The application was reviewed by Jefferson County Department of Community Development staff on April 20, 2000 for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: Landslide hazard area 2 and 3; Eagle habitat; aquafer recharge area; and shoreline. 2.) Aquifer recharge areas in Jefferson County are characterized by porous geologic formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 3.) Susceptible aquifer recharge areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. This includes any portion of Jefferson County with a DRASTIC index of greater than or equal to 180 points as determined using the U.S. Environmental Protection Agency DRASTIC methodology: Drastic: A Standardized System for Evaluating Ground Water Pollution Using Hydrogeologic Settings (EPA 600/23-87-035). 4.) The construction of a single family residence is not considered a high impact land use, therefore the proposed structure is not subject to Aquifer Recharge Area regulations at this time. However, when Best Management Practices are adopted by the Jefferson County Board of Commissioners, there may be some rules and/or recommendations which apply to the future development of the subject property regarding Aquifer Recharge protection (please see enclosed copy of DRAFT Best Management Practices rules). 5.) Bald eagle habitat is listed as Washington State Priority Species. Priority species are defined as wildlife species requiring protective measures for their perpetuation due to their population status, their sensitivity to habitat alterations and/or their recreational importance. Priority habitat is defined as a habitat type with unique or significant value to many species. 6.) On April 20, 2000 a request was sent to Washington Department of Fish and Wildlife to determine whether an eagle management plan was needed. Per letter dated May 12, 2000 from Shelly Ament (Fish &Wildlife Biologist), Lot 2 within the Middle Point Land Conservancy subdivision will not require a separate eagle management plan but the landowner must comply with the covenents for habitat protection outlined for the subdivision. These covenants are listed in Section VI, "Recommendations for development design" In:An Assessment of Wildlife Species and Habitats for the Middle Point Land Conservancy Property, prepared by Resources Northwest, Inc,. June 15, 1992. 7.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 8.) These bluffs are considered unstable and are subject to catatrophic'slides. The potential for an earthquake of a high magnitude occuring in western Washington in the near future is considered a high probability by regional experts. g.) A geotechnical report dated May 2000 has been prepared for Lot 2 by Northwest Territories, Inc. with the following recommendations: 1. Drainage from roof and paved yard areas should not be allowed to concentrate but should be distributed north and south into adjacent areas as evenly as possible. 2. Vegetation cover on the lot should be maintained in natural conditions except where necessary for residential construction. 10.) Said parcel (Lot 2) is subject to a minimum building setback of 200 feet from the top of the bluff. This setback also includes construction of septic systems and drainfields, hot tubs, viewing decks, decks, gazebos, fences, and beach access systems. No hunting or discharge of firearms, no lawns, agriculture, or livestock grazing, no use of motorized vehicles, no unleshed pets. 11.) The subject parcel is limited to 0.5 acre clearing for homesites including driveways. 12.) The parcel (Lot 2) is subject to Covenants established by recorded CC&R's under Auditor's File Number 355675. 13.) The parcel (Lot 2) is subject to a maintenance agreement and restrictive covenant with Jefferson County for purposes of the approved stormwater system per Auditor's File Number 355636. 14.) The parcel (Lot 2) is subject to a road maintenance agreement as recorded under Auditor's File Number 355676. 15.) A site specific erosion control plan dated May 17, 2000 has been prepared by NTI for the septic/drainfield for Lot 2. This waiver from the provisions of the Jefferson County Interim Critical Areas Ordinance is granted subject to the following conditions. Any deviation from these conditions shall result in this waiver being revoked and the application becoming subject to further review. CONDITIONS OF APPROVAL: 1.) Applicant shall fully and completely adhere to all the conditions and requirements of the eagle habitat management plan dated June 15, 1992 titled "An Assessment of Wildlife Species and Habitats for the Middle Point Land Conservancy Property"as prepared by Resources Northwest, Inc. 2.) A vegetive buffer of 200 feet shall be permanently maintained from the top or edge of the landslide hazard area. All buffers shall be measured perpendicularly from the top of the landslide hazard area shoreline bluff. 