The application was reviewed by Jefferson County Permit Center staff on 5/09/00 for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: Seismic Hazard Area, Osprey and Eagle Habitat, Streams (Type 9), Landslide Hazard Area (Low Hazard), Susceptible Aquifer Recharge Area, adjacent commercial forest lands. 2.) Acting upon the above information, Jefferson County staff conducted a site inspection of the subject property on September 23, 1997 and confirmed the existence of the following critical areas and/or their associated buffers on the property: Landslide Hazard Area, Seismic Hazard Area, Streams, Fish and Wildlife Habitat, Eagle Habitat, and Designated Forestlands.. 3.) Designated commercial forest lands are located on the northern, western, and southern adjacent properties. According to the Jefferson County Interim Forest Lands Ordinance (Ordinance No. 01-0121-97), buffer and development restrictions are required on property located adjacent to designated forest lands. Please refer to the attached letter regarding buffers and development restrictions for this property. 4.) Lands adjacent to the subject property may conduct a variety of forest related activities that are not compatible with residential development. These activities include spraying, pruning, harvesting, blasting, drilling, rock curshing, and vehicle movements, which can generate dust, smoke, noise and odor. Forest or mining activities performed in accordance with county, state, and federal laws are not subject to legal action as public nuisances. 5.) An eagle management plan was required and submitted to the Washington State Department of Fish and Wildlife. 6.) This waiver also includes findings and conditions for evaluation of shoreline areas as regulated under the provision of The Jefferson County Shoreline Management Master Program, adopted March 7, 1988, as amended. 7.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 8.) The subject property also contains bluffs. These bluffs are considered unstable and are subject to catatrophic slides. The potential for an earthquake of a high magnitude occuring in western Washington in the near future is considered a high probability by regional experts. 9.) A Type 9 Stream is located on the subject property. Y' his waiver from the provisions of the Jefferson County Interim Critical Areas Ordinance is granted subject to the following conditions. Any deviation from these conditions shall result in this waiver being revoked and the application becoming subject to further review. CONDITIONS OF APPROVAL: 1.) Landslide hazard areas and their associated buffers shall remain naturally vegetated. A 100-foot setback is required from the top of the landslide hazard area (bluff). Included within the 100-foot setback requirement, a vegetative buffer shall be maintained along the bluff. The buffer shall measure 30-feet, measuring perpendicularly from the top of the landslide hazard area. Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Area Administrator. No alteration shall be made to the landslide hazard area or its associated buffer without prior authorization by the Critical Area Administrator. 2.) Prior to and during approved construction activities, the perimeter of the landslide hazard area buffer shall be marked with a temporary sign. The sign shall be placed in such a manner that it can be directly observed from the construction area. The sign shall contain the following statement: "Landslide Hazard Area and Buffer- Do not Remove or Alter Existing Native Vegetation." 3.) Surface drainage shall not be directed across the face of a marine bluff, landslide hazard or ravine. If drainage must be discharged from a bluff to adjacent waters, it shall be collected above the face of the bluff and discharged to the water by tight line drain and provided with an energy dissipating device at the shoreline. A shoreline permit is required to discharge water at the shoreline. 4.) All construction activities, including the storage and preparation of materials, shall not encroach upon the designated geologically hazardous area, or its associated buffer. 5.) Damage to vegetation to be retained on site shall be minimized by directional felling of trees away from these areas. 6.) The applicant shall permanently separate the boundary of the landslide hazard area buffer from the remainder of the subject property through installing and maintaining one of the following; logs, trees, a hedge row, or other prominent physical marking. The separation method identified by the applicant shall be approved by the Critical Area Administrator prior to planting or installation. 7.) Vegetation retained on-site following completion of clearing for roadways, utilities and the like, may be cleared only if such clearing is absolutely necessary to complete the proposal (Note: This condition shall not be construed as allowing removal of native vegetation within a designated critical area or its associated buffer). 8.) Applicant shall fully and completely adhere to all the conditions and requirements of the eagle habitat management plan which have been agreed upon between the applicant and the Washington State Department of Fish and Wildlife. 9.) A setback of 100-feet shall be permanently maintained from the top of the landslide hazard area (bluff). All buffers shall be measured perpendicularly from the top of the landslide hazard area. 10.) A setback (buffer) of 15 feet, measured perpendicularly from the ordinary high water mark along the bank shall be permanently maintained as a fish and wildlife habitat area along the Type 9 Stream.
