PUBLIC COMMENT Chair Grace called for public comment. There being none, the option was left open for public comment to be made by late arrivals. APPROVAL OF AGENDA Chair Grace called for a motion to accept the agenda for January 16, 2025. MOTION: Member Eisenhour moved to approve the agenda as amended. Member Kolff seconded the motion, which carried by a unanimous vote. APPROVAL OF MINUTES Chair Grace requested a motion to approve the minutes of the December 19, 2024 meeting. MOTION: Member Kolff moved to approve the minutes. Member Eisenhour seconded the motion, which carried by a unanimous vote. Respectfully submitted Page I of 4 G. Gilbert OLD BUSINESS AND INFORMATIONAL ITEMS 1. Jefferson County Public Health (JCPH) Report Staff Member Martine welcomed Commissioner Dudley-Nollette to the Board, representing District 1. They also thanked Member Kolff for offering to represent the Board of Health at the Behavioral Health Advisory Committee (BHAC) and reminded the Board that an alternate will need to be appointed. They mentioned that the State Department of Health is in financial flux, due to state budget shortfalls and changes in federal and state administrations. This may impact health funding and services across the governmental public health system. Member Eisenhour informed that she has taken on the liaison role with state government and will regularly be attending meetings in Olympia. Member Martine concluded with an announcement that JCPH published its first Environmental and Climate and Health Impact Report (community health assessment) with a correlated data dashboard, available on the County website. 2. Jefferson Healthcare Report Member Kolff attended a meeting of the Washington State Hospital Association, discussing priorities and possible impacts of government action. Jefferson Healthcare is one of the rare hospitals that operates profitably. The hospital renovation and expansion is on track, both time and budget -wise, anticipating a July opening. PUBLIC COMMENT Chair Grace paused Old Business in order to allow comment from a member of the public. Commenter made a statement concerning the costliness and scarcity of eggs, and questioned overreaction (declaration of emergency in California) to avian influenza when considering the rarity of human infection. OLD BUSINESS AND INFORMATIONAL ITEMS (continued) 3. Infectious Diseases Update Dr. Berry gave an update on current infectious diseases of note. There is currently a high rate of influenza cases, though there are early signs of a downturn. Vaccination, and masking when in indoor, crowded spaces, is recommended; stay home when ill. Low rates of COVID have been seen. RSV has had a mild year, largely due to good uptake of the RSV vaccine; there is a good RSV vaccine, recommended for elderly, infants and pregnant people. There is good news concerning Avian flu; it remains largely an animal (not human) ailment. Human infection results from close, unsafe contact with animals; wear gloves and an N95 mask if caring for sick poultry, cattle, or wildlife. There are no current poultry outbreaks in Clallam or Jefferson Counties. Protect poultry flocks by reducing contact with wild birds. Monthly dairy testing has found no avian flu in cows in the state of Washington. The declaration of emergency in California is largely an economic issue, due to devastation of the dairy industry. There have been cases of avian flu crossing over into cats, due to eating wild birds or raw meat. Avoiding raw food and keeping cats indoors or to limited outdoor areas is recommended. NEW BUSINESS 1. Introduction of Commissioner Heather Dudley-Nollette to the Board of Health Staff member Martine welcomed new Board Member Dudley-Nollette to the Board of Health, and to the Board of County Commissioners, and looked forward to introducing her to the work of JCPH. Introduction of Celeste Dybeck, new Tribal Representative to the Board of Health Member Kolff gave a brief biography of new Board Member Dybeck and listed many of her services to Jefferson County. 3. [POTENTIAL ACTION] New Consumer of Public Health Board Member: applicant interviews and selection The following individuals, having expressed interest in serving on the Board of Health in the position of Consumer of Public Health, and having filled out an application, were interviewed by the Board: Eden Blooms Bridgette Ramsey Ariel Shultz Armijo Stephen Schumacher Erica Ellis Michael Schattenkerk Jamillah DeCianne Gabrielle Vanwert Following a vote by current Board Members present: MOTION: Member Brotherton moved to appoint Gabrielle Vanwert as the new Consumer of Public Health Member on the Board of Health. Member Dudley-Nollette seconded the motion. Chair Grace called for public comment. Commenter congratulated Ms. Vanwert on selection and appreciated her willingness to speak for people who don't have a voice in the community. A vote was held on Member Brotherton's motion, which passed unanimously. FUTURE POTENTIAL AGENDA TOPICS Member Brotherton proposed scheduling a presentation by Olympic Region Clean Air Agency concerning its services. Staff Member