The application was reviewed by the Jefferson County Department of Community Development staff on January 17, 2002 for the potential presence of Critical Areas or Environmentally Sensitive Areas (ESAs) under provisions of the Interim Critical Areas Ordinance (JCICAO). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following CAs were confirmed to be present on the subject property: Osprey Nest. 2.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 3.) The applicant is proposing to create or add 3100 square feet of impervious surface and 3042 square feet of land disturbing activities. Sections 6.6 and 6.7 of the Jefferson County Unified Development Code requires that your proposal submit a Small Parcel Erosion and Sediment Control Plan. The applicant submitted a Small Parcel Erosion and Sediment Control Plan with the building permit application. 4.) This approval is for a single family residence with attached garage only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 5.) The parcel is a legal conforming lot that is designated Single Family (4 dwelling units per acre) (MRP-SF 4:1) under the Jefferson County Comprehensive Plan Land Use Map effective August 28, 1998. 6.) Maximum impervious surface (lot coverage) shall not exceed 45 percent. 7.) Minumum setback from Rainer Lane Right-of-Way(a local access road) shall be 20 feet. Minimum side and rear yard setbacks shall be 5 feet. 8.) The building height shall not exceed 35 feet. 9.) Per Section 3.107 of the Port Ludlow Master Planned Resort Code, Accessory Dwelling Units shall not be allowed in the MPR-SF zone. 10.) The department requested WDFW review for potential impacts to Osprey Nests. Based on a July 20, 2001 WDFW letter pertaining to Osprey Review of 560 Rainer Lane; and a follow-up phone call on January 25, 2002, the subject property is located within 1/4 mile from the nearest Osprey Nest. Because the proposed activity is greater than 660-feet fromany documented osprey nest, it is unlikely that the activity will impact the osprey located in the vicinity of the subject property. WDFW made the following recommendations - (a) the removal of snags or live trees suitable for nesting may impact future nesting of osprey by eliminating potential nesting structure and should be avoided. (b) construction during the nesting season (April 1st through October 1st) should be avoided if a nesting pair is identified within 660 feet of the proposed construction. 11.) The site plan as submitted with the building permit application on 12/21/01 has been reviewed for consistency under the MPR. It has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the approved site plan date stamped 1/26/02 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 12.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. is\F_BLD_Permit Buildng.rpt 10/29/19 I Q02 • t!i ` of 1ER p fft, , _ • ----)/ $ I7...3..2.. t......................_-....i.......,.....,........................................r ,r,crl '' I s ..........,......: -...........'.. • cP n co C, re:7,D ' Itie' i d''.;c , r - `'. 1 .N , 4 ti ,, '. a t ...„:,... : fli t ,rr-,. it .. . a Q l'" ram. p 7:'' •a I 4 C t Ya►. e _ $ fa - i ` sEr CI e i In . .............. •.. ,. - ;53q:#k: 7 ..per-•plat.... . .. .. . . . ... .. / tATi_ v , lir , / S1 S f SM3 PLAN (w da .d -2 0--..G 2 - Assumed Hi . - .PROVED 7--- lyy JEFF RSONOMMI .: 3iw r C' DEPT. Development pursuant to this permit shall be undertaken subject to the applicable development and performance standards of the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: - Set back buildings, utilities and roads as far as possible from surface waters(streams, rivers, lakes, marine waters), or at least 150 feet from the edge of the water -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches Any individual, group, or agency can bring suit for a listed species "taking," even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle at (206)526-6613, or the U.S. Fish and Wildlife Service at(503) 231-6121. APPEALS: Pursuant to RCW 36.70C, the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court within twenty-one (21) calendar days of the date of issuance of this land use decision.
