Gillam; Block 6, Lots 3 through 6 RE UEST AND ROAD DESCRIPTION: To vacate that triangularportion of 5th Street descrlbed as fo ows: Beglnning at the Southwest Corner of Block 15, running west a distance of 30 feet, thence southeasterly to a point lying 30 feet south of said Southwest Corner of Block 15, thence north tQ the point of beginning; within Gise's Addition to Port Townsend, Section 16, Township 30 North, Range 1 West, W.M. The principal petitioner, Florence Hos, is requesting to vacate that portion of 5th Street in order to obtain acceptable setbacks for building a home on Lots 1 and 2, Block IS, as per Jefferson County Building Department setback requirements (20 feet from front property line and 3 feet from side and back property lines). At present the subject portion of the road is undeveloped and is covered with grass and few trees. A utility pole (telephone and power) is located in ,the immediate area, although without a survey of the property it is hard to determine if it lies within the subject road vacation area. DEPARTMENT AND AGENCY FINDINGS: 1. Jefferson County Public Works Department: a. The proposed vacation ~i1l not conflict with the orderly expansion of the County road system. b. The proposed vacation will not hinder overall area circulation. c. The proposed vacation will not require compensation by the applicant for past expenditures, pursuant to Jefferson County Ordinance No. 2-76. d. The property was posted August 28, 1979, for notification of a public hearing to be held by the Jefferson County Board of Commissioners September 17, 1979. 2. Cape Geo~ge Fire Protection District #6: (Unavailable for comments.) 3. emergency Medical Services Council: The proposed vacatlon will not hinder the efficient delivery of emergency services to the area in which the proposed vaca- tion is located. 4. Pacific Northwest Bell Telephone Company: (Unavailable for comments~) 5. City of Port Townsend Utilities: Not applicable; there are no water lines in the area. Properties are served by individual wells for water supply. 6. puget Sound Power and Li9ht Company: The proposed vacation may hinder the mainten- ance of existing electric power service lines or poles. Without a survey it is hard to determine if the pole lies within the subject road vacation area. 7. Jefferson County Planning Department: a. The Jefferson County Comprehensive Plan optimum land use map designation for the area the proposed vacation is located, and surrounding area, is industrial. b. The proposed vacation is not desi9nated a trail corridor according to the Jefferson County Park, Recreation and Open Space Plan. c. The public hearin9 for the subject road vacation ~1111'be September 17, 1979, at 10:30 ~;m. in the Commissioners' Chambers, Courthouse, Port Townsend. The applicant shall contact Pacific Northwest Bell Telephone Company and Puget Sound Power and Light Company to determine if the utility pole lies within the subject road vacation area. If so, the applicant shall secure the necessary easements with the telephone and electric companies (ie. for maintenance arid installation) prior to final approval by the Board of Commissioners. Ingman; Tax 71, Section 2 Mary Rutter; south 52 feet of Tax 74, Section 2 Gert McMillen; Tax 65, Section 2 Pat Archer; Lot 3, Norton's 1st Addition to Ironda1e, Section 3 James Gibbons; Tract 121, 7th Avenue Acre Tracts, Section 3 REQUEST AND ROAD DESCRIPTION: To vacate that triangular portion of the Old Chimacum- -Hadlock County Road, No. 18-15.63, lying north and west of the westerly margin of County Road No. 18, adjacent to Tax Lots 86 and 141. The whole distance is about one hundred eighty feet in length and about twenty-seven feet in width at the southerly end of said road, diminishing to a point at the northerly end of said road. The applicant is requesting to vacate said road because it is not being used as a County road. It is presently being used as a service area for the Mobil gas station and a parking area for Bill's Barber Shop at the Hadlock four-way stop. The right-of-way is paved with AC paving except that portion in the southwest corner in front of Bill's Barber Shop, which is gravelled. I I DEPARTMENT AND/OR AGENCY"FINDINGS: 1. Jefferson County Department of Public Works: a. The proposed vacation will not conflict with the orderly expansion of the County road system. b. The proposed vacation will not hinder the overall area circulation. c. The proposed vacation shall require compensation by the applicant for past County expenditures, pursuant to Jefferson County Ordinance No. 2-76. d. The proposal is to vacate to the centerline of County Road No. 18-15.63. As a result, the public will no longer be able to use that portion of the road for access, and it will be necessary for the road to~e barracaded off and a new alignment constructed (across from the Hadlock Apartments). 