Martine reproposed the Olympic Community of Health, which will present on the new Community Care Hub model that will be launched in the region in 2025. Member Kolff proposed adding climate action topics. Member Eisenhour suggested a discussion of Community Wildfire Protection Plan, and the Community Wildfire Defense Grant (in development). ANNOUNCEMENTS According to Member Kolff, Jefferson Healthcare recently received a Climate Change Air Quality Grant and has reached out to JCPH. An existing OSS may be connected to a replacement structure that was damaMd in a natural disaster or other situation beyond the Property owner's control such as, fire, earthquake, landslide, etc., if all of the following requirements are met: a. The footprint, heated square footage, and septic capadtV requirements of the replacement structure remains the same as the original structure. b. The waste -strength is of res[dential strength in nature. c. The existing OSS was issued a perm[t and has been given_ final _approval _for use by the department. d. The existing method of sewage dis osaI is not a pit privy, outhouse seepage pit, or method of disposal that if continued use of the O55 would be inconsistent with the Purpose and obiectives of this chapter. e. The OSS shall have a full evaluation by a septic designer or engineer that proves the following; ([) The tank(s) are In Rood condition/working order; fOi) The disposal component has at Ieast two feet of vertical separation; Oil The disposal component is not onded• (iy) The OSS has not been modified without permits; (v) The 055 meets proper setbacks to wells and surface waters; and M) The OSS has not failed as defined by chapter 246-272A WAC. f. If all of the above in this subsection are met an up-to-date record d rawi ng of the OSS generated by a desi ner shall be submitted to the de artment and the O55 shall be retrofitted as to Provide proper access for ongoing O&M as prescribed in the desi n section of this chapter. 4 A reserve area designation shall be required on any propertyserved by an OSS prior to approval of a buildin permit that increases the footprint or adds additional structures on a property which does not already have a reserve area. 8.15.065 Areas where OSS may ose a sign if [cant risk to public health. The health officer may impose additional reouirements to an 055 application beyond the minimum established in this chapter and cha pter 246-272A WAC and may deny the a pp I!cation in a ny area where an OSS may ose a sign ifi cant risk to human health and the environment. The health officer shall make the following, findin s in their decision: 1 The decision is made as a matter ofpi-of essionaI iud ment to protect human health and saf ety, and the environment; 2 The re uirements and restrictions contained within the decision are prudentand necessary t4 prevent or reduce the Possibili of failure of an O55 or to minimize any ne ative im acts of an 055 u Pon Publ[c health and environmentally sensitive areas; and Page 14 of 63 3 The determination is based on a review of available science by the department and other agencies with ex ertise in maki ng their determination. 8.15.070 No discharge to water or ground surface. Effluent from any en site s ageOS5 disposal sy t-am-or other human sewage shall not be discharged directly or indirectly to surface water or upon the surface of the ground, except where expressly permitted by K-Wthe department, DOH, or -by the tnra5WRg, R State Depaft.-,.en s Ecology=- rn-a 9 20 § 2 (App; s).Ord c_,�� 8.15.075 Minimum land area requirements. Prior to apy roval of an OSS oermit pursuant to this chapter, LLOR determination oursuant to cha pter 18.12 JCC or a land division pursuant to cha pter 18.35 JCC the property shall comply with one of the minimum land area req uirements below. If multi le lots are needed for the -property to meet one of there ulrements below, the lots shall be bound together via a restrictive covenant or lot consolidation. The covenant or consolidation shall be recorded with the Jefferson County Auditor's Office on a form approved by the department. Excess adjacent lots not needed for the property to meet minimum land area shall be included in the covenant or consolidation unless the iots ind ividual ly comply with Table XI of cha pter 246-272A-0320 WAC. Excess lots may be unbound if they are needed for other land areas needing to comply with this section. (1) The property meets Table Xi of chapter 246-272A-0320 WAC; or 2 The Property does not meet Table XI of chapter 246-272A-0320 WAC but complies with all of the followin : a. The property is at least SQ% of the required land area of Table XI of chapter 246-272A-0320 WAC• and b. The property utilizes an OSS that does not exceed the nitro en loadi ng limits of Table XII of chapter 246- 272A-0320 WAC, and c. The Property utilizes an OSS meeti ng a minimum of treatment level B and bacterial level 2 or a pressurized OSS with 36 inches of vertical separation; and d. The property utilizes an OSS without taking size reductions; and e. The owner of the property does not own additional adjacent lots or