The applicant is apply to construct stairs to the beach. This project has been previously reviewed under the Jefferson County Shoreline Master Program (Case#SDP00-00022). A decision of approval was written and included a list of conditions prior to the commencement of construction. 2.) The application was reviewed by the Jefferson County Department of Community Development staff on 11/29/00 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Shoreline (Suburban), and Stormwater. 3.) The applicant is proposing to construct a set of stairs down to the beach. The shoreline decision (SDP00-00022) stipulated conditions which included the submission of a Small Parcel Sediment and Erosion Control Plan. 4.) A Small Parcel Sediment and Erosion Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 5.) The site plan as submitted with the application on April 21, 2001 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated May 4, 2001 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 6.) The building height is not to exceed 35 feet. 7.) The standard setbacks required from the shoreline do not apply due to a review and decision rendered through SDP00-00022. 8.) Residential developers and individual builders shall be required to preserve shoreline vegetation and reduce the associated risk of erosion during construction and any future activity which may impact the stability of the shoreline. 9.) The Shoreline Permit was reviewed for Eagles. A Critical Area Review (CAR00-00390) and a Shoreline Permit (SDP00-00022) review was conducted on the subject property. Shelly Ament from the Department of Fish and Wildlife found no conflict with the proposed development and the proximity of the eagles nest. 10.) The applicant must adhere to all of the conditions rendered through the Shoreline Permit (SDP00-00022). In addition, all of the disturbed areas along the shoreline bluff must be replanted with native vegetation. NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development. Development pursuant to this permit shall be undertaken subject to the applicable development and performance standards of the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes"listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are induded as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -Set back buildings, utilities and roads as far as possible from surface waters(streams, rivers, lakes, marine waters), or at least 150 feet from the edge of the water -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches Any individual, group, or agency can bring suit for a listed species "taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. The first is the placement of a protective feature, Shotcrete, on a bank face to seal the surface and prevent further erosion for the purpose of protecting an existing single-family residence. The Shotcrete will be placed in an area landward and above the Ordinary High Water Mark (OHWM). The second project is the installation of a deck on a basalt bench above the OHWM for the purpose of storing hand-powered watercraft. The deck will include a short set of steps anchored down the side of the rock to provide access to the beach. Non-toxic materials are proposed for the deck and step construction. The proposal is exempt from review under the State Environmental Policy Act pursuant to WAC 197-11-800(1)(b)(i) and (2)(d). PROJECT LOCATION: Parcel Number 977 400 012, Government Lot 2, in the SW 1/4 of Section 28, Township 29 North, Range 01 East, WM. WATERBODY AND/OR ASSOCIATED WETLANDS: OAK BAY SHORELINE OF STATE-WIDE SIGNIFICANCE: YES SHORELINE DESIGNATION: SUBURBAN Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the following conditions: 1.) Construction shall be in substantial compliance with the site plan and designs submitted to Jefferson County on November 29, 2000 (Log Item 4) and included in the applicant's January 9, 2001 letter to WDFW (Lot Item 21), or as hereafter amended by Jefferson County and/or the Washington Department of Ecology. 2.) The applicant shall follow all provisions of Hydraulic Project Approval issued by the Washington Department of Fish and Wildlife and any other permits/approvals required bf any other agencies. 3.) Proper disposal of construction debris must be on land in such a manner that debris cannot end up on the beach and/or cause water quality degradation of state waters. 4.) Measures shall be taken to prevent the Shotcrete erosion protection material from ending up on the beach and/or causing water quality degradation of state waters. The applicant shall be responsible for compliance with this provision during and after the application of Shotcrete. 5.) The applicant must prepare a Small-Parcel Erosion and Sediment Control Plan prior to further construction, pursuant to the Jefferson County Stormwater Management Ordinance (No. 10-1104-96). Proper erosion and sediment control practices must be used on the construction site and adjacent areas to prevent upland sediments from entering the water body. All areas disturbed or newly created by construction activities must be re-vegetated using bioengineering techniques or equivalent type of protection against erosion. 6.) The boat storage grid (i.e., type of pier) shall be maintained to provide a reasonable level of safety to users. 7.) The boat storage grid (i.e., a type of pier) shall be designed and constructed to minimize hazards to users and to be capable of withstanding the historic extremes of wind, wave, and tides at the location. 8.) Overhead lighting for the boat storage grid structure shall be prohibited. 9.) Railings, if provided, shall be of clear or open framework design and conform to the Uniform Building Code where required. 10.) Prior to any construction and/or land-disturbing activities, the applicant shall submit a Building Permit application and/or stormwater management plan for review and approval. Docks and piers shall be setback a minimum of ten (10) feet from property lines except for joint use docks and piers, which may be located adjacent to or upon a property line when mutually agreed to by contract or covenant with the owners of the adjoining property, a copy of which shall be filed with the County Auditor and submitted with the shoreline permit application. 13.) The design, location, and construction of docks, piers, and floats, as well as their subsequent use, shall avoid adverse effects on fish, shellfish, wildlife, marine vegetation, water quality, and geohydraulic processes. Construction methods shall minimize the use of materials hazardous to the environment. 14.) All lumber and other materials treated with preservative shall be sufficiently cured to minimize leaching into the water or shore bed, in accordance with the Best Management Practices approved by the Washington Department of Fish and Wildlife. 15.) The proponent shall notify the Jefferson County Department of Community Development at (360) 379-4450 forty-eight (48) hours prior to commencing construction in order to allow monitoring and ensure conformance with permit conditions. 16.) The proponent is responsible for contacting the Corps of Engineers to determine whether a Department of the Army (DA) Permit is necessary. A DA permit shall be obtained prior to the performance of any activities waterward of the mark of mean higher high water or in wetlands. NOTICE: This permit may be rescinded by the Jefferson County Hearing Examiner or the Washington State Shorelines Hearings Board upon finding that the permittee has not complied with the conditions herein, pursuant to RCW 90.58.140(8). The permittee is liable for all damages to public and private property arising from violation of any provisions of the permit hereby granted, induding the cost of restoring the affected area to its condition prior to violation and possible court costs that may ensue from violation, pursuant to RCW 90.58.230. Construction pursuant to this permit will not begin nor is it authorized until twenty-one (21) days from the date of filing as defined in RCW 90.58.140(5)(6) and WAC 173-14-090 or until all review proceedings initiated within twenty-one days from the date of such filing have terminated, except as provided in RCW 90.58.140(5a-c). Construction or substantial progress toward construction of the permitted development shall begin within two (2) years from the date of this permit and completion of the permitted development shall be accomplished within five (5) years from the date of this permit.
