FINDINGS:
1.) The Administrator finds that this application complies with applicable provisions of the Unified Development
Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County
Comprehensive Plan and Land Use map.
2.) The application was reviewed by the Jefferson County Department of Community Development staff on 1/30/0
for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified
Development Code (UDC). After an initial Geographic Information Systems mapping review and an
investigative site inspection, the following ESAs were confirmed to be present on the subject property:seismic
hazard, and moderate landslide hazard.
3.) A site visit was conducted to determine the setback to the mapped geohazard area on 2/1/01. The structure for
which applicant sought a permit had been constructed without a building permit and was located at the top of
the slope (ie zero setback from the landslide area).On 2/5/01, a Notice of Voluntary Correction was sent for
building without a permit and locating a structure within a Geologically Hazardous Area and its associated 30
foot buffer.Also on 2/5/01 a Correction Notice was placed on the structure by the Jefferson County Building
Division to stop all further construction. A compliance meeting was held with Al Scalf, Building Official, during
which Grady agreed to remove approximately 16 feet of the unpermitted structure even with the plane of the
existing permitted residence. Jefferson County would then issue a building permit to complete the modified
structure. Grady submitted a signed agreement on 2/22/01 detailing his intention to remove the portion of the
addition that extends past the plane of the existing residence. As the proposed structure is still within the 30 fod "
geohazard buffer measured from the top of the slope, a Hold Harmless Agreement was filed on 3/28/01
(AFN#442139)to allow for permitting and completion of the modified structure while relieving Jefferson County
of liability as detailed in the Hold Harmless Agreement. Revised structural plans and site plans were submitted
3/27/01.
4.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and
groundwater that may combine to create problems with slope stability, erosion, and water quality during and
after construction or during natural events such as earthquakes or severe rainstorms.
5.) On 3/25/01 a site visit was perfomed by Jefferson County staff to determine compliance with the conditions
agreed to; namely removal of unauthorized 16 foot section of addition. Substantial compliance was observed,
with the exception of final removal of decking and revegetation measures required. Removal of the remaining
decking and foundation piers will be a required condition of this building permit and issuance of certificate of
occupancy.
CONDITIONS:
1.) This approval is for a RESIDENTIAL ADDITION only. Any future permits on this site are subject to review for
consistency with applicable codes and ordinances and does not preclude review and conditions which may be

placed on future permits.
2.) The revised site plan as submitted with the building application on 3/27/01 has been reviewed for consistency
under the UDC and has been approved by Jefferson County DCD. Any modifications, changes, and/or additions
to the stamped, approved site plan dated 4/5/01 shall be resubmitted for review and approval by Jefferson
County.
3.) Prior to and during approved construction activities, the perimeter of the landslide hazard area buffer shall be
marked with a temporary sign. The sign shall be placed in such a manner that it can be directly observed from
the construction area. The sign shall contain the following statement: "Landslide Hazard Area and Buffer- Do
not Remove or Alter Existing Vegetation."
4.) The applicant shall remove all foundations, footings, and remaining decking and building matererials and replant
and restore the area disturbed between the current building edge and the top of the slope of the landslide area
prior to issuance of final certificate of occupancy.
5.) Maximum lot coverage is not to exceed 25%.
6.) The building height is not to exceed 35 feet.
NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances,
regulations, or statutes applicable to the proposed development.
Development pursuant to this permit shall be undertaken subject to the applicable development and performance
standards of the Jefferson County Unified Development Code.
If during excavation or development of the site an area of potential archaeological significance is uncovered, all
activity in the immediate area shall be halted, and the Administrator shall be notified at once.
The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became
effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any
person may bring lawsuit against any individual or agency that"takes" listed species(defined as causing harm,
harassing, or damaging habitat for the listed species). In addition,the National Marine Fisheries Service can levy
penalties. All areas in Jefferson County are included as "critical habitat"fora listed species. Development of
property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures
are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine
shoreline, freshwater shoreline, or floodplains are advised to do the following:
-Set back buildings, utilities and roads as far as possible from surface waters (streams, rivers, lakes, marine
waters), or at least 150 feet from the edge of the water
-All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters
- Remove minimal vegetation for site development, especially large trees
-Allow trees that have fallen into surface waters to remain there
- Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into
surface waters or roadside ditches
Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with
Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a
professional fisheries habitat biologist, and following the recommendations for site development provided by the

SPECIAL CONDITIONS FOR CASE BLD01-00057
1.) The application was reviewed by the Jefferson County Department of Community
Development staff on 1/30/01 for the potential presence of Environmentally Sensitive
