Parcel Number. 950100709 S-T-R: 16-27N-01E Site Address: 60 S BEACH DR PORT LUDLOW WA, 98365 FINDINGS: In accordance with the authority provided under subsection 4.101 and the requirements contained in Subsection 5.402 of the Jefferson County Interim Critical Areas Ordinance, the following are findings of fact relating to the referenced application: 1.) Acting upon the above information, Jefferson County staff conducted a site inspection of the subject property on May 21, 1999 and May 23, 2000 and confirmed the existence of the following critical areas and/or their associated buffers on the property: Wetlands (Category II), and Fish and Wildlife Habitat associated with the shoreline.. 2.) The Jefferson County Interim Critical Areas Ordinance (ICAO) requires a standard setback of 100 feet from a Category II Wetland for properties deemed High Intensity Land Uses. The ICAO defines parcels under 1-acre as a High Intensity Land Use. 3.) Due to the physical constraints of the subject property,the applicant applied for a Reasonable Economic Use Variance to deviate from the required setbacks of the Jefferson County Interim Critical Areas Ordinance. The request would reduce the setback requirements from the associated wetland from 100-feet reduced to 15-feet along the northern property line, and 100-feet reduced to 30-feet along the western property line. 4.) An Open Record Hearing was held on July 11, 2000 at 1:00 P.M at the Jefferson County Courthouse. Hearings Examiner Iry Berteig presided and rendered a decision of APPROVAL regarding the request. The Hearing Examiner's decision also includes a list of conditions. 5.) The Hearings Examiner's Decision with associated Conditions can be referenced through the Findings, Conclusions and Decision Report (Page 10, Walter Pederson Variance CAR00-00038). This waiver from the provisions of the Jefferson County Interim Critical Areas Ordinance is granted subject to the following conditions. Any deviation from these conditions shall result in this waiver being revoked and the application becoming subject to further review. CONDITIONS OF APPROVAL: 1.) Prior to issuance of the County Building Permit and Sewage Disposal Permit, the Applicant will be required to sign a waiver, "Findings and Conditions of Approval"which will require the following conditions: 2.) A minimum setback of 30 feet shall be permanently established as a fish and wildlife/wetland habitat area buffer associated with the wetland/shoreline on the western portion of the parcel. This buffer shall be measured perpendicularly from the edge of the wetland/shoreline, as flagged by the consultant. 3.) A minimum setback of 15 feet shall be permanently established as a fish and wildlife/wetland habitat buffer associated with the wetland located along the northern property line. The applicant shall develop and submit to the Development Review Division for approval a buffer enhancement plan using restive vegetation, which substantiates that aghanced buffer will improve the functional attributes of th bitat and provide additional protection to djacent wetlands, including: a. A maintenance plan for the prescribed vegetative buffer. A two-year maintenance program shall include weeding, supplemental watering, and other items necessary to maintain planted areas in a healthy condition; and b. A site plan depicting the exact location of plantings, density of said plantings, and species of plantings. 5.) Fish and wildlife habitat area buffers shall remain naturally vegetated. 6.) Construction activities (including the storage, preparation of materials and disposal of construction debris) shall not encroach upon designated fish and wildlife habitat areas or their associated buffers. 7.) A temporary construction fence along the upland boundary of the wetland buffer shall be installed prior to any site alteration other than installation of buffer enhancements. 8.) A permanent physical separation along the upland boundary of the wetland buffer, as stated above, shall be installed and permanently maintained. Such separation may consist of logs, a tree or hedgerow, or other prominent physical marking approved by the Administrator. 9.) Buffer perimeters shall be marked with temporary signs, one along the northern buffer area and one along the western buffer area. Signs shall remain in place prior to and during approved construction activities. The signs shall contain the following statement: "Wetland and Buffer- Do Not Remove or Alter Existing Native Vegetation." 10.) Residential structures shall not exceed thirty-five feet in height. 11.) The applicant shall follow recommendations as stated in the Drainage and Erosion Control Plan and the Habitat Management Plan. 12.) The installation of the septic tank and transfer tank shall be subject to the approval of the appropriate health agency to assure that the tanks are designed to withstand flooding. 13.) Violations of any above conditions may result in an immediate"STOP WORK"order. Violation of Condition 6 within the designated fish and wildlife habitat areas may be the basis for revocation of this variance. 14.) The Applicant, or subsequent owner, shall advise all contractors and subcontractors of these conditions and the consequences of violations.
