The application was reviewed by the Jefferson County Department of Community Development staff on June 5, 2001 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: SUSC aquifer recharge area. 2.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 3.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 4.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 5.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 6.) The site plan as submitted with the single family residence and detached garage building applications on May 11, 2001 have been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated June 13, 2001 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 7.) This approval is for a single family residence and detached garage only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 8.) The building height shall not exceed 35 feet. 9.) Minimum Setback from Gardiner Beach Road shall be 20 feet. Minimum side and rear setbacks shall be 5 feet. 10.) Maximum lot coverage shall not exceed 25%. 11.) Gardiner Beach Road is a county local access road (C502009). A road approach permit (RAP01-0111)was applied for at time of building application and will be issued simultaneously with the building applications. 12.) A septic permit(SEP94-0269)was cancelled on June 25, 1998 for expiration of the permit. 13.) A septic permit(SEP99-0255)was approved on September 24, 1999 for a three bedroom system. 14.) The parcel has been designated as RR 1:5 under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 15.) A minimum of twrti (2) on=site parking spaces are required for the single family residence. 16.) A building permit(BLD01-0269) for a detached garage will be issued simultaneously with this permit. • i:1F_BLD Permit Buildng.rpt 10/29/19 JEFFERSON COUNTY DEPARTMENT OF COMMUNITY DEVELOPMENT UNIFIED DEVELOPMENT CODE TYPE I LAND USE PERMIT APPLICANT: KEITH K DAVIS CONNIE R DAVIS 14609 142ND AVE SE RENTON WA 98059-5523 DATE ISSUED: June 18, 2001 DATE EXPIRES: June 18, 2002 MLA NUMBER: MLA01-00251 PROJECT PLANNER: M FARFAN PROJECT DESCRIPTION: SINGLE FAMILY RESIDENCE SINGLE FAMILY RESIDENCE DETACHED GARAGE ROAD APPROACH & 911-Gardiner Beach Rd PROJECT LOCATION: Parcel number 002 284 035 in Section 28, Township 30, Range 02 West, WM located at Gardiner Beach Rd, WA 98382 FINDINGS: 1.) Development pursuant to this permit shall be undertaken subject to the applicable development and performance standards of the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes"listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -Set back buildings, utilities and roads as far as possible from surface waters(streams, rivers, lakes, marine waters), or at least 150 feet from the edge of the water -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches Any individual, group, or agency can bring suit for a listed species "taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle at (206)526-6613, or the U.S. Fish and Wildlife Service at(503) 231-6121. Pursuant to RCW 36.70C, the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court within twenty-one (21) calendar days of the date of issuance of this land use decision. Please check the measures you plan to implement and show their approximate location on the site plan. You may also propose measures other than those listed. Attach additional sheets, if more space is required. Stabilize construction access route. Limit construction vehicles to one route, if feasible. Provide a stabilized construction access by applying quarry spalls, ballast, or crushed rock to minimize tracking sediment onto roads. (See attached illustration from Stormwater Management Manual.) If sediment is transported onto roads, they will be cleaned thoroughly. Minimize the extent of land disturbing activity and preserve existing vegetation. )14%. EROSION AND SEDIMENT CONTROL WORKSHEET Phase clearing so that only areas that are actively being worked are uncovered. [] Start and complete land disturbing activities and stabilize the site between April 1 and September 30. Stabilization means that disturbed areas will have well-established plant cover or be landscaped to minimize erosion. XStabilize exposed soil Exposed and unworked soil will be covered within 2 days between October 1 and March 31 and within 7 days between April 1 and September 30. Cover exposed soil with a minimum of 2 inches of straw or hay or other material pproved for this purpose. [ ] Cover soil stockpiles with plastic sheeting and locate away from water bodies, roads, and property lines. XPlace gravel base on roads, driveways, and parking areas after clearing and subgrade preparation. CProtect adjacent properties and water bodies from sediment deposition: Place straw or hay bales in ditches and drainage ways down slope from areas of land disturbing activity to filter runoff before it leaves the project site or enters water bodies. (See attached illustrations from Stormwater Management Manual.) [ ] Install a filter fence down slope from areas of land disturbing activity to filter runoff before it leaves the project site or enters water bodies. (See attached illustration from Stormwater Management Manual.)