is unable aggregate additional lots that would allow the Pror)erty to meet Table XI of cha pter 246-272A-0320 WAC: or (3) The property does not meet (1) or (2) above but gualifies for a waiver from the above requirements by complying with all of the following: a. Application for a waiver including a iustification describfng how the requested waiver is consistent with the purposes and objectives of protecting public health; and b. The propetty utilizes an OSS meeting a minimum of treatment level B and bacterial level 2; and c. The pro e utilizes an OSS without taking size reductions and d. The pro perty utilizes an OSS that does not exceed the nitro en load in limits of Table XII of chapter 246- 272A-0320 WAC; and e. The prooerty does not rea uire any other waivers from this cha ter or chapter 246-272A WAC to Permit an OSS; and f. The owner of the property does not own additional ad I scent lots or is unable 4tggregate additional lots that would allow the propeny to meet 2 above• or 4 The property has a Oermitted ❑5S that has been given final approval by the de artment or has been partial[ installed as defined by this_chapter; or S The roe has an OSS that was constructed prior to 1970 and has been proven as such. Page 15 of 63 8.15.080 OSS ^~ _4e Gewage system permit requirements. (1) Permit reg uired. Installation modification ex ansion of an OSS or connection to an existing OSS without a valid permit issued by the health officer is prohibited. "'^ ���"' �'," ^ a `^ "^ �talled v •.�.. ^� r to (2) An OSS permit shall not be issued on a property that does not meet one of the minimum land area provisions of this chapter. 3 Exemption from permit re uirement for Minor Repairs. A ermit Is not required for those repairs defined as minor re airs. The f ol lowi ng is req uired for minor repairs: a. All minor repairs shall be documented via the on -site septic inspection and monitoring database or Other approved method; b. The work shall be completed by a property owner, certified installer, O&M specialist, O&M technician or pumper as allowed under their certificate; and c. Where pump or control panel are replaced or altered a report shall be submitted to the department to identify the completed minor re afr. The report shad include component manufacturer, specification, and verify that settings and f u ricti on a lity are consistent with the a Djoroved design. 4 Emergency mitigations for sewage surfacing or backing up into a structure; a desi per or installer Tnav perform emer en cy mitigations to alleviate the hazard until a repair permit can be issued. All of the foll owing shall be required in such situations: a. The mitigation shall protect human and_ environmental health- b. The miti gation shall eliminate possible human or anlmal contact with OSS eff{uent- c. The miti ation shall consider site constraints such as but not limited to surface waters wells ditches round water etc; and d. The mitigation shall be documented and reported to the department within of 24 hours work performed. 5 Shali be acted u pon in accordance with the re uIations in effect at the time of formal submittal including but not limited to its period of validity and expiration date. 6 Installation of an OSS does not assure future development on the prooeny. Future development shall comply with state and local code at the timeof_appi icatlon_ 7 A plication. The application shall be submitted on a form provided by the department with all submittal re uirements as required by the department through administrative rule on the form and by this chapter. Incomplete applications and fees shall be returned to the applicant without further processing or review. To be considered complete an application shall include all of the following: a. A detailed to -scale construction plan for the proposed OSS and site with on inaI sign atu re of the designer, b. A Ilcation form is com fete and accurate with property information and on inal slg nature of a pplicant or authorized representative; and c. A soil log report completed by the individual who performed the soil evaluation. The report shall identify the date the soil observations were made and the name of the person who logged the soils for the report. Soils evaluation shall be completed by a designer or -professional engineer licensed in the state of Washin ton soil scientist licensed in the state of Washln fion nr the local health officer. The soil testing shall com P ly with the req uirements of cha pter 246-272A-0220 WAC and the f ol I owi ng procedures: i A minimum of two soil logs shall be du-g in bath the Proposed pri'mary area and the oroposed reserve area of sufficient size and depth to accurately determine site suitability for on -site sewage disposal. Ol The health officer may re wire additional sail logs or such further testing as is necessary to determine the adequacy of a site for on -site sewage disposal. iii Where sieve analysis tests are required, they shall be completed by a certified lab and chain of custody re uirements shall be followed. Page 16 of 63 (Ivl The property owner shall fill and cover the holes provided for evaluation of the soils for an installation permit or subdivision review within 10 day1following notification that the Inspection b the health officer is complete. The property owner shall be notified in wnting when the Inspection has been completed. d. Any easements or covenants neressaryto provide sufficient area to locate an ❑55 shall be recorded with the Jefferson County auditor's office prior to submittal of any O55 permit applicatian. In the case of immediate pubiic health hazard recordi ng of the easements covenants or lot cons-ol idations shall be reg uired j3dar to final ap proval of the ❑55. 