Mr. cook and Mr. Cole. The magnitude of the problem was pointed
out by Mr. Chesterley inasmuch as he indicated the drainage
originates from a,small valley approximately 7/8 mile long,
covering a substantial, but admittedly unknown, area of upland
extending possibly to Teel, Lake, Much of this area is heavily
forested and has a much higher potential drainage if the present
forested conditions are altered or changed without proper pro-
tective measures.
Prior to 1961 much of the run-off which had been diverted from
the natural drainage passed westerly to a culvert which crossed
the road at approximately Lot 3 or 4. After that date, the
Chesterley and Fish properties began to have drainage come
across their properties from a culvert which crossed the road
at approximately Lot 11. In about' 1966, the entire flow of
drainage was diverted across the Chesterley and Fish properties
and caused a heavy damage through erosion. This damage was
repaired by our clients at considerable expense to themselves.
_ They have attempted to minimize damage since that time and have
received some cooperation from the county in attempting to equal-
ize the drainage between the two culvert's. It is anticipated
that under present conditions, the maximum drainage that could
over our client's properties would be approximately one-half
of the total present flow as measured at the point of diversion. ., '
ft m However, if drainage is to increase, or if there is more than
that amount coming over the Chesterley and Fish properties, it a
is anticipated that there could be severe damage to the Chesterley
and Fish properties.

to twenty years prior to the platting of that property. He
indicated that Pope & Talbot would submit plans to the county
commissioners outlining the manner in which water run-off E

Dear Sir:
In view of increased property taxes,
came being paid under protest due to the fact that
with the enormous increase in this year's taxes,
we are not receiving proper improvements such as
water drainage.
You are probably already familiar with the
complaints about drainage along Queen Anne Boulevard
at Pt. Ludlow Bay. The writer sees no reason, in
view of present and future progress, why same could
not be properly taken care of by draining excess run-off
water along side the county road to the sixty-foot
allotment which the county owns for access to the Bay,
and not allowing the water to drain over private
property, thus causing considerable damage to mentioned
property.
If we are to pay such increased taxes, one
would expect to have proper road engineering with
proper drainage. Would appreciate giving this matter
your further consideration and advising.

Peference is made to the fact that if the washout was caused by
roadway drainage, the damage would have been also apparent on
Fish's driveway. , you will recall, is constructed of
quarry rock which allows considerable seepage and also because of
its massive size is not subject to erosion.
I hope that you appreciate the fact that Mr, Fish is interested in
avoiding litigation, but if necessary, this will be undertaken,
Your cooperation and attention to this problem would be appreciated.
P. S. The home of Lot 14 which is threatened by loss of lateral support
due to erosion is a year-round home. At the rate that erosion took
place in the last year, the home will undoubtedly be lost this year.

This water is coming through a concrete culvert pipe under the county
road some 270 ft. southwest of

be sealed along with deepening the existing open culvert ditch allowing
the water to be diverted to a natural year around creek that goes under

Permit issued by the Department of the Army does not give any
property rights, either in real estate or material, or any exclusive
privileges, and does not authorize injury to private property or in-
vasion of private rights, or infringement of Federal, State or local
laws or regulations; nor does it obviate the necessity of obtaining
State assent to the work authorized. It expresses the assent of the
Federal Government only insofar as it concerns the public rights of
navigation.
Interested parties are invited to submit in writing any objections
that they may have to the maintenance of the work. The decision as to
whether or not the plan will be approved must rest primarily upon the

This agreement is between JEFFERSON COUNTY, acting by the
Board of County Commissioners, hereinafter referred to as the y
"COUNTY", and ROBERT W. and ELAINE BECKMAN, hereinafter referred
to as the "BECKMANS".
WHEREAS, the BECKMANS are the owners of Lots 8 and 9 of
Ludlow Point Tracts, as recorded in Volume 4, Page 6 of Plats,
records of the Jefferson County Auditor, and
WHEREAS, the BECKMANS have constructed a garage and carport
encroaching upon COUNTY rights of way dedicated in said plat and
known as South Bay Lane, and more descriptively shown on attached
Exhibit "A" which by this reference is incorporated herein, and
WHEREAS, the BECKMANS acknowledge that the garage and
carport are on COUNTY rights of way and recognize that the COUNTY
requires protection of its interest in the rights of way; NOW
THEREFORE,
IT IS AGREED:
(1) LICENSE. The BECKMANS shall have a license to use,
operate and maintain a garage and carport, as shown on the
attached Exhibit "A", for the purposes of storage of vehicles and
other items, and for those purposes only.
(2) COSTS AND EXPENSES. The BECKMANS shall pay all costs
and expenses related to the use, operation and maintenance of the
garage and carport.
(3) INDEMNIFICATION. The BECKMANS shall be responsible for
the safe and proper maintenance of the garage and carport. The
BECKMANS shall, further, defend and hold the COUNTY harmless from
all liability or expense of litigation in connection with any
item of actual or alleged injury or damage related to the
BECKMAN'S use and maintenance of the garage and carport.
(4) TERMINATION. This license may be terminated by the
COUNTY on ninety (90) days notice. On termination, the BECKMANS
..ill remove any and all appurtenances from the right of way, and
the right of way restored to a neat and orderly condition,
subject to the approval of the COUNTY. All costs incurred in
restoring the right of way to a neat and orderly condition shall
be paid by the BECKMANS.

