Prior to issuance of the Jefferson County Building Permit and Jefferson County Sewage Disposal Permit, the applicant will be required to sign a waiver, "Findings and Conditions of Approval"which will require the following: a. The applicant shall develop and submit to the Permit Center for approval a "Small Parcel Erosion and Sediment Control Plan". Once the subject permit has been issued, the applicant shall fully implement the provisions of the submitted "Small Parcel Erosion and Sediment Control Plan."A final building inspection will not be performed until the Permit Center verifies plan compliance. b. Authorized clearing for the proposal shall be the minimum necessary to accomplish the project. c. A vegetative buffer of 30 feet shall be permanently maintained from the top or edge of the landslide hazard area. All buffers shall be measured perpendicularly from the top of the landslide hazard area. d. All construction activities, including the storage and preparation of materials, shall not encroach upon the designated geologically hazardous area, or its associated buffer. e. A thirty-foot buffer area consisting of native vegetation shall be required along the top of the shoreline bank. Prior to final building inspection, Development Review staff shall inspect this thirty-foot buffer area to assure this condition has been met. Please phone 360-379-4450 to arrange the inspection. f. Once established, the landslide hazard area buffer shall be retained in its natural condition. Minor pruning of vegetation to enhance views may be permitted by the Administrator on a case-by-case basis. g. Landslide hazard areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Areas Administrator. h. Surface drainage shall not be directed across the face of a marine bluff, landslide hazard or ravine. i. Residential structures shall not exceed thirty-five (35) feet in height. j. The applicant shall carry out stair/path construction consistent with the mitigative measures detailed in-the General Recommendations section of the geotechnical report authored by Jane N. Myers, P.E. of Myers Biodynamics, Inc. and entitled "Slope Evaluation, Cohen-Sapida Property-Adelma Beach Road, Jefferson County, Washington." 2.) Proper disposal of construction debris must be on land in such a manner that debris cannot enter the water body or cause water quality degradation of state waters. 3.) In order to minimize visual impact, the staircase shall be constructed to harmonize with the local shoreline environment to the maximum extent practicable. The structure shall be constructed of wooden material which will weather and blend with the existing shoreline bank and can be painted, if necessary, to further minimize visual impact. 4.) Construction shall be in substantial compliance with the site plan submitted to Jefferson County on January 10, 2000 and dated December 27, 1999 (Log Item#15) as it exists now or is hereafter amended by Jefferson County and/or the Department of Ecology. 5.) No fill or other material may be placed in the waters or intertidal areas of Jefferson County. 6.) NOTICE: 1. This permit may be rescinded by the Jefferson County Hearing Examiner or the Washington State Shorelines Hearings Board upon finding that the permittee has not complied with the conditions herein, pursuant to RCW 90.58.140(8). 2. The permittee is liable for all damages to public and private property arising from violation of any provisions of the permit hereby granted, including the cost of restoring the affected area to its condition prior to violation and possible court costs that may ensue from violation, pursuant to RCW 90.58.230. 3. Construction pursuant to this permit will not begin nor is it authorized until twenty-one (21) days from the date of filing as defined in RCW 90.58.140(5)(6) and WAC 173-14-090 or until all review proceedings initiated within twenty-one days from the date of such filing have terminated, except as provided in RCW 90.58.140(5a-c). Construction or substantial progress toward construction of the permitted development shall begin within two (2) years from the date of this permit and completion of the permitted development shall be accomplished within five (5) years from the date of this permit. 4. Nothing in this permit shall excuse the permittee from complying with any other federal, state, or local statutes, ordinances, or regulations applicable to this project, but consistent with RCW 90.58.