8 Errors In design or installation are the res onsibili of the property owner. The p roe owner or their authorized agent is responsible for the accurate representation of all information presented to the health officer. Any error committed by a desi ner or installer remains the sole res on si bi lity of the property owner. The department does not have the authori or res onsibi I ity to change 055 re uirements when errors occur in design or installation. 9 ❑55 for structures 5ubiect to cha ter 15,151CC and for any 055 located in a flood lain f loodway, coastal high hazard area or area of special flood hazard as defined in cha ter 15.15 JCC the OSS permit shall not be issued until all reg uired permits and app rovals have been issued p ursuant to chapter 15.15 JCC. PermIts for all OS5 shall comply with all ap PIicable rea uirements of RCW WAC and federal law. b. Permits for all 055 within unincorporated Jefferson County shall comply with all applicable provisions of the JCC in cl ud i rR but nat limited to the Jefferson Cou nty. Page 19 of 63 3 Repair ermits ma be extended for an additional 90 days if the health officer determines it is warranted. Additional mitigations to reduce risk may be required. Such mitigations may include inspection by an O&M specialist, technician, or designer or participation in a voluntary compliance agreement. 4 Per chapter 245-272A WAC the minimum design flow of an OSS fora mar dwelling unit is 240 gallons per day. A re air or replacement residential OSS that was previously design ed for less than 240 gpd shall be sized to meet this minimum design standard. 8.15.082 Pending OSS application or permit - transferabil extension and cancellation. 1 Application and permlt transferable. An aRplication and permit is transferable with property ownership. Z Extension of time for pending O55 Permit application The health officer may extend the time for action by the applicant fora period not to exceed 180 days upon written request by the 2Pplicant showing that circumstances beyond the control of the applicant have prevented completion of a Eicatipn re uirements. No application shall be extended more than once. 3 Cancellation of pendirig OSS permit a p pitations. An application shall be cancelled if the aA licant fails to submit requested additional information within 12 months of the department's written notice of required information. The applicant shall resubmit a complete application and design with current designer stamp, av current application fees, and meet the current rules and regulations. 8.15.083 05S permit expiration and partial installation. (1) 055 Permit Expiration. a. An OSS ermit issued under this section shall expire after three ears from the date of issuance. b. An OSS permit may remain valid beyond its expiration date if the property for which the permit has been issued also has an active building permit for which the structure that will be connected to the OSS. c. If the OSS 1s not installed before the permit expires, a new permit may be apiplied for based on standards in effect_at the date of the new application, 121 Partial installation. When an OSS has been partially_installed _as defined by, this chapter and the original permit has _expired, any _future installation of tanks or other components needed to complete the OSS shall. require a new permit. The proposed components -shall meet code at the time of application. 8.15.084 Revocation of issued OSS permit or denial of OSS permit application. The health officer may revoke or deny an issued OSS permit or OSS permit application for good cause to protect public health and safety or the environment, including but not limited to the following: 111_ Development or continued use of the 055 threatens pubilc health; (2) Misrepresentation or inaccuracy in the construction plan or the permit apolication; 3 Fall_ure to meet cond!tio_n_s of the _D_ermit or the regulations or 4 Changes or alterations to the site that may ne a tively im act the f u ricti on ing of the 055 or reserve area included but not limited to Sradin f N ling, clear! Tig, cr bum ing o rwations. 