HomeMy WebLinkAbout054 09 c. cud') ') l\{eQ'~ .5 Cl/LCI!cCj ST ATE OF WASHINGTON Jefferson County In the Matter of: Establishing an inventory } of property suitable for the purpose of } expanding Jefferson County's affordable } housing stock in partnership with public } and/or private entities with expertise in } designing, funding, developing and } managing affordable housing. } RESOLUTION NO. 54-09 WHEREAS, The Board of County Commissioners for Jefferson County, hereinafter referred to as the "Board," found the lack of affordable housing for very low-income, low- income, or moderate-income households and special needs populations is intensified by the rising cost of land and construction; and WHEREAS, there are publicly owned land and buildings which may be suitable to be marketed, sold, leased, or exchanged for the development of affordable housing; and WHEREAS, the County's adopted Comprehensive Plan encourages the development of housing for people with special needs (Housing Element goal HSG 4.0); and WHEREAS, Policy HSP 4.7 states: Consider vacant public lands to accommodate low income housing opportunities throughout the county; and, WHEREAS, RCW 43.63A.5l0 defines "Affordable housing" as: residential housing that is rented or owned by a person who qualifies as a very low-income, low-income, or moderate-income household or who is from a special needs population, and whose monthly housing costs, including utilities other than telephone, do not exceed thirty percent of the household's monthly income; and WHEREAS, the County has adopted a Housing Action Plan (2006) that includes over 40 strategies to address the growing need for affordable housing stock including Action 36 which states in part: "inventory and evaluate supply of public and private buildable lands - able to be developed for a variety of mixed income innovative residential projects throughout the urban centers of the city and county"; and WHEREAS, the County has worked cooperatively with the Port Townsend City Council to identify available lands within the city limits; RESOLUTION NO. 54-09 WHEREAS, the County has conducted preliminary analysis of lands which may be suitable for affordable housing based upon the following criteria: I) Located within an urban area; 2) Able to be developed for a variety of mixed income innovative residential projects (e.g., an acre or more in size, no designated use) 3) No identified environmental hazards - e.g., majority of site is clear of critical areas 4 ) Available infrastructure 5) Appropriate zoning; and WHEREAS, developing affordable housing requires specific expertise, NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Jefferson County, Washington, that: Jefferson County establishes an "Inventory of Property Suitable for Affordable Housing" to include the two county-owned properties generally referred to as "QFC Complex Area" and "Adjacent to Laurel Grove Cemetery" (as further described in Attachment A). The Board qualifies the availability of the "QFC Complex Area" to note that the parcel is currently required for its purposes, however it may be available for affordable housing use given a proposed concept includes provisions for county office needs or given Jefferson County obtains alternate facilities to accommodate existing needs. The Board limits the availability of the property "Adjacent to Laurel Grove Cemetery" to the northern two-thirds, excepting the south one-third of the property containing the historical County Cemetery per the survey map of December 18991. Furthermore, the Board hereby directs staff to pursue a grant to retain a qualified consultant and/or distribute the "inventory" to housing providers inviting them to partner with the City/County and proceed with appropriate due diligence assessments, design, acquisition of funds, and development of affordable units for rent, lease or sale. A mixed- income development compatible with the surrounding neighborhood is desired. Mechanisms shall be in place to ensure that the affordable units remain affordable for a minimum of 40-years. Final disposition of any subject properties shall be subject to prior approval by the Board as to future use. This shall not be construed to imply pre-judgment on any subsequent land use or environmental approval process. Finally, the County shall periodically purge the inventory of real property of sites that are no longer available for the development of affordable housing. The inventory revision shall include an updated listing of real property that has become available since the last update. As used herein, "real property" means buildings, land or buildings and land. The Housing Action Plan, developed in conjunction with the City of Port Townsend and Jefferson County, involving diverse groups of stakeholders, adopted by the City of Port Townsend and Jefferson County in 2006 identifies 42 major action plan strategies determined to be important in effectively implementing the housing action plan in Port Townsend and Jefferson County. Additionally, the Jefferson County Comprehensive