SPECIAL CONDITIONS FOR CASE # BLD01-00129:
1.) The proposal will remove an existing residence that has been vacant since 1994, and
restore the property back to natural riverine habitat.
2.) The submitted proposal has identified a "work zone"which utilizes already existing
impervious surface. The proposal will remove all exisiting human development which
consists of a septic system, buildings, concrete slabs, a driveway, and a above ground oil
tank. Once the development is removed, then the dike will be relocated and the property
will be replanted with native vegetation.
3.) The application was reviewed by the Jefferson County Department of Community
Development staff on 12/15/00 for the potential presence of Environmentally Sensitive
Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an
initial Geographic Information Systems mapping review and an investigative site
inspection, the following ESAs were confirmed to be present on the subject property:
Flood Hazard (Zone A Floodplain), Wetlands, and Shoreline.
4.) The project has identified a "work zone"which will be the primary area for all heavy
equipment and machinery. The work zone shall utilize the existing impervious surface
and no additional areas will be altered or disturbed. Upon completion of removing the
existing buildings and development(identified as Phase II), the applicant will implement
Phase III which consists of restoration of the floodplain and wildlife habitat. Because the
application is not proposing development, and the existing development will be removed
and the floodplain and wildlife habitat restored the proposal will not be required to
implement provisions for wetlands or floodplains identified through Section 3 of the
Jefferson County Unified Development Code.
5.) The applicant is proposing to remove all existing development and impervious surface.
Based on the amount of removal activity, the applicant submitted a Small Parcel Sediment
and Erosion Control Plan. The plan identifies phasing the project and reseeding with a
mix of grass seed and 2-inches of straw. Upon completion of Phase II, the applicant shall
submit a Buffer Enhancement(Re-Vegetation) Plan, which shall identify the materials and
methods utilized to restore the disturbed area.
6.) The applicant shall adhere to the provisions identified in the submitted Small Parcel
Sediment and Erosion Control Plan submitted by Jefferson County Public Works on
March 1, 2001. Prior to undergoing Phase III of the project the applicant shall submit a
detailed Buffer Enhancement (Re-Vegetation) Plan identifying all methods and materials
utilized to restore the area to its natural raverine habitat.
7.) The demolition project shall stay within the work zones identified through the submitted
site plan dated March 1, 2001, which was approved by the Department of Community
Development on March 26, 2001.
8.) Loading and unloading must occur on site (off-street).
9.) All noise emitting machinery that cannot in any other way operate below the maximum
permitted noise level shall be housed in a sound-attenuating structure.
10.) Residential developers and individual builders shall be required to preserve shoreline
vegetation and reduce the associated risk of erosion during construction and any future
activity which may impact the stability of the shoreline.
11.) The storage and handling of inflammable liquids, liquified petroleum, gases and
explosives shall comply with rules and regulations falling under the jurisdiction of the fire
marshal, the laws of the state and other local ordinances. Bulk storage of inflammable
liquids below ground shall be located no closer to the property line than the greatest
dimension (diameter, length, or height) of the tank.

FINDINGS:
1.) The Administrator finds that this application complies with applicable provisions of the Unified Developmen
Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County
Comprehensive Plan and Land Use map.
2.) The proposal will remove an existing residence that has been vacant since 1994, and restore the property back
to natural riverine habitat.
3.) The submitted proposal has identified a "work zone"which utilizes already existing impervious surface. The

NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal
ordinances, regulations, or statutes applicable to the proposed development.
Development pursuant to this permit shall be undertaken subject to the applicable development and performance
standards of the Jefferson County Unified Development Code.
If during excavation or development of the site an area of potential archaeological significance is uncovered, all
activity in the immediate area shall be halted, and the Administrator shall be notified at once.
The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon
became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA,
any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing
harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service
can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species.
Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if
protective measures are not taken. To minimize the potential to damage habitat, all property owners developing
adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following:
-Set back buildings, utilities and roads as far as possible from surface waters (streams, rivers, lakes, marine
waters), or at least 150 feet from the edge of the water
-All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters
- Remove minimal vegetation for site development, especially large trees
-Allow trees that have fallen into surface waters to remain there
- Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into
surface waters or roadside ditches
Any individual, group, or agency can bring suit for a listed species "taking", even if you are in compliance with
Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a
professional fisheries habitat biologist, and following the recommendations for site development provided by the

Pursuant to RCW 36.70C, the applicant or any aggrieved party may appeal this final decision to Jefferson County
Superior Court within twenty-one (21) calendar days of the date of issuance of this land use decision. For more
information related tojudical appeals see UDC Section 8.5.2.