8.15.085 Operational permits, 1 Application recluired. Application for an operational permit shall be submitted on a form provided by the department. Incomplete applications and fees shall be returned to the applicant without Further processing or review. To be considered complete an operational permit application shall be fully completed and shall have fees paid in full. 2 An operational permit shall be re uired in following cases; a. For privately -owned OSS consisting solely of a holding tank; b._ For experimental OSS or OSS for which there is a proprietary product development permit; c. Pursuant to resolutions adopted by the SOH; or Page 20 of 63 d. For OSS that the health officer determines riasgs a sign if ica n trisk to public health. (3) When an operational permit is required, the health officer shall: a. Establish conditions of approval of the operational permit which shall be met by the property owner for continued use of the OSS; b. Update conditions in the operational permit as appropriate as a result of changes to the OSS and its use; and c. lJ pcn a determination by the de artment that the OSS is not in comp liance wlth Its operational permilt, den.y. or withhold approvals of applications for other permits issued by the department that have been applied for bV the property owner. (4) Property owners shall renewed their operational permit annually or as otherwise required by theoperational permit. 5 A written service contract In a form acceptable by the department shall be in effect between the Property owner and an O&M specialist, technician um er or designer to gerform the inspections, maintenance um p ing, sam pling, mon itori n& and an other re uirements of the a perational permit. 6 The projoeM owner of an OSS which is req uired to have an o erational permit shall be res onsible for complying with the conditions of the operational permit and for renewing the operational permit at the required freguencv as specified by the operational permit. 7 Failure to com p ly with the conditions in an o erational Permit or to renew the operational Permit as rec Luired by the o erational permit is a violation of this cha ter and is enforceable under title 19 3CC. 8.15.090 Design requirements for all OSS. 1 A[I OSS shall be design ed in accordance with this chapter and chapter 246-272A WAC. One copy of the following information: (i) Directions to the site. (ii) Identification if the parcel is within the boundaries of a sewer utility. (iii) If connecting to a community OSS provide. {* . (0) One copy of any special reports applicable to the project, such as geotechnical report or wetland delineation. (4 11) Design and construction specifications shall include the following items and those required by hapter 246- 272A WAC. This portion of the application shall be no more than 10 pages, 11, inches by 17 inches, unless specifically authorized by the health officer. All sheets m4st-shall be at least eight and one-half inches by 11 inches but not more than 11 inches by 17 inches. 4a4a. A complete, detailed, and dimensional site plan including: (i) The date of the design, the designer's seal and the de_ onDina!-signature. Vertical cross-section drawings showing: (i) The depth of the disposal component from native grade, the vertical separation, and depth of soil cover; (ii) Septic tank; (iii) Pump tank and its components; and (iv) Monitoring and access ports. (:�12) Calculations and assumptions supporting the proposed design, including: (a}a. Soil type (§fib. Hydraulic loading rate in the disposal componenti- (c4 . The Systems maximum and average daily flow capacity of the OSS and how determined (d}d. Source of the sewage including waste strength characteristics; and- (eke. Where pumps are included, provide friction loss and dynamic head calculations. (813) Nothing herein shall preclude the designer from providing supplemental information regarding the design directly to the client under separate cover. The amount required for adequate financial assurance shall be determined in a financial estimate certified by a third -party financial professional and approved by the department. At a minimum, the financial estimate shall consider the revenue streams or funding necessary to satisfy financial needs of a community 055 throu hout its useful life in ciuding but not limited to provision of sufficient funds or revenue stream for operation and maintenance replacement at the end of its useful life, and protectlion from liability from its failure, and the impacts of inflation. b. Financial assurance shall be Provided in form acceptable to the department. Financial assurance instruments may take the form of a trust on a form acceptable to the department, an irrevocable stands? letter of credit issued by a bank or other financial institution, an irrevocable surey performance bond issued bV a bonding or insurance company, or another tVpe financial assurance in a form acceptable to the director. (4) A covenant that runs with the land in a forma proved by the director shall be recorded with the county auditor on each lot or parcel serviced by a commun[tv OSS. At a minimum the covenant shall satisfy all of the following_ requirements: a. Reg uire the owner of the corn muni 0S5 to comply with all req uirem ents of the covenant- b. ReQuire the owner of the communily OSS to provide access to any person who is responsible for 0&M of the community OSS: c. Authorize lacement of a lien on every lot or parcel that fails to comp ly with the financial re