The application was reviewed by Jefferson County Permit Center staff on 1/12/01 for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: Landslide hazard areas(low to severe), Eagle Habitat, Susceptible Aquifer Recharge Area, Erosion hazard area, and Shoreline, and stormwater. 2.) A geotechnical report was not submitted in conjunction with this application,however, the applicant references a report for associated SEP00-00230 permit submitted for Lot 7 (three lots north of this proposal). The Geological evalulation conducted on Lot 7 in Tala Point Estates rendered a recommendation of a minimum 175 foot setback from bluff edges to prevent accidental falls. The proposed building site is located 255 feet from the top of the bluff, therefore, shoreline jurisdiction does not apply. 3.) Aquifer recharge areas in Jefferson County are characterized by porous geologic formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 4.) The potential for an earthquake of a high magnitude occurring in western Washington in the near future is considered a high probability by regional experts. 5.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 6.) These bluffs are considered unstable and are subject to catatrophic slides. The potential for an earthquake of a high magnitude occuring in western Washington in the near future is considered a high probability by regional experts. 7.) The bluff height is 95 feet. The required setback from the top of the bluff is 95 feet as stipulated through the Jefferson County Shoreline Management Master Program. 8.) A Bald Eagle Site Management Plan (BEMP) has been developed between the applicant Al Ruhmann and WDFW biologist Shelly Ament dated 11/9/00 which has conditionally allowed construction of a new 3-bedroom residence with an attached garage as depicted on the site plan included in the Management Plan. All conditions listed in the BEMP shall be followed in addition to conditions in this waiver. 9.) CONDITIONS OF APPROVAL: 1.) Landslide hazard areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Area Administrator. No alteration shall be made to the landslide hazard area or its associated buffer without prior authorization by the Critical Area Administrator. 2.) All construction activities, including the storage and preparation of materials, shall not encroach upon the designated geologically hazardous area, or its associated buffer. 3.) Damage to vegetation to be retained on site shall be minimized by directional felling of trees away from these areas. 4.) All trees and understory lying outside of approved construction limits shall be retained during clearing for roadways and utilities. Understory damaged during approved clearing operations may, however, be pruned. 5.) Clearing limits for roads, septic, water and stormwater utilities, and temporary erosion control facilities shall be clearly identified on site and inspected by the Critical Area Administrator, or their designee, prior to the commencement of any clearing-activities. 6.) Clearing for roads and utilities shall remain within marked limits. 7.) No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures has been completed. 8.) Applicant shall fully and completely adhere to all the conditions and requirements of the eagle habitat management plan which have been agreed upon between the applicant and the Washington State Department of Fish and Wildlife. 9.) The proposed development shall be located on the subject property exactly as identified on the Universal Plot Plan, or other Site Plan, approved by the County as part of the triggering permit application. Applicant shall be responsible for contacting and notifying contractor(s) of the above conditions in order to ensure compliance at various stages of construction/development. 10.) The applicant shall fully implement the provisions of the submitted "Small Parcel Erosion Control Plan."
