FINDINGS AND CONDITIONS OF APPROVAL AS REQUIRED UNDER THE
JEFFERSON COUNTY INTERIM CRITICAL AREAS ORDINANCE

In accordance with the authordy provided under subsection 4.101 and the requirement contained in Subsection
5.402 of the Jefferson County Interim Critical Areas Ordinance, tee following are findings of fact relating to the
referenced application:
1.) The application was reviewed by Jefferson County Permit Center staff on 1/24100 for the potential presence
of critical areas regulated under the provisions of the Ordinance, and the following critical areas were
confirmed as potentially present on the subject property: Wetlands;seismic hazard;wood duck habitat;
silent Lake shoreline:and type 9 stream.
2.) Acting upon the above information,Jefferson County staff conducted a site inspection of the subject
property on 1-25-200(1 end conferred the existence of the following critical areas and/or their associated
buffers on the property:wetlands,fish &wildlife habitat. shoreline(Silent Lake),stream/drainage flowing
through wetland
3.) The potential for an earthquake of a high magnitude occurring in western Washington in the near future is
considered a high probability by regional experts_
4.) Proposed development activities,as shown on the submitted plot plan, meet plat conditions.
This waiver from the provisions of the Jefferson County Interim Critical Areas Ordinancee is granted subject to the
following conditions. Any deviation from these conditions shall result in this waiver being revoked and the
application beeoming subjeet to further review.
CONDITIONS OF APPROVAL:
1.) The minimum building setback shall be 75 feet from the shoreline or the upland boundary of its contiguous
wetland for a maximum distance of 100 feet parallel to the shoreline and no less than an average of 100
feet for the remainder of the lot_ There shall be no grading or development between Silent Lake and the
building setback line except for construction of a lake access path_
2_) Outside of the area cleared for a hornesite,a reinirnum of 50%of the trees representative of the size and
species composition of the stand, including all snags and all trees 21"DBH shall be retained. Ali retained
trees may be limbed up to provide views.
3.) An area 30 feet wide(15 feet wide on both sides of the lot line)between lots 6 and 7, and an area 30 feet
wide around the perimeter of the wetland shall be maintained as open space with no removal of natural
vegetation or existing trees.
4.) No alteration shall be made to the wetland or its buffer without prior authorization by the Critical Area
Administrator. Suffer enhancement is allowed as long as native species are selected for planting.
5.) .411 construction activities, including the storage and preparation of materials, shall not encroach upon the
designated wetland,or its associated buffer.

the subject property through installing and maintaining one of The following; logs, trees, a hedge row,or
other prominent physical marking. The separation method identified by the applicant shall be approved by
the Critical Area Administrator prior to planting or installation.
7.) In the area extending 35 feel back from the Silent Lake shoreline and the upland boundary of its contiguous
wetlands, native vegetation shall be maintained. Understory vegetation may be trimmed down to a height
of six feet. A minimum of 75% of the trees representative of the size and species composition of the stand
and all snags and all trees larger than 21"diameter at breast height(DBH)shah'be maintained. All retained
trees may be limbed up to provide views.
8.) Fish and wildlife habitat area buffers shall remain naturally vegetated. Should buffer disturbance occur
during construction, replanting with native vegetation shalt be required by the Critical Area Administrator..
No alteration shall ne made to the fish and wildlife habitat area buffer without prior authorization by the
Critical Area Administrator,
9) Ai!construction activities, including the storage and preparation of materials, shall not encroach upon the
designated fish and wildlife habitat area, its associated buffer,or any critically important plants and trees
identified on the subject property.
10.) Damage to vegetation to be retained on site shall be minimized by directional felling of trees away from
these areas.
11.) The applicant shall permanently separate the boundary of the fish and wildlife area buffer from the
remainder of the subject property through installing and maintaining one of the following; logs,trees,a
hedge row, or other prominent physical marking. The separation method identified by the applicant shell be
approved by the Critical Area Administrator prior to planting or installation.
12.) The proposed development shall be located on the subject property exactly as identified on the Universal
Plot Plan, or other Site Plan, approved by the County as part of the triggering permit application.Applicant
shall be responsible for contacting and notifying contractor(s)of the above conditions in order to ensure
compilare at various stages of construction/development.
