-sac one the County Road (Tale Shores Road) are not going to drive to the cul-de-sac end of the road every time they arrive and depart their homes. The lots confronting the cul-de-sac are all occupied. There are no vacant home sites. Consequently, the cul-de-sac may never experience any significant increase in traffic above that which presently exists. Therefore, in essence and based on the County's analysis of greater use, the South Bay Lane cul-de-sac will never qualify for improvement. Additionally, your statement that of the present use of the road, we see no need to revoke the license in orcer to n:ake road improvements" is unfair and inconsiderate to my rights as a property owner.