This Agreement is between JEFFERSON COUNTY, acting by the
Board of County Commissioners, hereinafter referred to as the "COUNTY
and JAMES R. HUNTLEY and COLLEEN G. HUNTLEY, husband and wife,
hereinafter
referred to as the "HUNTLEYS".
WHEREAS, HUNTLEYS are the owners of and reside on Lots 8
and 9 of Ludlow Point Tracts, Vol.. 4, Pg. 6 of Plats, records of Jefferson
County Washington, and
WHEREAS, the HUNTLEYS have constructed a house and carport
and rock wall encroaching upon COUNTY right of way dedicated in said plat
and known as South Bay Lane, and more descriptively shown on attached
Exhibit "A" which by this reference is incorporated herein, and
WHEREAS, HUNTLEYS acknowledge that the house and carport
and rock wall are on COUNTY right of way and recognize that the COUNTY
requires {

` COUNTY on 90 days notice. On termination HUNTLEYS may remove any equip-
ment they have stored within the carport; and the carport and house
foundation area shall be removed from the right of way, and the rock wall
shall he removed from the right of way and the right of way restored to
a neat and orderly condition.
(6) COUNTY APPROVAL FOR WORK TO BE PERFORMED. HUNTLEYS

Dear Board of Commissioners:
Please be advised that this law firm represents Leonard and
.Audrey Pedersen, who are residents of the Port Ludlow area,
in Jefferson County. Their neighbors on a cul-de-sac known
as South Bay Lane, James R. Huntley and Harold P. Curtis,
were granted licenses on May 11, 1983, allowing their private
use of portions of th
The Pedersens have voiced concerns from the very beginning
n regard to the loss of their expectation of the use and
enjoyment of the cul-de-sac area. They related these
you as a governing body during the board meeting of July
12, 1982. This was perceived by the Pedersens to be an informal
initial discussion of the concerns on South Bay Lane. However,
sometime
ater, as you will note from the date of the licenses,
the issues were resolved against the Pedersen's wishes, without
further input from them.
Clearly, the Pedersens had some concerns about the process
and the result in regard to the licenses

me copies of letters prepared by themselves and by other attorneys
working for them, which addressed these concerns both to you
as a governing body and to the Jefferson County Prosecuting
Attorney. This correspondence has occurred over the course
of the last two or three years. Clearly, there has been no
change in status that has come about as a result of that correspondence.
I have advised the Pedersens that because of the time frames
between the granting the license and their current appeal,
there is little likelihood that they may prevail on a suit
to have the licenses extinguished. However, a reading of
the licenses show that they are not transferrable and freely
terminable by the county upon notice. Given these elements,
the Pedersens have instructed me to make it clear that they
will contest any transfer of the license to subsequent owners
of neighboring parcels and reaffirm their desire to have the
licenses terminated.

The facts are
these: Mr. David Crow, of Edmonds, Washington, spent seven years
building the house in which my wife and
I now live. We purchased the house from
Mr. Crow in February 1978, At the time of purchase, there was a

