The application was reviewed by Jefferson County Permit Center staff on 12/22/00 for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: Wetlands, Seismic Hazard Area, Streams (Type 3 & 9), and Landslide Hazard Area I and II. 2.) Acting upon the above information, Jefferson County staff conducted a site inspection of the subject property on 11/08/00 and confirmed the existence of the following critical areas and/or their associated buffers on the property: Wetlands and Streams (Type III). 3.) The applicant submitted a Wetland Delineation Report in conjunction with their application. The report conducted by Olympic Wetland Resources concluded the wetlands to be Class II Wetlands, thus requiring a 50-foot buffer. 4.) In addition to the Wetland Delineation Report the applicants also submitted a Buffer Averaging Plan which included a Buffer Enhancement Plan. The application requests to utilize buffer averagingdue to the topographical constraints on the property to establish the building envelope. 5.) The applicant is proposing to average 950 square feet of wetland area. The proposal reduces the standard setback south of the proposed building envelope down to 30-feet, and adds wetland buffers on the eastern edge of the property. This waiver from the provisions of the Jefferson County Interim Critical Areas Ordinance is granted subject to the following conditions. Any deviation from these conditions shall result in this waiver being revoked and the application becoming subject to further review. CONDITIONS OF APPROVAL: 1.) A setback of 30-feet has been granted by the Jefferson County Critical Areas Administrator to utilize buffer averaging. The buffer averaging , measured perpendicularly from the wetland edge, shall be permanently maintained as a buffer. No filling, grading, clearing or other alteration of the wetland or its buffer is allowed. 2.) No alteration shall be made to the wetland or its buffer without prior authorization by the Critical Area Administrator. Buffer enhancement is allowed as long as native species are selected for planting as specified through the submitted vegetation plan. 3.) Prior to and during approved construction activities, the perimeter of the wetland buffer shall be marked with a temporary sign. The sign shall be placed in such a manner that it can be directly observed from the construction area. The sign shall contain the following statement: "Wetland and Buffer- Do not Remove or Alter Existing Native Vegetation." The applicant shall permanently separate the upland boundary of the wetland buffer from the remainder of the subject property through installing and maintaining one of the following; logs, trees, a hedge row,or `` _ = other prominent physical marking. The separation method identified by the applicant shall be approved by the Critical Area Administrator prior to planting or installation. 5.) All construction activities, including the storage and preparation of materials, shall not encroach upon the designated wetland, or its associated buffer. 6.) A setback (buffer) of 25-feet, measured perpendicularly from the ordinary high water mark along the bank of the Type III Stream (Naylor Creek) shall be permanently maintained as a fish and wildlife habitat area. 7.) Fish and wildlife habitat area buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Area Administrator. No alteration shall be made to the fish and wildlife habitat area buffer without prior authorization by the Critical Area Administrator. 8.) All construction activities, including the storage and preparation of materials, shall not encroach upon the designated fish and wildlife habitat area, its associated buffer, or any critically important plants and trees identified on the subject property. 9.) The applicant shall follow the revegetation plan submitted by Olympic Wetland Resources. The Plan stipulates the following: Area A is located south of the proposed building envelope. Area A will consist of 8 groupings of 4 species of shrubs (65 shrubs to be planted in Area A). Area B is located southeast of the proposed building envelope.