uirements of the covenant; and d. For existing wells, the sanitary control area shall be established by covenant and portrayed graphically on the face of the plat. 61 Additional information. Application is required annually for certificate renewal. All certificate renewal applications, along with the required bond roof of continuing education and renewal fee shall be submitted to the department by March 3st. a. Reports shall include at a minimum the following information: i Measured depth of scum and sludge In the septic tank and pump chamber, if resent ii Condition of tanks baffles risers screens; iii Signs of backflow from drainfield• iiy) Signs of ground water infiltration into tank; and (v) All maintenance completed at time of pumping service. d, By submitting these reports, the -sewage -pumper shall verify in an unsworn declaration that they have performed inspection of the items under this section and accurately reported the results. It shall be unlawful to dispose of sewage at any location other than disposal sites designated and approved by Ecolagv. 0 Temporary storage of septage. If a pumper uses a tanker, other than a pump truck, to temporariiv store sewage for transport, the pumper shall develop and maintain a spill response procedure manual, submit a site plan of the property, provide a datumerrt of approval from the property owner, and meet any approvals requirements from DCD. Transport tankers shall meet the requirements for pump tanks contained in chapter S.15.12Qf Ub) JCC. A stationary tank, not Ilcensed to travel on the road, shall require a permit that meets all requirements of chapter 246-272A WAC, (9) Access risers and monitcring ports shalt be secured against tamperinp, and accidental access prior to leaving a site where a tank has been serviced or inspected. For proprietary products that require O&M by an authorized person, an O&M specialist shall not monitor or maintain these products unless they have Obtained written authorization from the manufacturer, trademark, or patent holder. 5 Reporting Requirements. a. The 08M specialist or O&M technician shall report failure of an OSS to the department within 24 hours of first iden tifyin the failure. b. The 0&M specialist or O&M technician shall submit inspection reports to the department in an approved format within 30 days fallowing the inspection. c. By submitting the report, the O&M s eciallst or 0&M technician shall verify in a declaration under oath that they have performed and accurate{y reported current OSS conditions. d. At a minimum the inspection shall include a site visit and a visual ins ection of all tanks, purnp basins treatment units dis osal area and other components of the 05S as detailed on the record drawing or site plan on record. e. An updated site vlan shall be submitted by the 0&M specialist or O&M technician when the certified person identifies new sources of wastewater site conditions have than ed that rn av alter the functionality of the OSS, or as requested by the health officer. f. The health officer shall give written notice of the hearing to any -person aggrieved who has filed a written com laint with the health officer and the affected certificate or authorization holder. c. For the first suspension under this subsection by certificate or authorization holders the suspension eriod shaIl not exceed 30 days; and the second violation in any three- ear period shall result in a suspension of the certificate or authorization for a period not less than 15 days and not to exceed 180 days. d. For inspections completed by authorized homeowner inspectors, falsely or inaccurately completed Inspections shall not be acce ted and may result in suspension of authorization. Reins ection may be re wired by a certified O&M specialist or technician. Next re uired ins ection shall be com feted b certified 0&M specialist or technician. (3) Revocation of Certificate or Authorization. a. A certificate or authorization may be revoked for repeated violation of any of the requirements of this chapter or any other a Iicabie re ulation or if, after a heari ng with the BOH the holder of such certificate or authorization shall be found grossly incompetent or negligent, or to have made fraudutent misre resentations in rnaking a pplication for a certificate or authorization or should the bond or insurance required herein be canceled. b. The third notice of violation issued by the department within anV 12-month period shall be considered as repeated violations and result in certificate or authorization revocation. d. if the BOH revokes a certificate or authorization, the holder shall not proceed with any further work in connection with the activity covered by the certificate or authorization. e. The certificate or authorization holder shall be notified by certified mail of revocation of the certificate or authorization, upon determination of -a finding that a violation has occurred requiring revocation. f. If, after revocation of a certificate_or authorization, the applicant desires to reapply for a certificate or authorization the applicant shaii wait six months prior