3.) Landslide hazard areas and their associated buffers shall remain naturally vegetated. No structures within 200 feet of the top of the bank shall be allowed. Structures are identified as decks, viewing decks, gazebos, fences, beach access systems, septics and drainfields. The following uses are prohibited within the 200 foot buffer from the top of the bank: no hunting or discharge of fire arms, no lawns, agriculture or livestock grazing, no use of motorized vehicles, and no unleashed pets. 4.) In the older mature coniferous forest area and easterly conservation easement areas, no timber harvest or firewood cutting, except as referenced above, or to construct wells and septic drainfields on the easterly portion of the property that other provisions of the conservation easement are met. 5.) All applications for development proposals including building permits for construction of residences, and appurtenant structures shall submit an erosion and sedimentation control plan which meets the requirements of the Jefferson County Department of Community Development. Per Auditor's File Number, a maintenance agreement and restrictive covenant has been entered into with Jefferson County for purposes of maintenance of the approved stormwater system. 6.) Any proposed changes to the soil erosion and water pollution/flood control plans shall be submitted to the County, approved by the County, and implemented by the contractor prior to disturbing any soil on the site. Submittal and approval of those plans shall preclude any construction activity. 7.) No permanent infiltration galleries shall be utilized as part of the construction temporary erosion control and water pollution/flood activities. 8.) All permanent storage and retention/detention areas used as part of the temporary erosion control and water pollution/flood activities and conveyence systems shall be cleaned of all silts, sand and other materials following completion of construction and the permanent facilities shall then be completed including permanent infiltration areas. 9.) All disturbed areas shall receive temporary and permanent erosion control in the form of vegetation establishment such as grass seeding. A means shall be established to protect the permanent storm drain system prior to establishment of the permanent erosion control measures. 10.) All erosion and sediment control Best Management Practices shall be selected, constructed, and maintained in accordance with the Washington State Department of Ecology STORMWATER MANAGEMENT MANUAL FOR THE PUGET SOUND BASIN (current edition). • • 11.) , The construction and maintenance of erosion and sediment control measures shall be the responsibility of ' the contractor. The contractor shall not deviate from'the approved plans without prior approval from Jefferson County Department of Community Development. The contractor shall have a set of approved plans on the site whenever construction is in progress. 12.) The erosion and sediment control measures depicted on the plan (dated 5/17/00 as prepared by NTI)are minimum requirements to meet anticipated site conditions. As conditions dictate during construction, the contractor shall consider whether additional measures are necessary to ensure erosion and sediment control. 13.) Construction vehicle access shall be limited to one route, whenever possible, quarry spalls or crushed rock shall be applied to the access in order to prevent sediment from being transported onto roads. If this should occur, roads shall be cleaned thoroughly by shoveling or sweeping. 14.) Clearing shall be phased so that only areas that are being worked are exposed. All exposed and unworked soils shall be stabalized by appropriate Best Management Practices. From October 1 through April 30, unworked soils shall not be left exposed for more than 2 days. From May 1 through September 30, unworked soils shall not be left exposed for more than 7 days. 15.) All erosion and sediment control measures shall be maintained in a satisfactory condition until such time as land disturbing activities are completed and the potential for onsite erosion has passed. 16.) The contractor shall request inspection of temporary erosion and sediment control measures by the Jefferson County Department of Community Development (379-4450)as soon as practicable after installation. 17.) Drainage from roof and paved yard areas should not be allowed to concentrate but should be distributed north and south into adjacent areas as evenly as possible. 18.) All construction activities, including the storage and preparation of materials, shall not encroach upon the designated 200 foot setback from the top of the bank. 19.) Vegetation retained on-site following completion of clearing for roadways, utilities and the like, may be cleared only if such clearing is absolutely necessary to complete the proposal (Note: This condition shall not be construed as allowing removal of native vegetation within a designated critical area or its associated buffer). 20.) All trees and understory lying outside of approved construction limits shall be retained during clearing for roadways and utilities. Understory damaged during approved clearing operations may, however, be pruned. 21.) A minimum setback of 200 feet shall be permanently maintained as a fish and wildlife habitat area buffer associated with the shoreline. The 200 foot setback shall be consistent as shown on the face of the recorded Middlepoint Land Conservancy Large Lot Subdivision per Auditor's File Number 355679. 22.) Fish and wildlife habitat area buffers shall remain naturally vegetated. 23.) Clearing for the homesite shall be limited to 0.5 acres including driveways. 24.) Within older mature coniferous forest areas, no more than 5 percent of the trees shall be cut and thinning shall be restricted to surpressed trees.