that a post with a basketball hoop attached, erected by Col. Pedersen about -
four months ago, lies within the county-cul-de-sac.
I think I understand the legal position, as explained to us by .Mr. Sanstrom.
I believe that Mr. Harold Curtis (who is away in California at this time)
would be happy to agree to a request that the County vacate, in our favor
and in that of Col. Pedersen, these small infringements on the cul-de-sac.
I could ba mistaken, but I do not believe that Col. Pedersen would agree.
He has been unwilling to speak to me or to my wife for about two years, al-
though we have tried to be good and friendly neighbors. The matter is most h'
unfortunate; my wife and I feel quite blameless, but Col. Pedersen has chosen
to be hostile. I believe that his formal complaint to you is connected with
this attitude on his part. I understand that he has told various County of-
ficials that because our wall and carport intrude into the cul-de-sac, fire -
equipment or other heavy vehicles might not be able to turn around therek
lie also says, according to Hr. Sanstrom, that he is unable to turn his boat
and trailer around readily in the cul-de-sac. As to the first problem, i.e.,
county equipment, I em not a good judge, but I believe that inspection first-
hand on your part will confirm that there Is indeed a generous amount of
space. As to the problem of his boat: he has turned it around several times
in the cul-de-sac under our eyes, and seemingly without trouble. Ou one re- I
cent occasion, he seemed to have some difficulty with the maneuver, but in
that case two cars belonging to his guests were parked within the cul-de-
sac and were the chief impodiment. Recently, for a period of about six
weeks, Col. Pedersen parked his boat-trailer (part of the time with the - -
boat Ou it) clearly within the cul-de-sac. At various times, his visitors
have parked inside the cul-de-sac for a week or more. We du not particularly
object to this; we believe this is a lonely, rural, isolated area with very
little traffic and that informality and goodwill if shown aA all sides can -
resolve any such questions easily.
We understand that at sofao future date, the County might decide to pave our
road or make other improvements and that the wall and corner of our carport
in question could conceivable pose an impediment. We doubt that this will
happen soon, but it certainly is possibled However, we believe that in the
present state of affairs, these fixtures of ours do not seriously infringe -
use of the cul-de-sac by the property-owners here or by the public. Mrs.
Huntley and I would therefore like to request that the County Commissioners
grant us an Occopation Permit, which--if granted--I understand would allow
us to leave these fixtures as they now are until such time as the County
might require the small bits of land for public purposes.

Gentlemen:
The County has reviewed the adequacy of the above referenced access road
and has decided on the following action:
1. A "Dead End" "No Turn Around"
meaning and intent of
that guests, and not abutting residents, shall
park in the cul-de-sac. Parking in the cul-de-sac to be in a manner
that will not block individual residential access.
The current- needs of the County Road Department and the District
Fire Department are being met for maintenance and access. Therefore,
no improvements of the road or cul-de-sac will be made at this time.
If the residents on South Bay Lane wish to upgrade the road by widening to
two lane traffic with a fully developed cul-de-sac, the project can be done
as.an R.Z.D. (Road Improvement District), or by individually funding it in
accordance with R.C.W. 36.82.110 (copy included).
To improve the cul-de-sac without improving the rest of the road in not
normal. The cost of reconstructing only the cul-de-sac is estimated by the
Engineer's office to be approximately $2693.27.

Maintain which you sent to me on 1 April 1983.
My wife and I have signed this document. However,
in the interests of accuracy, we would appreciate it
if the Commissioners and the
Prosecutin
Attorney
would note the statement which we have added to the Li-
cense, and indicate their approval of that addendum.
As drafted, the original License indicates that we
constructed all the structures which encroach, but this
is not the case. As you will see the
"house" portion of the
(garage) which encroaches constitutes (if I
understand this most recent survey correctly) no more
than a corner, about a foot square, of an overhanging
eave of that structure
was of course appalled to
discover that this, too, was an "encroachment."
My wife and I bought this property in February 1978,
with no idea of these anterior encroachments, construe-
ted by the previous owner, Mr. Crow
As I explained
to the Commissioners at the hearings last year
the
carport, which we added to the garage in the summer of
1978 was a completely inadvertent
encroachment. We
did not have a proper survey which showed buildings
and other structures, we "eyeballed" the de facto
cut de sac, and made an unfortunated assumption
But we would greatly appreciate it if the Commissioners
will acce
our addendum, which I believe sets this
record straight
The matter is important to clarify,
my lawyer and I believe, because at
some point, other
owners of our property and other County officials
may have to deal with the question again.

Enclosed is the original of the License to Use and
Maintain, which you sent to me on 1 April 1983.
My wife and I have signed this document. However, in
the interests of accuracy, we would appreciate it very
much if the Commissioners and the Prosecuting Attorney
would nole the statement which we have added to the Li-
cense, and indicate their approval of that addendum.
As drafted, the original License indicates that we `
constructed all the structures which encroach, but this
is not the case. As
you will see, the portion of the
"house" (garage) which encroaches constitutes (if I
understand this most recent survey correctly) no more
than a corner, about a foot square, of an overhanging
eave of that structure. I was of course appalled to
discover that this, too, was an "encroachment."
My wife and I bought this property in February 1978,
with no idea of these anterior encroachments, construc-
ted by the previous owner, Mr. Crow. As I explained
to the Commissioners at the hearings last year, the
carport, which we added to the garage in the summer of
1978 was a completely inadvertent encroachment. We
did not have a proper survey which showed buildingst '
and other structures, we "eyeballed" the de facto
cul de sac, and made an unfortunate assumption. But
we would greatly appreciate it if the Commissioners
will accept our addendum, which I believe sets this
record straight. The matter is important to clarify,
my lawyer and I believe, because at some point, other
owners of our property and other County officials
may have to deal with the question again.
I spoke to Milton Sanstrom about this. Would you mind
- showing him this letter and the License, as amended?