Plan and City of Port Townsend Comprehensive Plan identify goals and policies addressing affordable housing. Jefferson Countv Comnrehensive Plan: Goal: HSG 4.0: Encourage the development of housing for people with special needs. Policy: HSP 4.7 Consider vacant public lands to accommodate low income housing opportunities throughout the county. Citv of Port Townsend Comnrehensive Plan: Housing Affordability: Goal 2: Promote affordable housing throughout all geographic and economic segments of the community. Policy 2.4: Develop and maintain and inventory of surplus public lands that may be suitable to nonprofit housing providers for affordable housing. Additional to comprehensive plan goals and policies and Housing Action Plan strategies: RCW 36.34,137 makes the following provisions: (I) Every county shall identify and catalog real property owned by the county that is no longer required for its purposes and is suitable for the development of affordable housing for very low- income, 10wOincome, and moderate-income households as defined in RCW 43.63A.5l0. The inventory shall include the location, approximate size, and current zoning classification 'of the property. Every county Shall provide a copy of the inventory to the -department of community development by November I, 1993, with inventory revisions each November I thereafter. (2) By November I of each year, beginning in 1994, every county shall purge the inventory of real property of sites that are no longer available for the development of affordable housing. The inventory revision shall include an updated listing of real property that has become available since the last update. As used in this section, "real property" means buildings, land or buildings and land. And RCW 36.34.135 makes the following provisions: If a county owns property that is located anywhere within the county, including within the limits of city or town, and that is suitable for affordable housing, the legislative authority of the county may, by negotiation, lease the property for affordable housing for a term not to exceed seventy-five years to any public housing authority or nonprofit organization that has demonstrated its ability to construct or operate housing for very low-income, low-income, or moderate-income households as defined in RCW 43.63A5l0 and special needs populations. Leases for housing for very low-income, low-income, or moderate-income households and special needs populations shall not be subject to any requirement of periodic rental adjustments, as provided in RCW 36.34.180, but Shall provide for such fixed annual rents as appear reasonable considering the public, social, and health benefits to be derived by providing an adequate supply of safe and sanitary housing for very low-Oincome, low-income, or moderate-income households and special needs populations. RCW 43.63A.510 makes the following provisions: (1) The department shall work with the departments of natural resources, transportation, social and health services, corrections, and general administration to identify and catalog under-utilized, state-owned land and property suitable for the development of affordable housing for very low-income, low-income or moderate-income households. The departments of natural resources, transportation, social and health services, corrections, and general administration shall provide an inventory of real property that is owned or administered by each agency and is available for lease or sale. The inventories shall be provided to the department by November 1, 1993, with inventory revisions provided each November I thereafter. (2) Upon written request, the department shall provide a copy of the inventory of state-owned and publicly owned lands and buildings to parties interested in developing the sites for affordable housing. (3) As used in this section: (a) "Affordable housing" means residential housing that is rented or owned by a person who qualifies 2 Agenda Request 10:30 am as a very low-income, low-income, or moderate-income household or who is from a special needs population, and whose monthly housing costs, including utilities other than telephone, do not exceed thirty percent of the household's monthly income. (b) "Very low-income household" means a single person, family, or unrelated persons living together whose income is at or below fifty percent of the median income, adjusted for household size, for the county where the affordable housing is located. (c) "Low-income household" means a single person, family, or unrelated persons living together whose income is more than fifty percent but is at or below eighty percent of the median income where the affordable housing is located. (d) "Moderate-income household" means a single person, family, or unrelated persons living together whose income is more than eighty percent but is at or below one hundred fifteen percent of the median income where the affordable housing is located. NOTES: Finding -- 1993 c 461: "(I) The legislature finds that: (a) The lack of affordable housing for very low-income, low-income, or