These interim siting standards arc to be used until superseded by final siting regu- latlons adopted pursu_ant to HCW IU,IU5.:'~U throu!\h 70.105.<70. .~b) Applicability, The interi.m siting stand.1rds described in this subsection. appl',- to owners nnd opera torR l."lf any preempted facilities for which, after July 28, 1985, per.mit applications wer(' submitted to the department in accordance wir~..:.., or permits WCI"e:: issued by the department pursuant to, WAC 173-303-805 or 173-303-806. (c) . Implementation. Ch..mers/operators of preempted facilities to which the interim siting stanuards of chip> subsection apply must include in (or amend the existing) TSD fne! lit)' apn,:lic.ation, submitted pursuant to WAC 173-303-805 or 173-303-806. informnti0n that nemon$trates consideration of ~ compliance \,Jith the interim ::;lting stanclarus of t'his subsection. (d) Definitiuns. Anv terms used in this suhsectionthat ar~ not dcfinud below shall h~ve the mewnings provided in WAC 173-303-040. For the purposes of this ~ubsection, tl1c following ~ermR 51',1.11 have the described meanings: -~IlPreempted facility" menns any facility that includes as a signif- icant part of it~ activities th~ folJ.olV'ing operations: (a) Landfill, (b) jncineration. (c) land treatment, (d) surface impoundment to ,be closed as a landfill, or (c) wastE' pile to be closed asa landfill. (ii) "Perennial surface water body" means any lake, river, pond, canal, stream, reservoir, inland water, saltwater and other surface waters under the jurisdfction of the state of Hushington that normally has contin- uous flow.throughout the year. This does not include man-made lagoons, or ': 'iJr~pounclm'en't::$ associated with a facility. ~, "c,",.~.l(i:1:'iV uArea of influence" means the ar<!C1 surface and subsu:r:face area ~urrounding awell(s) within the potentiomFtric surface has been changed due 'to' 'ground wa ter t.;ithdrawal. (iv) .'Residences" means nIl~' dweJ.ling, including private homes, rental ;h6in'e:s'~:,.h('lar'd.ri.nR houses t Rpartment~, motels an.d hotels. ~:::;L:~:Hrv))..i;"'Institutiontl means any public: or t:'rivate establishment hav.i.ng c:. social, educational, or religious purpose, including SCllools, colleges, universities, hospitals, health care facilities, churches, and refor matories. '-----w-Structural St'ability. (i) Proximity to Holocene Earthauak~ Fnult. All provisions of sub- section (3) of this section shall apply. (Ii) Subsidence. Consideration shall be given to any sinking of the land surface within the faCility boundaries due to the removal of solid mineral matter or fluids from the subsllrface. Uii) Unstable Slopes. CC'nsideration shall ;,C given to any steeply slopinR arens wittdn facil i ty boundaries where the rapid mass lRovemen t of eartll mnterinls is likely to occur. (iv) Sol1s Stabtlity. Consideration sh"U be given to any weak or unstable soils within the facility boundaries. Weak or unstable soils or conditions include, but are not limited to, or~dnic soils, expansive salls, ~ds ~ect to liquefac tion durinA seismic events, soft clays, sensitive clc1Ys, loess and quick conditions. (v) Tsunami/Storm Sur~c. Consideration shall be gjven to shtlreline cHcnsbordering the: Pacific Ocean and the Straits of Juan De Fuca that may flood because of tsunamis or storm sur~cs. (f) Surface Water Quality Protection. (i) 100-Year Floodplain. All requirements 'of subsection (4) of this section shall apply. (i:) Pl'oximity to Surface Water. ~o preempted facility, Rh"n b~ located within 500 feet of a perenninl surface water body. No preemted fnd,li ti e~ shall be located within: (A) 500 feet. measured horizontally from the nearest portion of the facility. of a surface or ground water :lntake for public or private drink ing water jf the facility js located upgrndtt"lnt from such on intake; or, (B) 250 feet, measured hori?ontallv from the nf:arest point of the facility boundary, of a surface or Around ~....ater intake for public or priva,te drinking water if the facility is located downgradient or cross-gradient from such an intake. (iv) Wellhead Protecti(Jn Areas. No prl!empted facility shall be located within the 81.'en of influence surrounding a water well or wellfleld that i~ supplying potable wat~r to a domestic water supply system for use outside the facility boundaries. (i) Sen~~':i:ive Area Protection.. Preempted f<..'l,cilities shall be subject to the fol1owin~ Ioeational standardR for sensitive areas: (i) Threatened and Endangered Species. No preempted facility shall locate in an area that would result in the taking of individuals of a sp~cies, or the direct elimination of habitat of species that are on the federal list of thr~atened or endangered species; (ii) Shorelines and Wetlands. All provisions of subsection (5) shall ~ (iii) Wjlderness Areas. No preempted facility sha] 1 locate in a Wilderness Area as so designated under the Wilderness Protection Act; (iv) State and Federal WIldlife Refuges. No pre~mpted facilitv shall locate in a State or Federal refuge as so desiRnated unde~ state and federal laws anc.l regulations; (v) Parks, Scenic and N.ecredtiona:1 A.!:.~as.. No preempted facility 5h;11] be locntcd in a city, county, state, or federally designated park, scenic nrea, or recrc~tional area; and, (vi) Archeological and Historical Areas, Nati.onal Monuments. Reratin~ of Projects In FY 87 the rating system itself has been changed. In FY 88 proj ects will he rated under the new Priority Rating System. In subsequent years, project ratings are reevaluated each year. Most projects receive a !tno changett rating, but a few require rerating because of changes in receiving water quality, health considerations, or a change in the rating parameters. Cost estimates on the rating sheets are updated by Ecology staff with each rerating. More frequent updates are encouraged. Removal of Projects Projects which have been rated will be removed from the project priority list when the proposed project: 1. has a signed grant to build the project using Washington State Referendum 26 or 39 monies, or monies provided under the state Centennial Clean Water Fund CRCW 70.145), or 2. has completed the project hy other means, or 3. is determined to be ineligible for federal funding, or 4. has achieved compliance with secondary treatment. Failed Innovative and Alternative Projects Projects deemed "Failed I/A" by EPA with concurrence from Ecology will he administratively advanced to the top of the project priority list for a 100 percent modification/replacement grant. DesiRn Criteria ChanRen If, due to changes in design criteria, a project is unable to receive a positive ce~tification, then a grant may be offered to the community to perform modifications in order to receive a positive certification and meet NPDES permit compliance.
