She i ~~ testified to the following: The applicant inherited the property. ~-~ She wants to do something with it. In attempting to find out what she could do with it, she contacted a septic system installer. He concluded that at least a portion of the drainfield would have to be situated within the right-of-way. Consequently the applicant is seeking the vacation to accommodate the drainfield. ~"`. She does not believe that the right-of-way is needed for access ~~ purposes. She owns property on the north aide of East Price Street ~ . i just east of the applicant's. She gets access to her property by `` way of James Street, which intersects with Price Street one-half '~ block east of the applicant's property. i ~~ William Marlowe, area resident, testified in opposition to the ! ~ request. He testified to the following: He is concerned about the ~'~ possible effect a septic system could have on the area. Most of the property is wet. It is a wetland by all definitions. A copy of this section is attached to this recommendation, ;~~ identified as Exhibit A, and, by this reference, incorporated i~ ' herein. The Hearing Examiner has reviewed the proposed vacation f and the evidence of record with regard to their criteria and makes ~" the following findings and conclusions: ;,; ~ 1. The proposed vacation does not comply with the Jefferson County Comprehensive Plan and other applicable plans, ~ policies, and ordinances. , 1 The property is situated in the area covered by the Tri-Area Community Plan. Motorized Transportation and Circulation Policy 3 states: Transportation and circulation routes, including rights- ' f of-way should not be vacated or abandoned (a) where - existing or future land development indicates their usefulness, (b) where the effectiveness of fire, medical, i. ° or other emergency services may be impaired, (c) where ' such routes can effectively be used for utility corridors as trails or pathways, or (d) where a county road abuts `,`. a body of fresh or salt water, unless such a vacation is for public purposes as specified in RCW 86.37. ~~+; ~ % As is discussed below, at least 40 feet of the right-of-way may be f i needed to serve future development. Therefore, vacating it as proposed would be inconsistent with this policy. '~ There are several parcels of land in addition to the applicant's that abut East Price Street between Third Avenue on the west and ~: ~ ' James Street on the east. East Price Street provides the only ~ ; access to these lots. That is true whether the lots are approached ~~ sas j from the west or from the east. This fact suggests that East Price . Street is needed for access to these lots. If the vacation were e~" granted as requested, it would not be possible to improve Eaet Price Street to minimum county standards. For this reason, and in light of the fact that the applicant may not be able to develop the property at all if she is not able to obtain any of the land within the right-of-way, the Hearing 1 _ Examiner recommends that the applicant be allowed to resubmit a ~ ?9 Vacation Application to vacate between 10 and 20 feet rather than ,~~~r. the proposed 30 feet. If the applicant reapplies for a vacation ~;.> ` i and seeks to vacate more than 10 feet, the Hearing Examiner _ recommends that the applicant be required to demonstrate to the p,: satisfaction of the Public Works Department that road improvements ~-• may be placed off-center within the right-of-way without adversely . affecting the safe and efficient movement of vehicles on the street t, ~. or other property abutting the street. 3. The effectiveness of fire, medical, law enforcement, or other emergency services will not be impaired. The Hearing Examiner hoe reviewed the proposed vacation and the evidence of record with regard to this requirement and makes the following findings and conclusions: The Jefferson County Accessors's Office has stated that the set value of the Vacation Request is $3,600. County policy requires ~ payment of one-half of that amount. The street is located in the community of Irondale, approximately 5 miles Southeast of the city limits of Port Townsend. 2. The road is in use, and has been so far an unknown period of time, although currently the area in question is not used for vehicular traffic. At present the road condition consists of a portion of unopened right of way and a narrow soil path approximately 8 feetin width. ~ 3. It is advisable to preserve this road for future use. It provides practical access to " Lots 13-24 in Block 41 and Lots 1-5 in Block 33. Should Price Street be ~ constructed to County road standards, a right of way of more than 30 feet would be required. Approval of this vacation would reduce the right of way to an +' unacceptable width. f ~ 4. The County Engineer advises that he recommends denial of this request.
