In the Matter of Appointment of Andrew
William Pernsteiner as Sheriff for Jefferson RESOLUTION NO. 15 0 2 2 4-2 5 R
County to fill the vacancy
WHEREAS,the retirement of Sheriff Joe Note on January 3, 2025 has created a vacancy
in the office prior to the expiration of his term; and
WHEREAS,Article II, § 15 (Amendment 52) of the Washington State Constitution
designates the Jefferson County Board of County Commissioners as the appointing authority to
fill vacancies in the County's partisan non judicial offices; and
WHEREAS, Article II, $ 15 (Amendment 52) of the Washington State Constitution sets
forth the procedure for filing vacancies in Jefferson County partisan non judicial offices; and
WHEREAS, on February 1, 2025 the Jefferson County Democrats' Central Committee
submitted three nominations for Sheriff to the Jefferson County Board of County Commissioners;
and
WHEREAS, on February 24, 2025 Jefferson County Board of County Commissioners
having reviewed materials submitted by the candidates and the Commissioners having individually
interviewed the candidates, held a meeting open to the public for deliberations regarding
appointment of the Sheriff; and
NOW, THEREFORE, THE BOARD OF COUNTY COMMISSIONERS OF
JEFFERSON COUNTY,WASHINGTON,HEREBY RESOLVE AS FOLLOWS:
Section 1. Whereas Clauses are Findings of Fact. The Jefferson County Board of Commissioners
hereby adopts the above "Whereas"clauses as Findings of Fact.
Section 2. Purpose. The purpose of this resolution is to appoint a Sheriff for Jefferson County to
fill the vacancy.
Section 3.Appointment of Sheriff. Andrew William Pernsteiner is hereby appointed as Sheriff for
Jefferson County to fill the vacant position.
Section 4. Severability. If any section, subsection, sentence, clause, phrase or section of this
Resolution or its application to any person or circumstance is held invalid, the remainder of this
Resolution or its application to other persons or circumstances shall be fully valid and shall not be
affected.
Section 5. SEPA Categorical Exemption. This Resolution is categorically exempt from the State
Environmental Policy Act under WAC 197-11-800 (19).
Section 6. Effective Date. This appointment shall take effect and be in full force immediately
upon passage of this Resolution by the Board of County Commissioners.
