REQUEST AND ROAD VACATION DESCRIPTION: To vacate the following portions of unopened
County roadsln the vlclnlty of the Oak Bay Road-Indian Island Road intersection, within
Section 12, Township 29 North, Range 1 West, 1~.M: (1) that portion of White Street in
the plat of Kuhnsville that lies between the old right-of-way and new right-of-way of
County Road No.4 (Ness' to Flagler Road); (2) that portion of Myrtle Street and Magnoliu
Avenue that lies between the old right-of-way and new right-of-way of County Road No.4
in Bay View Addition to Hadlock; and (3) that south one-half of Myrtle Street that
borders the north side of Lot 1 of Block 6, Bay View Addition to Hadlock, which extends
to the point of intersection of the north side of the old right-of-way of County Road
No.4.
The Moore's are requesting to vacate the above-referenced portions of unopened
County roads because they have not been used as right-of-ways and do not allow the full
potential use of their property due to separation and/or size.
The property is presently undeveloped with no structures. Trees and grass cover
the subject vacated area. There are no utility poles running along the old County road,
however, th!! City of Port Townsend's water ,line does. Magnolia Avenue, running north
of the old County road, is open and provides access to abutting properties. The old
County road 1s blocked off at the northeast intersection of County Road No.4.
DEPARTMENT AND AGENCY FINDINGS:
1. Jefferson County Department of Public Works:
a. No objection as the port-ions to be vacated are small severed sections that
resul ted from real i gnment of the County road to Indi an Is 1 and. Other roads and
platted right-of-ways provide adequate access to the areas abutting the portions
proposed for vacation.
b. The property was posted in compliance with R.C.H. 36.86 for notification of a
public hearing to be held by the Jefferson County Board of Cornnissioners on Febru-
ary 11, 1980.
2. Chimacum Fire Protection District #1: No objection.
3. Emergency Medical Services Council: No comment received.
4. Pacific Northwest Bell Telephone Cumpany: No comment received.
5. Puget Sound Power and Light Company: No comment received.
6. City of Port Townsend Utilities: No Objection as water lines do not run within the
subject vacated area.
1. Jefferson County Sheriff's Office: No objection.
8. Jefferson County Planning Department:
a. The Jefferson County Comprehensive Plan optimum -land use map designation for the
area the proposed vacation is located, and the surrounding area, is suburban.
b. The proposed road vacation is not a designated trail corridor according to the
Jefferson County Park. Recreation, 2~~~D_~E~~~~. A bike trail route is
designated along the Ness' to Flagler Road and a bike and horse trail exists
along the Oak Bay Road.
c. The public hearing for the subject road vacation will be February 11. 1980, at
11:00 a.m. in the Conmissioner's Chambers, Courthouse. Port Townsend. ^ leu,"
notice will be in the January 30 and February 6, 1980, editions of the Port Town-
send Leader notifying the public of said hearing.
d. Adjacent property owner Chuck Stuart (to the north) is opposed to the subject
peti tion because (1) there is no advantage for him if the vacations were approved,
(2) access to his property (Lots 8 and 9) will be hindp.red by the establishment "I
a half-width right-of-way access, and (3) there is a potential that his taxes wi II
increase as a result of future development of the Moore's property.
e. The vacation of one half of MYrtle Street would be inconsistent with the road
design standards found in Section 6.203.8 of the Jefferson County SubdivisiQD
Ordinance.

PRINCIPAL PETITIONERS INSTRUCTIONS
1. The petition must be accompanied by a bond in the penal sum of one hundred dollars
($100.00) payable in cash, check, or money order to Jefferson County Department of
Public Works for newspaper publication fees, County filing fees, and all other
expenses incurred by the County in the processing of this vacation petition.
2. The petition must also be accompanied by a map ~ X 11 inches showing to a reasonable
scale (a) the highway, road, or alley, or portion thereof, proposed to be vacated;
(b) the property location and names of petitioners; and (c) the nearest constructed
road to the proposed vacation. This information may be found in the County Assessor's
Office and Department of Public Works.
3. The principal'petftioner is requested to ~e present at the meetings of the Jefferson,
County Planning Commission and Jefferson County Board of Commissioners when this
petition for vacation is considered.

