SPECIAL CONDITIONS FOR CASE# BLD01-00313:
1.) The application was reviewed by the Jefferson County Department of Community
Development staff on 6/25/01 for the potential presence of Environmentally Sensitive
Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an
initial Geographic Information Systems mapping review and an investigative site
inspection, the following ESAs were confirmed to be present on the subject property:
Susceptible Aquifer Recharge Area, Seismic, and type 1 shoreline.
2.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological
formations that allow percolation of the surface water into the soils and the underlying
zone of saturation. Aquifers are geologic formations that contain sufficient saturated
permeable material to yield significant quantities of water to wells and springs. Aquifers
serve as the source of drinking water within most of the rural portions of Jefferson County.
3.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions
that promote rapid infiltration of recharge waters to groundwater aquifers.
4.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water
quality degradation. The submitted proposal does not require additional aquifer
protection measures. However, during construction the project shall follow the Best
Management Practices (BMPs) and facility design standards as identified and defined in
the Stormwater Management Manual for the Puget Sound Basin (see attached).
5.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater,
erosion and sediment during construction. BMPs shall address permanent measures to
stabilize soil exposed during construction, and in the design and operation of stormwater
and drainage control systems.
6.) Prior to commencing development activity, proponent is responsible for informing the
Washington Department of Fish and Wildlife (WDFW) in order for WDFW to determine
whether this action is subject to the Washington State Hydraulic Code (Chapter 220-10
WAC). Hydraulic Project Approval (HPA) is required for all hydraulic projects, which are
defined as construction or performance of other work that will use, divert, obstruct, or
change the natural flow or bed of any of the salt or fresh waters of the state.
7.) In addition to Jefferson County permit conditions, the project proponent shall comply with
all conditions set forth by the Washington Department of Fish and Wildlife through
Hydraulic Project Approval.
8.) Prior to commencing development activity, the proponent is responsible for informing the
US Army Corps of Engineers(COE) in order for COE to determine whether a Department
of the Army permit or review is required. Generally, review is required for construction
and dredging in or around navigable waters of the US and for work or fill in hydrologically
connected wetlands. Contact the US Army Corps of Engineers, Seattle District
Regulatory Branch, PO Box 3755, Seattle WA 98124, (206) 764-3495, for more
information.
9.) Jefferson County determined that this proposal is categorically exempt from review under
the State Environmental Policy Act(SEPA) pursuant to WAC 197- 11- 800-(2.(ii).
10.) This approval is for a demolition only. Any future permits on this site are subject to review
for consistency with applicable codes and ordinances and does not preclude review and
conditions which may be placed on future permits.
11.) The parcel is a legal non-conforming lot that is designated as Rural Residential (RR 1:5)
under the Jefferson County Comprehensive Plan Land Use Map, effective 8/28/98.

FINDINGS:
1.) The Administrator finds that this application complies with applicable provisions of the Unified Developmen
Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County
Comprehensive Plan and Land Use map.
2.) The application was reviewed by the Jefferson County Department of Community Development staff on June
25, 2001 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the
Unified Development Code(UDC). After an initial Geographic Information Systems mapping review and an
investigative site inspection, the following ESAs were confirmed to be present on the subject property:
Susceptible Aquifer Recharge Area; Seismic Hazard; and Type 1 Shoreline.

