\'l1IEREAS, an Application for non-exclusive Franchise has been
submitted by Port Townsend Cable TV Ltd., a true copy of which is
attached hereto, for the purposes set out in the said Application, and
WHEREAS, hearing on the said Application was held before the
Board of County Commissioners of Jefferson County, Washington, on
June 22, 1981, at the hour of 10:30 a.m., pursuant to the provisions
of RCli 36.55, after notice given as required by law, and
WHEREAS, it appears to be in the public interest to grant the
said non-exclusive franchise request, NOW, THEREFORE,
IT IS HEREBY RESOLVED that a non-exclusive franchise be and l.t
is hereby granted to the applicant namet:! above (GRANTEE) for a period
of twenty-five (25) years from the date of this Resolution, to install,
operate, maintain, repair and use a cable television system in, under,
along and across that portion of county road rights-of-way described
as follows:
All that portion of Jefferson County lying
East of the Olympic National Park.
This non-exclusive franchise is granted upon the following express
terms and conditions:
(1) The said GRANTEE, its successors and assigns, shall have
the right to enter only upon the above-described rights-of-way for
the purpose of constructing its facilities and for operating, main-
taining, repairing and using those facilities.
(2) The terms and conditions of Jefferson County Ordinance No.
2-81, an ordinance prescribing terms and conditions for franchise
agreements granted by Jefferson County, are incorporated herein by
reference and made a part of this Resolution for all purposes as
fully as if set forth in this Resolution. The GRANTEE, fo~ itself,
its successors and/or assigns, expressly agrees that it will strictly
comply with the requirements of t~e said ordinance and any amendments
thereto. GRANTEE understands and acknowledges that the ordinance
requires it to obtain a permit from the County Engineer/Director of
public Works before doing work under this non-exclusive franchise
and !)erforming other actions relating to the franchised matter.
(3) The GRANTEE shall submit a facility plan to the County
Planning Department for review of all new proposed facilities exclu-
9tve of service connections and appurtenances. Construction permits
will be granted upon the determination that the facility plan complies
with the county comprehensive plan.
(4) The GRANTEE shall commence construction work under this

Section 3. Restoration. After a permittee has completed the work on
the utility line, such permittee shall restore the right-of-way to as good a con-
dition as before the work commenced. After the restoration has been completed
the permittee shall notify the Departmont of such and the Departm~nt shall then
inspect the restoration work. If additional work is necessary to complete the
restoration, the permittee shall be notified of such and shall forthwith complete
the additional work. At the completion of the additional work the permittee shall
again notify the Department in order thilt an inspection may be made. Permittee
shall pay Department twenty-five dollars ($25.00) for every inspection beyond the
first one.
Section 4. Surety Bonds. A permittee shall post a surety bond through
a company licensed in Washington to issue such bonds in favor of Department con~
ditioned upon the satisfactory restoration of the right-of-way in the following
amounts in the following situations:
(a) For a longitudinal utility line installation in excess of one
hundred (100) linear feet but less than two hundred (200) linear feet one
thousand dollars ($1,000.00),
(b) For a longitudinal utility line in excess of two hundred (200)
linear feet -- five hundred dollars ($500,00) per one hundred (100) linear feet.
If a utility has an ongoing progrnm of installing, maintaining and
repairing a system of conduits to serve an area within the boundaries of Kitsap
County, the. Director or his designee may allow the utility to submit a blanke~
bond in an amount sufficient (minimum $5,000.00) to cover an average size project.
If the utility submits a project that exceeds the blanket bond amount, the Director
may require additiomll bonding.
Section 5. Cash bond. In lieu of the surety bond described in Section
4, permittee ffi<,y post a cash bond in the form of a cashier's check payable to
Department in a like amount as the surety band required by Section 4. The cash
bond shall be returned to per.mittee if the restoration work in the right-of-way
is HD.tisfactorily completed. If it is not satisfactorily completed, Department
shall use the bond to complete restoration.
Section 6. Disposi~of foes. The fees described in Sections 2 and
J shall be deposited into the county rOMI fllnd.
Section 7. .~'..~.!..v_~.E_~bonding r.c:q~c~~. 'l'he bonding requirements
described in Section II and 5 may, in tl,u cliscrction of the director of Depnrtment,
be waived if the utility line is not installed in an improved right-of-way.
Section 8. Penalty, Any pornon, firm, or corporation violating any of
the provisions of this ordinance is guilty of a misdemeanor, and each such person,
firm or corporation is gull ty of a separate offcnoo for each and every day or por-
tion thereof during which any violation in committed, continued or permitted, and