REQUEST AND VACATION DESCRIPTION: The following lots and county road and alleybe vacated:
1. "C" Street between the Irondale-Hadlock Road (County Road 18) on the north and vaca-
ted Fourth Street on the south;
2. Lots I, 2, and 3 of Clearview Addition to Irondale;
3. Lot 3 through 8 within Block I, South Port Townsend Addition (less Tax 110 and 78 of
Section 2, Township 29 North, Range 1 West, W.M.); and
4. The alley within Block 1 of South Port Townsend Addition.
The road and alley proposed to be vacated are not constructed. There is an anchor for a
power pole within the southern portion of the alley within Block 1 of South Port Townsend
Addition.
The principal petitioner is requesting the lots to be vacated to consolidate property.
The road and alley are to be vacated to reduce possible vehicular conflicts on the
Irondale-Hadlock Road and to provide additional usable land.
FINDINGS:
1. The proposed road and alley vacations shall be reviewed with criteria established
in the Jej'j'e:r>son County Road Vaaation Or:dinanae.
2. The proposed lot vacations shall be reviewed with criteria established under the
Washington State Plats-Vacation Code, R.C.W. 58.11.
3. The optimum land use map of the Jej'j'e:r>son County Comp:r>ehensive PZan designates the
area of the proposed vacations as suburban. The goal and Policies 12 and 13 of the
"Transportation/Circulation" section of the plan apply to the petition.
4. The proposed vacation is not within a designated trail corridor of the Jej'j'e:r>son
County Par>k, Rea:r>eation, and Open Spaae PZan.
S. A public hearing has been scheduled by the Jefferson County Board of Commissioners
for April 20, 1981 at 10:30 a.m. in their chambers at the County Courthouse, Port
Townsend. Public notice of the hearing was made by publishing legal notices in a
newspaper of county-wide circulation on April 8 and 15, 1981, in addition to posting
the subject site with notices.
6. Notice of the petition to vacate was made to the following departments and agencies:
a. Jefferson County Public Works Department: No objection.
b. Puget Sound Power and Light Company: No objection.
c. Pacific Northwest Bell Telephone Company: No objection provided a utility ease-
ment is retained in the alleyof Block 1, South Port Townsend Addition.
d. Jefferson County Sheriff's Department: No objection.
e. Port Townsend Utility Department: No objection
f. Emergency Medical Services: No comment.
g. Chimacum Fire Protection District 1: No comment.
7. Notice of the petition to vacate was made to all abutting property owners of the
proposed vacations. No comments were received.
SUGGESTED CONDITIONS FOR APPROVAL:
1. The Jefferson County Board of Commissioners should investigate possible compensation
for the value of the proposed vacated portion of road and the alley.
2. Jefferson County shall retain appropriate utility easements prior to final 'approval
of the al~ey vacation.
PLANNING COMMISSION ACTION: At their meeting April 8, 1981, the commission reviewed the
petition request and findings. As a result of their review, the commission, by formal
motion, recommended to the Board of Commissioners to not take action on the petition until
the Planning Commission had the opportunity to review a specific statement from the
Jefferson County Public Works Department on thc Possible affects the vacation of "e"
Street might have on future circulation and until it is known whether the owner of Lots 3
through 8. Block I, South Port Townsend Addition. agrees with the vacation of these lots
and adjoining alley.
ADDITIONAL FINDINGS:
8. The owner of Lots 3 through 8, Block 1. South Port Townsend Addition. is listed as
Alex B, Harper in the Jefferson County Assessor's Office. Mr, Harper is deceased
and the property is now owned by his wife, Elma Harper. Mrs. Harper signcd the

REQUEST AND VACATION DESCRIPTION: The following county roads and alleys and lots and
blocks within the plat of Junction City be vacated:
1. Enterprise Avenue between 7th Street and 5th Street;
2. 6th Street between Blocks 23 and 34 and between Lot 1, Block 33, and Lot 6, Block
24;
3. 5th Street between the north plat boundary and that vacated portion between Block
24 and the plat of Discovery Bay Village;
4. The alleys within Blocks 23, 24, and 34;
5. Lots 1 through 12, Block 23;
6. Lots 1 through 12, Block 24;
7. Lots 1 through 5, Block 33; and
8 Lots 1 through 12, Block 34.
'The area of the proposed vacations is undeveloped with typical second growth
vegetation. The nearest constructed roads are within the plat of Discovery Bay Village.
The roads within the plat of Junction City do not follow the uneven and steep terrain of
the area.
The principal petitioners are requesting the vacations to develop the area as
residential sites. The plat of Junction City divided the area into small lots and roads
without regard to the terrain. Future divisions of the al'ea, if the vacation request
,,~J granted, would be designed with respect to natural features.
FIND INGS:
1. The proposed road and al:ley vacations shall be reviewed with criteria established in

2. The proposed lot and block vacations shall be reviewed with criteria established under

a. Mrs, S.C. Brown is concerned the road vacations may restrict possible access to
her property.
b. Charles D. Broders stated: "As an owner of adjoining timberl ands, as well as a
taxpayer in Jefferson County, I wonder. quoting one of our illustrious county
commissioners, 'What is the county getting out of it?', referring to the timber
that is or recently was on the streets and alleys."

PLANNING COMMISSION ACTION: At their meeting April 8, 1981, the commission reViewed the
petition request, findings, and testimony from Artherur E. Freeman. Mr. Freman stated
the purpose of the proposed vacations is to create an acreage parcel to be later sub-
divided with respect to the steep and uneven terrain. The commission, by formal motion,
recommended the board approve the request with the condition for approval.