5.) A Special Report was not submitted in conjunction with the application to address the Seismic Hazard or Type
Shoreline.
6.) Per the Jefferson County Shoreline Management Master Program, the adjacent shoreline has been designated
'Suburban'. Residential development, including residential additions, are a permitted use in this designation.
7.) The applicant is proposing to create or add zero square feet of impervious surface and zero square feet of land
disturbing activities. An existing carport and two existing storage sheds will be demolished. The proposed new
garage consists of 890 square feet of impervious surface, which is equilvent to the square footage of the
existing carport and the two existing storage sheds. Sections 6.6 and 6.7 of the Jefferson County Unified
Development Code requires that your proposal submit a Stormwater Calculation Sheet. The applicant has
submitted a Stormwater Calculation Sheet.
8.) Jefferson County determined that this proposal is categorically exempt from review under the State
Environmental Policy Act(SEPA) pursuant to WAC 197-11-800 (2)(f) and WAC 197-11-800(1)(ii).
9.) This approval is for demolition of an existing carport and two existing sheds only. Any future permits on this sit
are subject to review for consistency with applicable codes and ordinances and does not preclude review and
conditions which may be placed on future permits.
10.) This approval is for a 308 square foot residential addition (den, storage, new entry & utility room expansion) an
308 square foot new 2-car garage only. Any future permits on this site are subject to review for consistency
with applicable codes and ordinances and does not preclude review and conditions which may be placed on
future permits.
11.) The parcel is a legal non-conforming lot that is designated as Rural Residential (RR1:5) under the Jefferson
County Comprehensive Plan Land Use Map, effective 8/28/98.
12.) A septic system repair permit was approved and made under permit SEP79-00048. It was issued October 24,
1979 and finaled October 10, 1979.
13.) The Olympic Air Pollution Control Authority issued a Notification of Demolition Permit June 13, 2001.
CONDITIONS:
1.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water quality degradation.
The submitted proposal does not require additional aquifer protection measures. However, during construction
the project shall follow the Best Management Practices (BMPs) and facility design standards as identified and
defined in the Stormwater Management Manual for the Puget Sound Basin (see attached).
2.) To help prevent seawater from intruding landward into underground aquifers, all new development activity on
Marrowstone Island, and within 500 feet of any marine shoreline shall be requires to infiltrate all stormwater
runoff, to the maximum extent practicable, onsite.
3.) Stormwater runoff shall be controlled and treated in accordance with best management practices and facility
design standards as identified and defined in the Stormwater Management Manual for the Puget Sound Basin,
as amended and the stormwater provisions contained in Section 6 of the Unified Development Code.
4.) To prevent seawater from intruding into underground aquifers, to reduce non-point source pollution to marine
waters, and reduce the potential for shoreline erosion due to tightline failure, the first and best alternative is
on-site infiltration using drywells or other methods, the second best alternative is upland off-site disposal, and
the least preferred alternative is direct discharge into marine waters through a stormwater tightline. In order to
utilize the least preferred alternative (a stormwater tightline discharging directly into marine waters) applicants
must demonstrate through a geotechnical or similar report prepared by a licensed professional that both on-site
infiltration and upland off-site disposal are not practicable or feasible. The report must include cost figures for
comparison.
5.) Appurtenant structures such as decks, sheds, and stairways shall be located behind the ordinary high water
mark as far as practical and shall meet applicable setbacks. The minimum setback from the ordinary high water
mark shall be thirty (30)feet or one (1)foot for each foot of bank height, whichever is greater. This setback shall
be measured from the bank's edge when the bank's height exceeds 10 feet. When the bank's height is less
than 10 feet, the setback shall be measured from the ordinary high water mark.
6.) The development shall ensure that surface water runoff does not pollute adjacent waters or cause soil or beach
erosion, either during or after the construction phase.

11.) The maximum impervious surface coverage shall not exceed twenty-five(25) percent of the lot area.
12.) Minimum setback from the front property line (or the right-of-way line of North Beach Drive) shall be 20 feet.
Minimum side yard setbacks shall be 5 feet.
13.) The building height shall not exceed thirty-five (35) feet.
NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal
ordinances, regulations, or statutes applicable to the proposed development.
Development pursuant to this permit shall be undertaken subject to the applicable development and performance
standards of the Jefferson County Unified Development Code.
If during excavation or development of the site an area of potential archaeological significance is uncovered, all
activity in the immediate area shall be halted, and the Administrator shall be notified at once.
, The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon
became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA,
any person may bring lawsuit against any individual or agency that"takes"listed species (defined as causing
harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service
can levy penalties. All areas in Jefferson County are induded as"critical habitat"for a listed species.
Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if
protective measures are not taken. To minimize the potential to damage habitat, all property owners developing
adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following:
-Set back buildings, utilities and roads as far as possible from surface waters(streams, rivers, lakes, marine
waters), or at least 150 feet from the edge of the water
-All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters
- Remove minimal vegetation for site development, especially large trees
-Allow trees that have fallen into surface waters to remain there
- Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into
surface waters or roadside ditches
Any individual, group, or agency can bring suit for a listed species "taking", even if you are in compliance with
Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a
professional fisheries habitat biologist, and following the recommendations for site development provided by the
biologist. For more information, contact the National Marine Fisheries Service in Seattle at (206)526-6613, or the
U.S. Fish and Wildlife Service at(503) 231-6121.
Pursuant to RCW 36.70C, the applicant or any aggrieved party may appeal this final decision to Jefferson County
Superior Court within twenty-one (21) calendar days of the date of issuance of this land use decision. For more
information related tojudical appeals see UDC Section 8.5.2.