to reappiication. Any person whose certificate or authorization has been revoked shall be required to pay all applicable fees and take and pass the written examination again before issuance of,a, new certificate. (4) Reinstatement of Suspended or Revoked Certificate or Authorization. a. The certificate or authorization holder shall make written application for reinstatement to the de artment specifying what practices, performance,and conditions that were named as grounds for suspension or revocation have been remedied, and the certificate or authorization holder shall provide a description of the than es in performance that will occur to avoid the rep etition of past violations. b. The department, upon determining that noted deficiencies have been satisfactorily addressed, shall reissue of the certificate or authorization to the individual after successful completion of the applIcation and testing procedure and payment of applicable fees. 5 Probation. A period of probation consisti ng of additional re orti ng ❑r ins ection req uirements may be imposed -on a certificate or authorization holder as a result of violations of this chapter or as a condition of operation following suspension or revocation of a certificate or authorization. Access shall be provided as determined by the manufacturer or patent holder and shall include access to ground surface for effluent sample collection, observation and inspection of the unit. d. Distribution Boxes 5 litters and Manifolds. If the location is known access shall be provided to distribution boxes s litters and manifolds as to allow inspection and to determine functionality of the component. Access shall be in the form of a watertl ht riser to the round surface. The risers shall have a means to lock or secure the lid against tampering and accidental access. (Ulg) Inspection Report. The inspection report shall be submitted in a format and manner prescribed by dGR#the department. (1) Applicability. Any person who applies for, owns, or operates an OSS may apply to the health officer for a waiver from anyof these F^^°'!'f�this chapter. (2) Granting Requirements. {aka. The health officer may grant such a waiver if it finds onl u on findin that the following have been met: (i) Special circumstances exist that are not of the applicant's making; Page 55 of 63 (ii) An unnecessary hardship will occur without the waiver; (iii) The health officer has determined that the waiver is consistent with the standards in, and the intent of, the public health protection purpose and objectives of;ei,this chapter; and (iv) Corresponding mitigation measures( ) to assure that public health and water quality protection, at least equal to that established by these err 4 this chapter, is provided. (4 . The health officer may grant a waiver conditioned by a timetable if: (i) Compliance with this rcQti!a+°c�=hanter wi4shali require spreading of costs over a considerable time period; and i (ii) The timetable is for a period that is needed to comply with this Fegu:atiencha ter. (f)c. The health officer may grant waivers from thesIe Feg tie his chapter for standards that are more stringent than the standards of Gbapter- hapter 246-272A WAC, or from 1) sQV 5i );F the requirements in these regw;atkH!�sthis chapter; that are not contained in Chapter- hapter 246-272A WAC without depa#ffleRt 9 heaithDOH approval. (3) Application. 4. The application shall be made on formspFea+ded-an__erov_ed bye the department and shall be accompanied by all information required by the health officer eF designee. (6 . The health officer may request additional information if required to make a decision. fe) . An application for a waiver, or for the renewal thereof, submitted to the health officer shall be approved or disapproved by the health officer within 90 calendar days of receipt unless the applicant and the health officer agree to a continuance. 4 A waiver approval shall remain valid for the period of the permit and under the conditions for which it was aporoved unless otherwise extended in w r-iting by the health officer. 5 A waiver approval may be required to be revised if the health pfficer determines that a otential threat to ublic health m av result without revision. 8.15.170 Appeal — Hearing. (1) Appeal of Public Health Action — Health Officer Administrative Hearing. Any peFseP aggrieved person by any Publi- may request, in writing, a hearing before the health officer h c OF t 2F de5i A&e. The appellapAa rieved erson shall submit specific statements in writing of the reason why error is assigned to the decision of public health. Such request shall be presented to the health officer within 10 business days of the action appealed; except in the case of a suspension, the request for a hearing m, ist shall be made within five business days. Upon receipt of such request together with hearing fees, the health officer shall notify the person of the time, date, and place of such hearing, which shall be set at a mutually Page 56 of 63 convenient time not less than five business days nor more than 30 business days from the date the request was