placing the utility, particularly abo;"e ground installations,
as near to the right of way line as practical.
(2) Utility line crossings of the road shall be normal to the road
centerline to the extent feasible and practical. Crossings should
be made on a true line and grade.
(3) The vertical location of underground utility lines shall be in
accordance with the currently applicable design standards for
utilities. The vertical clearance of overhead facilities shall
be consistent with the clearance as provided in WAC 136-40-404.
WAC 136-40-048 ROAD PURPOSE UTILITIES. Utility
installations that are needed for a road purpose, such as for continuous
lighting or traffic signals are to be located and designated in accordance
with the requirements of this policy including sections -416 and -512.
WAC 136-40-052 ACCOMMODATION WHERE PRIOR RIGHT.
Where the utility facilities are to be adjusted to accommodate road con-
struction and the utility has a prior property right in its location, the county
and the utility may enter into a common use agreement providing for joint
occupancy of right of way consistent with the requirements of each party.
WAC 136-40-100 DESIGN OF FACILITIES RESPONSIBILITY. The
utility company shall be responsible for thedesign of the utility facility.
The county engineer shall review the utility's plans with respect to location
and the manner in which the utility facility is to be installed and measures
to be taken to preserve safe and free flow of traffic, structural integrity
of the roadway structure, ease of the road maintenance, appearance of the
road and the integrity of the utility facility.
WAC 136-40-104 PLANNING, On new installations or adjustment
of existing utility lines, provision should be made for known or planned
expansion of the utility facilities. particularly those located underground
or attached to bridges. They should be planned so as to minimize hazards
and interference with traffic when additional overhead or undergl'ound lines
are installed at Bome future date.

Board of County Commissioners of Jefferson County, Washington on
December 5, 1982 at the hOL:r of 11: 00 ?. m., pursuant to the provisi_ons
of RCW 35.55, after notice given as required by law; and
WHEREAS, it appears to be in ,the public interest to grant
the said non-exclusive franchise request; now, therefore,
IT IS HEREBY RESOLVED that a non-exclusive franchise be and
itis hereby granted to the applicant named above (GRANTEE) for a per-
ied of twenty-five (25) years from the date of this Resolution, to
construct, o?erate and maintain a community water systelR upon, under,
over, across and along that portion of County road rights-of-',my
qescribed as follows: "
all roads dedicated in Bridgehaven Divisions 3, 5, 6 and
8 as recorded in Vol. 4, Pages 67-68, Vol. 5, Pages 3-4,
Vol. 5, Pages 7-8, Vol. 5, Pages 53-54, respectively, of
Plats, Records of Jefferson County, and all other County
roads lying within the south ~ of Section 9, Township 27N,
Range IE, IL!.l.
This nO~l-exclusive franchise is granted upon the following express
terms" and conditions:
(II The said GRANTEE, its successors Bnd assigns, shall have
the right to enter only upon che above-described rights-of-way for
the p~rpose of constructing its facilities and for operating, I~ain-
taining; repairing and using those facilities.
, (2) The terms and conditions of Jefferson Ceunty Ordinance No.
2-81, an ordinance prescribing terms and conditions for f.ranc~ise
agreements granted by Jefferson County, are incorporRte~ herein by
reference and made a part of this Resolution for all purposes as fully
as if set forth in this Resolution.' The GRANTEE, for itself, its
successors and/or assiens, expressly agrees that it will strictly com-
ply \~i th the requi17el\lents of the said ordinance and any Di,lendlllents
thereto. ~RA~TEE understcnds and acknowledges that the ordinance re-
quires it to cbtain a permit ft"om the County Engineer./Director of
Public ,)or:ts before doing \~O'Lk under thl.s non-exclus1.ve f'canchise and

