FINDINGS AND CONDITIONS OF APPROVAL AS REQUIRED UNDER THE
JEFFERSON COUNTY INTERIM CRITICAL AREAS ORDINANCE

FIN DINGS:
In accordance with the authority provided under subsection 4.101 and the requirements contained in Subsection
5.402 of the Jefferson County Interim Critical Areas Ordinance, the following are findings of fact relating to the
referenced application:
1.) The application was reviewed by Jefferson County Permit Center staff on 2-24-99 for the potential presence
of critical areas regulated under the provisions of the Ordinance, and the following critical areas were
confirmed as potentially present on the subject property: shoreline, stream (type 5), wetlands, seismic,
aquifer recharge area.
2.) Acting upon the above information, Jefferson County staff conducted a site inspection of the subject
property on 2-24-99 and confirmed the existence of the following critical areas and/or their associated
buffers on the property: shoreline, wetlands in the central and northern portion of the parcel, type 5 stream
crossing the rear of the property from west to east, then flowing along the eastern property boundary.
3.) The wetlands located on the parcel have been classified as a category III wetlands according to the
Washinton State Wetland Rating System, Second Edition.
4.) Subsequent to the initial findings and conditions dated 3-5-99 the applicant tightlined the type 5 stream
which flowed along the eastern property boundary. This was done without county approval and without a
hydraulics project approval from the Washington State Department of Fish and Wildlife. To mitigate for this
action the applicant presented Jefferson County and WA State Department of Fish and Wildlife with a
Mitigation/Enhancement Plan. This plan has been accepted by Jefferson County as mitigation for removing
the vegetation along the type 5 stream along the eastern property boundary and tightlining the stream in
that area.
5.) Aquifer recharge areas in Jefferson County are characterized by porous geologic formations that allow
percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic
formations that contain sufficient saturated permeable material to yield significant quantities of water to
wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of
Jefferson County.
6.) A site inspection by Permit Center Staff was performed on February 24, 1999.
7.) The potential for an earthquake of a high magnitude occuring in western Washington in the near future is
considered a high probability by regional experts.
8.) This waiver also includes findings and conditions for evaluation of shoreline areas as regulated under the
provision of The Jefferson County Shoreline Management Master Program, adopted March 7, 1988, as
amended.
9.) The standard setback for residential structures, including common appurtenant structures such as garages
and workshops, shall be 30 feet, or 1 foot for each foot of bank height, whichever is greater. This setback
shall be measured from the bank's edge when the bank height exceeds 10 feet.
10.) Proposed development is located on the north side of Shine Road. The shoreline is located on the south
side of Shine Road.

' This waiver from the provisions of the Jefferson County Interim Critical Areas Ordinance is granted subject to the
following conditions. Any deviation from these cbnditions shall result in this waiver being revoked and the
application becoming subject to further review.
CONDITIONS OF APPROVAL:
1.) A minimum setback of 30 feet shall be permanently maintained as a fish and wildlife habitat area buffer
associated with the shoreline. This buffer shall be measured perpendicularly from the ordinary high water
mark along the shoreline.
2.) A setback (buffer) of 15 feet, measured perpendicularly from the ordinary high water mark along the bank of
the "Type 5 water" (WAC 222-16-030)which crosses the north end of the parcel from west to east shall be
permanently maintained as a fish and wildlife habitat area.
3.) Fish and wildlife habitat area buffers shall remain naturally vegetated. Should buffer disturbance occur
during construction, replanting with native vegetation shall be required by the Critical Area Administrator.
No alteration shall be made to the fish and wildlife habitat area buffer without prior authorization by the
Critical Area Administrator.
4.) All construction activities, including the storage and preparation of materials, shall not encroach upon the
designated fish and wildlife habitat area, its associated buffer, or any critically important plants and trees
identified on the subject property.
5.) Residential structures shall not exceed thirty-five (35)feet in height.
6.) A setback of 25 feet, measured perpendicularly from the wetland edge, shall be permanently maintained as
a buffer. No filling, grading, clearing or other alteration of the wetland or its buffer is allowed.
7.) No alteration shall be made to the wetland or its buffer without prior authorization by the Critical Area
Administrator. Buffer enhancement is allowed as long as native species are selected for planting.
8.) Prior to and during approved construction activities, the perimeter of the wetland buffer shall be marked with
a temporary sign. The sign shall be placed in such a manner that it can be directly observed from the
construction area. The sign shall contain the following statement: "Wetland and Buffer- Do not Remove or
Alter Existing Native Vegetation."
9.) The applicant shall permanently separate the upland boundary of the wetland buffer from the remainder of
the subject property through installing and maintaining one of the following; logs, trees, a hedge row, or
other prominent physical marking. The separation method identified by the applicant shall be approved by
the Critical Area Administrator prior to planting or installation.
10.) All construction activities, including the storage and preparation of materials, shall not encroach upon the
designated wetland, or its associated buffer.
11.) The applicant has proposed to install the plants incorporated in the mitigation plan during the summer
months. Once the plan has been fully implemented a brief letter with photos will be submitted to the
Jefferson County Department of Community Development, Development Review Division (CASE NO.
CAR99-00026)to document installation of all the plants as specified on the enhancement design, as well as
any subsitutions made to plant species and numbers. In addition, a letter will be submitted to Jefferson
County to document the condition of the plants at the end of the growing season and whether or not any
plants need to be replaced. The building department will not perform a final building inspection until plan
compliance has been verified by the Development Review Division.
