The application was reviewed by the Jefferson County Department of Community Development staff on October 4, 2001 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Eagle, Type 9 stream, suburban shoreline designation. 2.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 3.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 4.) The revised site plan as submitted on October 31, 2001 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated November 1, 2001 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 5.) This approval is for a detached garage only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 6.) The proposed detached garage is located approximately 115 feet west of the existing single family residence. 7.) The easement located on the northern boundary is a utility easement. However, it appears this easement is also used as an ingress/egress easement per site inspection by Terry Duff of the Jefferson County Public Works Department. Per discussion with Al Scalf DCD Director, county will only require a 5 foot setback from north property boundary. 8.) An eagle plan was not required per comment from Shelly Ament(WDFW) on October 22, 2001. 9.) A building permit(BLD90-0258) was finaled on May 1, 1990 for a single family addition. 10.) A building permit(BLD99-0735) was finaled on November 30, 1999 for a woodstove installation. 11.) A septic permit(SEP90-060) was finaled on March 29, 1990. 12.) Maximum lot coverage shall not exceed 25%. 13.) Minimum setback from Oak Bay Road, a county minor collector road (C569908) shall be 20 feet. Minimum north and south setbacks shall be 5 feet. Minimum setback from shoreline shall be 75 feet. Proposed structure is located approximately 201 feet from west property boundary abutting Oak Bay Road. 14.) The building height shall not exceed 35 feet. • is\F_BLD_Permit_Buildng.rpt 1 0/29/1 9 4 , JEFFERSON COUNTY DEPARTMENT OF COMMUNITY DEVELOPMENT UNIFIED DEVELOPMENT CODE TYPE I LAND USE PERMIT APPLICANT: ROBERT SUTHER AMANDA SUTHER PO BOX 490 PORT HADLOCK WA 98339 DATE ISSUED: November 02, 2001 DATE EXPIRES: November 02, 2002 MLA NUMBER: MLA01-00479 PROJECT PLANNER: M FARFAN PROJECT DESCRIPTION: DETACHED GARAGE PROJECT LOCATION: Parcel number 921 194 001 in Section 19, Township 29, Range 01 East, WM located at 3811 Oak Bay Rd, Port Hadlock, WA 98339 FINDINGS: 1.) Development pursuant to this permit shall be undertaken subject to the applicable development and performance standards of the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes"listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to-damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -Set back buildings, utilities and roads as far as possible from surface waters(streams, rivers, lakes, marine waters), or at least 150 feet from the edge of the water -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches Any individual, group, or agency can bring suit for a listed species "taking," even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle at (206)526-6613, or the U.S. Fish and Wildlife Service at(503) 231-6121. APPEALS: Pursuant to RCW 36.70C, the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court within twenty-one (21) calendar days of the date of issuance of this land use decision. Attach additional sheets, if more space is required. [t -- Stabilize construction access route. Limit construction vehicles to one route, if feasible. Provide a stabilized construction access by applying quarry spalls, ballast, or crushed rock to minimize tracking sediment onto roads. (See attached illustration from Stormwater Management Manual.)
