FINDINGS AND CONDITIONS OF APPROVAL AS REQUIRED UNDER THE
JEFFERSON COUNTY INTERIM CRITICAL AREAS ORDINANCE

FINDINGS:
In accordance with the authority provided under subsection 4.101 and the requirements contained in Subsection
5.402 of the Jefferson County Interim Critical Areas Ordinance, the following are findings of fact relating to the
referenced application:
1.) The application was reviewed by Jefferson County Permit Center staff on 11/07/00 for the potential
presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas
were confirmed as potentially present on the subject property: Shoreline (suburban), Floodplain, Streams,
Seismic Hazard Area, and Aquifer Recharge Area.
2.) Acting upon the above information, Jefferson County staff conducted a site inspection of the subject
property on 2/24/99 and confirmed the existence of the following critical areas and/or their associated
buffers on the property: Floodplain, Shoreline, and Susceptible Aquifer Recharge Area.
3.) A Flood Elevation Certificate was submitted in conjunction with this application.
4.) Aquifer recharge areas in Jefferson County are characterized by porous geologic formations that allow
percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic
formations that contain sufficient saturated permeable material to yield significant quantities of water to
wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of
Jefferson County.
5.) Susceptible aquifer recharge areas are those with geologic and hydrologic conditions that promote rapid
infiltration of recharge waters to groundwater aquifers. This includes any portion of Jefferson County with a
DRASTIC index of greater than or equal to 180 points as determined using the U.S. Environmental
Protection Agency DRASTIC methodology: Drastic:A Standardized System for Evaluating Ground Water
Pollution Using Hydrogeologic Settings (EPA 600/23-87-035).
6.) This waiver also includes findings and conditions for evaluation of shoreline areas as regulated under the
provision of The Jefferson County Shoreline Management Master Program, adopted March 7, 1988, as
amended.
7.) The standard setback for residential structures, including common appurtenant structures such as garages
and workshops, shall be 30 feet, or 1 foot for each foot of bank height, whichever is greater. This setback
shall be measured from the bank's edge when the bank height exceeds 10 feet. This proposal is located on
low back shoreline, which requires a 30-foot setback. The applicant's proposal indicates a setback of
85-feet from Port Townsend Bay,end 65-feet fmm Hadlock_Lagoon.
8.) Attached for reference, are applicable requirement and policies of Ordinance No. 18-1120-95; sections
4.101 and 5.20.

, flaming conditions. Any deviation from these conditions shall result in this waiver being revoked and the
application becoming subject to further review.
CONDITIONS OF APPROVAL:
1.) A fish and wildlife habitat buffer zone associated with the shoreline shall be permanently maintained on the
property. The buffer zone shall be measured from the ordinary high water mark (OHWM) along the
shoreline to a perpendicular line 30 feet landward of the OHWM.
2.) Fish and wildlife habitat area buffers shall remain naturally vegetated. Should buffer disturbance occur
during construction, replanting with native vegetation shall be required by the Critical Area Administrator.
No alteration shall be made to the fish and wildlife habitat area buffer without prior authorization by the
Critical Area Administrator.
3.) All construction activities, including the storage and preparation of materials, shall not encroach upon the
designated fish and wildlife habitat area, its associated buffer, or any critically important plants and trees
identified on the subject property.
4.) Residential structures shall not exceed thirty-five (35)feet in height.
5.) The applicant shall apply for a shoreline permit exemption for the installation of a stormwater tight-line prior
to construction of any structures.
6.) A flood area certificate is required for all development in the floodplain. The flood certificate shall be
completed by a licensed surveyor and shall include a written and graphic portrayal of the following
information: a. the location of the subject property in relation to the flood hazard area; b. the distances of
the property and the proposed activity from the edge of the waterway; c. the height of the base flood (in
relation to mean sea level)within the vicinity of the proposed activity; d. the height of the subject property
(in relation to mean sea level).
7.) Flood proofing measures are to be used as required by the Jefferson County Flood Damage Prevention
Ordinance.
8.) All new construction shall use construction methods which minimize flood damage.
9.) New construction shall have the lowest floor elevated to at least one foot above base flood elevation.
10.) Fully enclosed area below the lowest floor that are subject to flooding are prohibited unless designed to
automatically equalize hydrostatic flood forces on exterior walls by allowing for the entry and exit of
floodwater. Designs for meeting this requirement must either be certified by a registered professional
engineer or architect or must meet or exceed the following criteria: a. A minimum of two openings having a
total net area of not less than one square inch for every square foot of enclosed area subject to flooding
shall be provided. b. The bottom of all openings shall be no higher than one foot above grade. c. Openings
may be equipt with screens, louvers, or other coverings or devices provided that they permit the automatic
entry and exit of floodwater.
11.) All new construction shall: a. be anchored to prevent flotation, collapse, or lateral movement of the
sturcture. b. be constructed with materials and utility equipment resistant to flood damage and potential
damage to adjacent properties. c. be constructed using methods and practices that minimize flood damage.
d. have structural components capable of resisting hydrostatic and hydrodynamic loads and the effects of
buoyancy. e. electrical, heating, ventilation, plumbing, air-conditioning equipment, and other service
facilities shall be designed and/or otherwise elevated or located so as to prevent water from entering or
accumulating within the components during conditions of flooding.
12.) Flood proofing of structures shall be provided by one or more of the following methods: a. Landfill: (Note:
Landfills are not permitted in the floodway.)The placement of fill may be utilized to elevate the structure and
must comply with the standards and policies of the Jefferson-Port Townsend Shoreline Management
Master Program, if applicable. b. Pole, pier or piling construction: The use of poles, piers, or piles for the
foundation of the structure may be used to allow the unrestricted flow of flood waters during periods at a
base flood. The lowest floor must be one foot above the base flood level. c. Parallel Foundation Walls:
Foundation walls may be designed and constructed to provide open spaces through which water can flow
unrestricted to equalize pressure. In velocity flood situations, it is important that all foundation walls be
parallel to the flow of the floodwaters. d. Extended Foundation Walls and Basements: (Note: Extended
foundation walls and basements are not permitted in the floodway.)The lowest habitable floor of a
residence may be constructed on foundation walls that extend above grade to one foot above the height of
the base flood provided that residential construction complies with the requirment of Section 5.101(2),
"Residential Construction," regarding the design of enclosed areas.
13.) Utilities shall be designed as specified in Section 5.20 of Ordinance No. 18-1120-95.
