The Department of Ecology has reviewed the above referenced Conditional Use permit to construct a stair tower in suburban designated shorelines of Hood Canal, a Shoreline of Statewide Significance. We concur that the proposal, as conditioned by Jefferson County,meets the intent of the master program and the criteria set forth in WAC 173-27-160 for granting a Conditional Use permit. I received a JARPA from Ronald Holsman, contractor, for a set of stairs to the beach on 5 July 2002 (copy provided to you on 20 March 2002, another copy attached for file). After a site visit with Ron Holsman on 10 July 01, during which we reviewed the site plans and I made very clear habitat concerns with bank destabilization and construction activities and structure on the beach, I determined that, if the submitted plans were followed, no HPA would be needed. This was codified in my 12 September 02 letter to Mr. Holsman (copy provided to you on 20 Mach 2002). On 14 March 02 I conducted a compliance visit with Keven Russel, Jefferson County, and found that the constructed project deviated significantly from the original proposed project. Of biggest concern, the row of two man rock that was to be placed by hand had been replaced with a three tier(minimum) row of Ecology Blocks, and the wood deck replaced with a preformed concrete slab. The beach had been modified, and wood piled around the seaward edge of the concrete slab. Jefferson county received revised plans to from Ron Holsman on 17 April 02. The plans were forwarded to me on approximately 24 April 02. To reiterate my conversations you and Ronald Holsman since 14 March 02, the work conducted was not what was proposed in the JARPA, was not permitted, but would have required an HPA. In it's current configuration it would not have been permitted. The combination of ecology block wall and concrete slab will likely have significant negative impacts to the nearshore environment via bluff destabilization and amplification of marine energy. The slab structure also appears to protrude further out from the bank than originally proposed (hence stacking of beach wood in front of the slab) which, in addition to an impact themselves, will likely further exacerbate nearshore impacts. After our 29 April 02 site visit with Jeff Stewart I agree that there are no likely mitigation alternatives in the vicinity of the site. The first priority is to prevent further damage to the nearshore environment. Given likely impact to the bluff and shoreline from the structure that was installed, I would recommend that we require written assurance from Holsman that no further 4 May 2002 Page 2 bank stabilization work will be done, or applied for for the life of the structure. If the structure can be removed without further destabilizing and impacting the shoreline I would recommend immediate removal. If it can't, I recommend Holsman be cited, and if possible, a bond invoked to pay for future repair of shoreline that will likely be needed. Please let me know if I can provide additional information. SPECIAL CONDITIONS FOR CASE BLD01-006Sb 1.) The application was reviewed by the Jefferson County Department of Community Development staff on 7/12/01 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Eagle Habitat, and Shoreline (Suburban). 2.) A Site Plan Advanced Approval Determination (SPAAD) was conducted and approved on the subject property (ZON01-00048). The submitted building applications for the stairs, single family dwelling, and detached garage comply with the original site plan and SPAAD approval. 3.) Approval has been granted for construction of a staircase down to the beach. The shoreline permit approval is filed under SDP01-00022. 4.) A Geotechnical Report was submitted in conjunction with this application. The report addressed the stability of the geologic hazard area. A setback of 10-feet shall be measured perpendicularly from the top or toe of the geologic hazard to the proposed STAIRCASE. The single family dwelling and detached garage shall maintain a 32-40'foot setback from the shoreline bluff. This setback is a one to one ratio from the height of the bluff. The submitted site plan complies with this requirement. 5.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 6.) Buffers are areas that shall be maintained in their natural condition, however, minor pruning or alteration of vegetation may be permitted as long as the function and character of the buffer are not diminished. 7.) Among the native conifer species which may be used in buffers or for re-vegetation include, but are not limited to: Grand Fir(Aibes grandis), Sitka Spruce (Picea Sitchensis), Shore Pine (Pinus Contorta), Douglas Fir(Pseudotsuga Menziesii), Western Red Cedar (Thuja Plicate), and Western Hemlock (Tsuga Heterophylla). Among native tree species which may be used includes: Vine Maple (Acer Circinatum), Big-Leaf Maple (Acer Macrophyllum), Red Alder(Alnus Rubra), Pacific Madrone(Arbutus Menziesii), Quaking Aspen (Populus Tremula), Black Cottonwood (Populus Trichocarpa), Bitter Cherry(Prunus Emarginata), Oregon White Oak (Quercus Garryana), Cascara (Rhamnus Purshiana), Pacific Willow(Saliz Lasiandra), and Scouler's Willow (Saliz Scouleriana). Among the native shrub species which may be used are: Sevice-Berry (Amalanchier Alnifolia), Red Osier Dogwood (Comus Stolonifera) Salal (Gaultheria Shallon), Ocean Spray (Holodiscus Discolor), Indian Plum (Oemlaria Cerasiformis), Pacific Ninebark (Physocarpus Capitus), Red Flowering Currant(Ribes Sanguineum), Wild Rose (Rosa Nutkana), Swamp Rose (Rosa Pisocarpa), Willows (Salix ssp.), Red Elderberry (Sambucus Racemosa), Snowberry(Symphoricarpos Albus), Evergreen Huckleberry (Vaccinium Ovatum), Red Huckleberry (Vaccinium Parvifolium). 8.) A vegetative buffer of 30-feet shall be permanently maintained from the top or edge of the Landslide Hazard Area. All buffers shall be measured perpendicularly from the top of the Landslide Hazard Area. However, the shoreline stairs shall maintain a 10-foot setback from the top of the bluff. 9.) All construction activities shall not encroach upon the buffer. This includes the storage or preparation of materials. 10.) The applicant shall permanently separate the boundary of the Landslide Hazard Area Buffer from the remainder of the subject property through installing logs, trees, a hedge row, or any other prominent physical marking approved by the UDC Administrator. 11.) The applicant shall fully adhere to all conditions and requirements of the eagle habitat management plan. 12.) The applicant is proposing to create or add more than 3,000 square feet of impervious surface. Sections 6.6 and 6.7 of the Jefferson County Unified Development Code requires that your proposal submit a Small Parcel Sediment and Erosion Control Plan. The applicant shall fully adhere to all of the provisions specified in the submitted and approved plan. 13.) A Small Parcel Sediment and Erosion Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 14.) The site plan as submitted with the building application on 11/21/01 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes,and/or additions to the stamped, approved site plan dated 12/02/01 shall be resubmitted for review and approval by Jefferson County Department of Community Development 15.) Maximum lot coverage is not to exceed 25%. Lot coverage is calculated by the amount of impervious surface which includes driveways, roof tops,concrete, etc. 16.)