It was good to see you yesterday. .
Just to recap our conversation about South Bay Lane:
1. You suggested that your road workers re-grade the
Lane to form shallow ditches on either side. .
2. At the point where our property abuts South Bay Lane
(just before the cul-de-sac at the East end), water
has a tendency to collect at the North edge of the
road, just in front of our garage. If, at this point,
some proper drainage could be arranged (perhaps carried
to the west side of the stone wall on which our garage
is situated, where there is a clear fall onto a grassy
slope headed for the Sound), that would be much apprec-
is ted. ?
- 3. On the boundary of South Bay Lane and our property,
and just in front (south) of
our garage, there is a
piece of wood, about two inches thick, sunk into the
grass. This marks the boundary between the county :
road and our property. When the above improvements
I would appreciate having a small, slightly-
raised (2 inches or so) concrete curb or other border
device placed where this we now is, to separate the
road gravel from our property in an unmistakable way.

really such a minor affair. If the road were to remain a country lane,
with grassy verges and little attention, except occasional gravel and

side) of the Road, some improvement is obviously necessary.

Gentlemen:
I have received your negative response to my request to upgrade the cul-de-sac
that adjoins my property. The reasons given for not accepting my proposal are
not germane to the problem and what I proposed, and are totally unacceptable.
Your statement, for example, that "The County has issued a license to use the
right-of-way to Harold Curtis and James Huntley" is not binding to the County.
Paragraph (5) of the license agreement, which by the way was granted without
a hearing or our knowledge, states clearly that "the license may be terminated
by the County on 90 days notice. Both Mr. Curtis and Mr. Huntley agreed to
this condition, and therefore, should be fully aware of the clause. Consequently,
the County is not bound to any protective agreement guaranteeing continued
encroachment.
Your statement "Because of the present use of the road, we see no need•to re-
voke the license in order to make road improvements" is not valid. First, as
expressed in my proposal, there would be no expense incurred by the County.
Second, a cul-de-sac is a deadend road. The only people using it are the
cul-de-sac property owners, vehicles cruising the area and service/maintenance
equipment. Property owners living on South Bay Lane in between the cul-de-sac
one the County Road (Tale Shores Road) are not going to drive to the cul-de-sac
end of the road every time they arrive and depart their homes. The lots
confronting the cul-de-sac are all occupied. There are no vacant home sites.
Consequently, the cul-de-sac may never experience any significant increase in
traffic above that which presently exists. Therefore, in essence and based on
the County's analysis of greater use, the South Bay Lane cul-de-sac will never
qualify for improvement.
Additionally, your statement that of the present use of the road, we
see no need to revoke the license in orcer to n:ake road improvements" is unfair
and inconsiderate to my rights as a property owner. I have offered to make
improvements to the cul-de-sac at no expense to the County. Since it is not

government administrators. To refuse these benefits for the sole purpose
of protecting the encroachments made by Mr. Curtis and Mr. Huntley are
prejudicial and biased to my cause.

FIRST: TYPE OF SERVICE.
This contract covers mercury vapor street lighting service only.
SECOND: DELIVERY. The Customer agrees for a period of 10 consecutive
years beginning July 8th 1969 to buy exclusively from the Company at the rates ;,r r
herein fixed all electricity required to operate the following mercury vapor
street lighting installation:

Individual lamps will be replaced on burnout, as soon as reasonably possible after .
notification by the Customer and subject to the Company's operating schedules and

more often as deemed necessary according to Company engineering standards.
The location of Company owned street lighting may be changed at Customer request i
and upon payment by the Customer of the costs of removal and reinstallation.

ility, or by the necessity for making repairs or changes in the Company's equipment and
facilities, and the Customer waives and shall not assert any claims against the Company for -

service by the Company under this agreement attributable in any manner to national emergency,
including voluntary cooperation by the Company in any method of operation or in any program
f recommended or requested by civil or military authorities. No temporary interruption shall
cancel this contract. No charge shall be made for service during the period of any interruption,

SEVENTH: The Company shall have the right to cancel this contract if any part of the
Company's property used for the rendition of this service is taken by eminent domain, or if it