received. The health officer Y4 4-shall issue a decision upholding or reversing public health's action. The health officer may require additional actions as part of the decision. (2) Appeal of Administrative Hearing. (a}a. Upon receipt of a timely written notice of appeal together with the hearing fee, the health officer shall set a time, date, and place for the requested hearing before the beard of �ealthBOH and shall give the appe44aF it- rieved person written notice thereof. Such hearing shall be set at a mutually convenient time not less than five business days or more than 30 business days from the date the appeal was received by the health officer. W . Any decision of the be@Fd of healt#BOH shall be final and may be reviewed by an action filed in superior court. Any action to review the BOH's decision must shall be filed within 30 business days of the date of the decision. (3) The following guidelines apply to all hearings and appeals conducted by the "e, 130!•i pursuant to this section: (a)a. Appeals shall be made in writing and shall be signed and dated by the petitiOniFlg 13BFtyaggrieved person. (4 . Appeals shall include a brief and concise statement of the law and facts, which affirmatively establish that the health officer has committed an error. (Q . Appeals shall be transmitted to the -.-e,ra R-r healthBOH by the department_ following receipt from the petitte 4mRg party together with all relevant material associated with the health officer's action, including, but not limited to, applications, reports, soil logs, photographs, staff analysis and recommendations. (mod. Upon receipt of the appeal materials transmitted by X-RF4the department, the dead-e€ health80H shall conduct a hearing to determine the correctness of the decision by the health officer within 35 days. The petit;...., aggrieved person shall be given five days' notice by certified mail of the purpose, time, date and place of said hearing. Further, if the Ong pa4yaggrieved person is a person other than the permit applicant or a permit holder, then notice of the purpose, time, date, and place of said hearing shall likewise be mailed by certified mail to the permit applicant or permit holder. (eje. Any hearing conducted pursuant to this section shall be a public hearing and the chairperson of the bGaFd of hea1t#BOH shall open the hearing and take testimony from any interested persons; provided, that testimony in suspension or revocation hearings shall be limited to that presented by the health officer, the certificate holder and any witness called by them; provided further, that the chairperson may limit the length of the testimony to a specific amount of time to be applied equally to those interested persons wishing to Page 57 of 63 speak, except in suspension or revocation hearings where the heare€heal*k�BOH is authorized to use its discretion. {q The procedure to be utilized during any hearing conducted pursuant to this section shall be as follows: (i) The petitiepiqg pa4yaggrieved person, permit applicant, or permit holder and the health officer, if not the ggrieved person, shall be given an opportunity to present evidence, analysis and recommendations. (ii) Members of the boardthBOH may direct questions to the petitioning paFtyapQrieyed person, permit applicant or permit holder and health officer. (iii) The chairperson of the heard shall permit the presentation of testimony by any interested person as set forth in this chapter. (iv) Following presentation of evidence and testimony, the chairperson of the "ear BOH shall close the hearing and initiate discussion with other board members on the matters presented. (v) Following discussion, the shall make ruling on the appeal. (vi) Under no circumstances shall cross-examination of persons making presentations at the hearing be permitted, notwithstanding that the beaF of healthBOH may ask questions as set forth above. {g}g_ Should the bear' of hn 4hBOH require additional testimony, it may continue the public hearing to a date and time not to exceed 35 days following the date of the initial public hearing; provided, that at the close of the second public hearing the heard of hPAkhBOH may continue its deliberations on the appeal to another time and date not to exceed 35 days following the close of the second public hearing conducted to receive additional testimony. In all other cases the beai,d of hPa;t#BOH may continue its deliberations on the appeal to another date and time not to exceed 35 days following the close of the public hearing. Nh. Relevant evidence is admissible, if in the opinion of the heard ef hPalthBOH it is the best evidence reasonably obtainable having due regard for its necessity, availability and trustworthiness; provided, that in passing upon the admissibility of evidence the Jefferson County heard BOH may give consideration to, but shall not be bound to follow, the rules of evidence governing civil proceedings in matters not involving trial by jury in the superior court of the state of Washington. {4i. A full and complete record shall be kept of all proceedings and all testimony shall be. recorded.