moderate-income households and special needs populations is intensified by the rising cost of land and construction; and (b) There are publicly owned land and buildings which may be suitable to be marketed, sold, leased, or exchanged for the development of affordable housing. (2) The legislature declares that the purpose of this act is to: (a) Provide for an analysis of the inventory of state-owned lands and buildings prepared by the departments of natural resources, transportation, corrections, and general administration; (b) Identify other publicly owned land and buildings that may be suitable for the development of affordable housing for very-low income, low-income, or moderate-income households and special needs populations; (c) Provide a central location of inventories of state and publicly owned land and buildings that may be suitable to be marketed, sold, leased, or exchanged for the development of affordable housing; and (d) Encourage an effective use of publicly owned surplus and underutilized land and buildings suitable for the development of affordable housing for very low-income, low-income, or moderate-income households and special needs populations." [1993 c 461 9 1.] BACKGROUND: At the January 12,2009 Joint Meeting, Mayor Sandoval stated she would like to see the City and County work together to look at the land currently owned by the entities which would be appropriate to set aside for affordable housing. Additionally, the possibility of then turning the properties over to an organization or holding for potential long term leases was discussed. It was agreed to have an action item regarding land inventory at the next joint meeting. 3 Agenda Request 10:30 am Commissioners and Council members acknowledged that most ofthe land held in city/county ownership has a designated use or critical areas issue. Furthermore, housing should be located in areas with adequate infrastructure and within close proximity to services. At the March 5, 2009 joint meeting, the City and County's initial lists were presented as follows: The criteria used in development of the preliminary City list stems from Action 5.9 of the Housing Action Plan: I) Urban areas 2) Able to be developed for a variety of mixed income innovative residential projects (e.g., an acre or more in size, no designated use) 3) Environmental hazards - e.g., majority of site is clear of critical areas 4) Infrastructure requirements 5) Zoning County staff prepared an exhaustive list of all properties owned within the City of Port Townsend. The list of County owned properties has subsequently been further narrowed to remove properties containing existing park and recreational uses, the Courthouse, and properties unsuitable for residential development due to critical areas and zoning. A combined list of City and County properties owned within the City of Port Townsend has been prepared for presentation to the City Council and County Commissioners at the June 25, 2009 joint City/County workshop session. The properties were discussed, and the Jackson Street property owned by the County was removed from the inventory. The inventory, including 7 properties owned by Jefferson County or the City of Port Townsend is attached. Additional possible future next steps identified in the adopted Housing Action Plan include: Complete appropriate due diligence assessments - of the properties for environmental hazards and mitigation, infrastructure requirements, public facility priming needs, suitable zoning, and development code specifications and opportunities. Package key prototype project lands - for lease or sale from public or private parties for the purpose of developing mixed income demonstration projects using land lease, community land trusts, and other innovative ownership. ANAL YSIS/STRA TEGIC GOALSIPROS and CONS: The analysis and pros and cons are found in the attached matrix of City and County owned properties. FISCAL IMP ACT/COST-BENEFIT ANALYSIS: Additional analysis is recommended which would require one, or a combination of, ofthe following: additional staff time, consultants, or partnerships with housing providers. See recommendations, below. There is no fiscal impact associated with identifying a possible affordable housing land bank RECOMMENDATIONS: As directed by the Board on September 21,2009, staff prepared a draft resolution formalizing adoption of the affordable housing land bank and direction to staff to distribute the "affordable lands inventory" to housing providers and inviting them to partner with the City/County. Staff has further suggested language in the draft ordinance to address concerns of the Board and to assure consistency with the resolution 4 Agenda Request 10:30 am adopted by Port Townsend City Council on September 21, 2009. Staffrecommends the Board review and adopt the attached resolution. There is no guarantee that any of the properties will develop to underlying densities, nor that they will be economically viable; however, creating the affordable lands inventory is a promising first step.