2. Port Townsend Utilities Department: The proposed vacation will not conflict with the orderly expansion or maintenance of existing or future water systems. Water mains are located under County Road No. 18 (the new Chimacum-Had1ock Road). 3. Puget Sound Power and Light Company: The proposed vacation will not hinder the maintenance of existing or future electric power service lines or poles. A power line pole is located in the northeast corner of Tax 86 (Mobil Station) and lines run overhead along the County right-of-way of County Road No. 18. 4. Pacific Northwest Bell Telephone Company: The proposed vacation will not hinder the maintenance of existing or future telephone lines or poles in the area which the vacation is located. 5. Chimacum Fire Protection District #1: The proposed vacation will not hinder the efficient delivery of fire protection service to the area in which the proposed vacation i~ located. 6. Jefferson County Sheriff's Department: The proposed vacation will not hinder the efficient delivery of the law enforcement protection to the area in which the road is to be vacated. 7. Jefferson County Planning Department. a. The existing Jefferson County Comprehensive Plan land use designation for the proposed area is residential. The draft Jefferson County Comprehensive Plan optimum land use map designation for the proposed vacation and surrounding area is conmercia1. b. The proposed vacation is not a designated trail corridor. according to the Jeffer- son County Park, Recreation, and Open Space Plan. County Road No. 18 is a designated bike route. SUGGESTED CONDITIONS FOR APPROVAL: 1. Prior to final road vacation approval by Jefferson County, the appliCAnt shall con- tact the Jefferson C~unty Department of Public Works to negotiate and pay fees to the County fo~ (a) past County expendfture pursuant to Jefferson County Ordinance No. 2-76, (b) installation of a flex beam guardrail and concrete posts at the end of County Road No. 18-15.63, and (c) construction of a new alignment between County Road No. 18-15.63 and County Road No. 18 (across from the Hadlock Apartments). '. . . .- DO:-U\LD R. SCOTT PETITION FOR VACATION OF A COUNTY ROAD PETITIONERS: All petitioners own property within Sections 34 or 35 of Township 30 North, Range 2 West, W.M. 1. Donald R. Helen Dent REQUEST AND ROAD DESCRIPTION: To vacate the north twenty feet and the south twenty feet of an approximate one mile portion of the Old Gardiner Road, County Road No. 102, in Gardiner. The principal petitioner, Donald R. Scott, is requesting the vacation in order to bring that portion of the right-of-way, which is one hundred feet, to the County standard of sixty feet. As reported by the Public Works Department, the existing road is located within the sixty foot right-of-way. Other than the road and utility poles, the right-of-way is undeveloped (covered with grass and trees). The County acquired the Old Gardiner Road right-of-way when State Highway 101 was constructed. The County will retain the full one hundred foot right-of-way west of the proposed road vacation within Section 34 for the -purpose of future intersection improve- ment. East of the proposed vacation within Section 35 the right-of-way reduces to sixty feet. DEPARTMENT AND AGENCY FINDINGS: 1. Jefferson County Pub11C Works Department: No objection in that the following has been done:or will be done if the request is approved: a. The proposed partial vaction of the Old Gardiner Highway (County Road No. 102 and State Road Log No. 38,000 between mile post 1.41 and 2.45) will reduce the existing one hundred foot right-of-way width to a sixty foot width. This will be accom- plished by the vacation of twenty feet along each side of the existing right-of-way. b. The remaining sixty foot right-of-way is presently all that is needed to maintain the existing two lane asphalt surfaced roadway. State Highway 101 parallels this road, eliminating any need for future widening of County Road No. 102. c. This vacation is not intended to include that part of County -Road No. 102 that extends from the eastern limits of the Gardiner Store property west to, its junction with State Highway 101. This exception being also described as lying west of the Old State Highway Engineer's Station 135+75. being 800 feet in length. d. On December 17, 1979, the prope~ty was posted for notification of a public heating to be held January 13, 1979, by the Jefferson County 80ard of Commissioners. 2. PLANNING COMMISSION ACTION: At their meeting January 2, 19BO, the Commission reviewed the request and department and agnecy findings. The Commission. by formal motion, recommended the Board of Commissioners approve the request subject to the condition that the intersec- tingwidths of any pub1 ic road right-of-way, which intersects that subject vacatpll area of County Road No. 102, not be vacated, such as the intersecting width of County Road No. 104-0.22, the Gardiner Beach Road Loop.
