Binding Advance Determination (CAR00-00288)with eight conditions was signed by the applicant on 8/14/00 and approved by the Critical Area Administrator on 8/16/00. 5.) Septic permit(SEP00-00214)with nineteen conditions was issued on 10/16/00 by Jefferson County Environmental Health Department. The permit expires on 10/16/03. 6.) A Notice to Title has been recorded (AFN 437690)to combine Lot 19 and west half of Lot 20 of Ludlow Beach Tracts to meet WAC 246-272 Minimum Land Area for issuance of an onsite sewage system permit. 7.) The site plan dated 3/7/01 and received on 3/8/01 identifies a 46 foot building setback from the top of the bank to the single family residence. 8.) The site plan dated 3/7/01 and received on 3/8/01 identifies that stormwater will be addressed on site and that an infiltration trench and bio-swale will be located in front of the single family residence with a tightline located on the western boundary. 9.) The site plan dated 3/7/01 and received on 3/8/01 identifies the proposed driveway located at the southwest corner of the parcel and then angeled to the northeast and eventually north to the proposed garage. Per discussion with Terry Duff(PWD) the road approach as identified on the site plan coincides with her site visit and discussion with applicants representative. CONDITIONS: 1.) Ludlow Bay Road is a local access road that requires a minimum 20 foot setback. Side setbacks are 5 foot minimums. The site plan identifies a 46 foot setback from the top of the slope to the foundation of the single family residence. 2.) Residential developers and individual builders shall be required to preserve shoreline vegetation and reduce the associated risk of erosion during construction and any future activity which may impact the stability of the shoreline. 3.) The building height shall not exceed 35 feet. 4.) Maximum lot coverage shall not exceed 25%. 5.) A minimum setback of 30 feet shall be permanently maintained as a fish and wildlife habitat area buffer associated with the shoreline. This buffer shall be measured perpendicularly from the ordinary high water mark along the shoreline. ' 6.) All construction activities, including the storage and preparation of materials, shall not encroach upon the designated fish and wildlife habitat area, its associated buffer, or any critically important plants and trees identified on the subject property. 7.) The applicant shall permanently separate the boundary of the fish and wildlife area buffer from the remainder of the subject property through installing and maintaining one of the following; logs, trees, a hedge row, or other prominent physical marking. the separation method idnetified by the applicant shall be approved bythe Critical Area Administrator prior to planting or installation. 8.) A minimum of two (2) on-site parking spaces are required for single family residences. 9.) The site plan as submitted on March 8, 2001 has been reviewed for consistency under the UDC. The site plan has been approved by Jefferson County. Any modifications, changes, and/or additions to the stamped approved site plan dated March 9, 2001 shall be re-submitted for review and approval by Jefferson County. 10.) There shall be no discharge of stormwater or the like over the top of the slope. 11.) Applicant shall adhere to all conditions of the Septic Permit, SEP00-00214. NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development. Development pursuant to this permit shall be undertaken subject to the applicable development and performance standards of the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes"listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are induded as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -Set back buildings, utilities and roads as far as possible from surface waters(streams, rivers, lakes, marine waters), or at least 150 feet from the edge of the water -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches Any individual, group, or agency can bring suit for a listed species "taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist.