purposes set out in the said Application, and
WHEREAS., hearing on the said Application was held before the
Board of County Commissioners of Jefferson County, Washington, on
July 13, 1981 at the hour of 10:30 a.m., pursuant to the provisions of
RCW 36.55, after notice given as required by law, and
WHEREAS, it appears to be in the public interest to grant the
said non-exclusive franchise request, NOW, THEREFORE,
IT IS HEREBY RESOLVED that a non-exclusive franchise be and it
is hereby granted to the applicant named above (GRANTEE) for a period
of twenty-five (25) years from the date of this Resolution, to install,
operate, maintain, repair and use pipes, manholes, valves, and other
appurtances in, under, along and across that portion of County rights-

Village; and The streets of Enterprise Avenue,

This non-exclusive franchise is granted upon the following express

the right to enter only upon the above-described rights-of-~ay for

(2) The terms and conditions of Jefferson County Ordinance

County Commissioners of Jefferson County, Washington, on October 10, 1983,
at the hour of 10:30a.m., pursuant to the provisions of RCW 36.55, after
notice given as required by law; and

IT IS HEREBY RESOLVED, that a Non-Exclusive Franchise be and it is
hereby granted to the applicant named above (GRANTEE) for a period of
twenty-five (25) years from the date of this Resolution, to install, operate
maintain, repair and use a Water Discharge Underground Pipeline, in, under,
upon, along and across that portion of county road rights-of-way described
as follows:
The Quilcene Fish Hatchery Road in the
Southeast Quarter of Section 22, Township
27 North, Range 2 West, W.M.
NOh-Exclusive Franchise is granted upon the following express terms'
and conditions:
(1) The said GRANTEE, its successors and assigns, shall have the
right to enter only Upon the above-described rights-of-way for the purpose
of constructing its facilities and for operating, maintaining, repairing
and Using those facilities.
(2) The terms and conditions of Jefferson County Ordinance No. 2-81,
an Ordinance prescribing terms and conditions for franchise agreements
granted by Jefferson County, are incorporated herein by reference and made
a part of this Resolution for all purposes as fully as if set forth in this
Resolution. The GRANTEE, for itself, its successors and/or assigns, ex-
pressly agrees that it will strictly comply with the requirements of the
said Ordinance and any amendments thereto. GRANTEE understands and acknow-
ledges that the Ordinance requires it to obtain a permit from the County
Engineer/Director of PUblic Works before doing work under this Franchise
and performing other actions relating to the Franchised matter.
(3) The GRANTEE shall submit a facility plan to the County Planning
Department for review of all .ne~ propOsed facilities ex61ujive of'ser~ice
Connections and appurtenances. Construction permits will be granted upon
the determination that the faCility plan complies with the County Compre-
hensive Plan.

INSTRUCTIONS
1. This form is authorized {or use whenever a bid the HmitAtions set forth therein. Where more than a
guaranty is required in connection with construction sinale corporate surety is involved. their names and ad.

Affidavit of Individual Surety (Stllndard form 28), for
elch individual surety, shall accompany the bond. Such
surenes may be required to furnish additional substanti_
ating informarion concerning their assers and financial
capability as the Government may require.
3. The penal sum of the bond may be expressed as a
percentage of the bid price if desired. In such cases, .
maximum dollar limitation may be stipulated (e.g., 20%
of the bid price but the amount not to exceed_
dollars).
5. Corporations executing the bond shall affix their
corporate seals. Individuals .hall execute che bond op_
posite the word "Seal"; and, if executed in Maine or New
Hampshire, shall aha affix an adhesive seal.
